      This is an application for bail under Section 439<\/a> of the Code of<\/p>\n
Criminal Procedure. The petitioner is accused No.3 in Crime No.378 of<\/p>\n
2008 of the Adimaly Police Station.\n<\/p>\n
\n
      2. The offence alleged against the petitioner are under Sections<\/p>\n
143<\/a>, 147<\/a>, 148<\/a>, 115<\/a>,323<\/a>, 324<\/a>, 307<\/a> and 427<\/a> read with Section 149<\/a> of the<\/p>\n
Indian Penal Code.\n<\/p>\n
\n
      3. The prosecution case is that the petitioner along with the other<\/p>\n
accused persons attempted to murder the de facto complainant.             It is<\/p>\n
stated that the de facto complainant was pulled down from the jeep and<\/p>\n
was manhandled by the accused persons.                The de facto complainant<\/p>\n
sustained serious injuries. The petitioner was arrested on 4.4.2009. The<\/p>\n
second accused was granted bail by this Court, as per the order dated<\/p>\n
28.4.2009 in B.A.No.2224 of 2009.           The first accused and the fourth<\/p>\n
accused are absconding.         In the order granting bail to the second<\/p>\n
accused, it is stated that considerable part of the investigation is over.<\/p>\n
Learned counsel for the petitioner submitted that no overt act as such is<\/p>\n
alleged against the petitioner.\n<\/p>\n

                                         :: 2 ::\n<\/p>\n
       4. Taking into account the facts and circumstances of the case, the<\/p>\n
duration of the judicial custody undergone by the petitioner, the nature of<\/p>\n
the offence and the present stage of investigation, I am of the view that<\/p>\n
bail can be granted to the petitioner.\n<\/p>\n
\n
       5. The petitioner shall be released on bail on his executing bond<\/p>\n
for Rs.50,000\/- with two solvent sureties for the like amount to the<\/p>\n
satisfaction of the Judicial Magistrate of the First Class, Adimaly, subject<\/p>\n
to the following conditions:\n<\/p>\n
\n
a)     The petitioner shall report before the investigating officer between 9<\/p>\n
       A.M.    and 11 A.M. on all Mondays, till the final report is filed or<\/p>\n
       until further orders;\n<\/p>\n
\n
b)     The petitioner shall appear before the investigating officer for<\/p>\n
       interrogation as and when required;\n<\/p>\n
\n
c)     The petitioner shall not try to influence the prosecution witnesses or<\/p>\n
       tamper with the evidence;\n<\/p>\n
\n
d)     The petitioner shall not commit any offence or indulge in any<\/p>\n
       prejudicial activity while on bail;\n<\/p>\n

\n
e)    The petitioner shall not enter into the limits of Adimaly Police<\/p>\n
      Station until further orders, except for the purpose of reporting to<\/p>\n
      the investigating officer.\n<\/p>\n

f)    In case of breach of any of the conditions mentioned above, the<\/p>\n
      bail shall be liable to be cancelled.\n<\/p>\n
\n
      The Bail Application is allowed as above.<\/p>\n
