SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/03\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">1.\tRule.\n<\/p>\n<p id=\"p_1\">Mr. Dave, learned AGP, waives service of notice of Rule on behalf of<br \/>\nrespondent nos. 1 and 2 and Mr. Vyas, learned advocate, waives<br \/>\nservice of notice of Rule on behalf of respondent nos. 3 and 5. With<br \/>\nthe consent of the learned advocates for the respective parties, the<br \/>\nmatter is taken up for final hearing today.\n<\/p>\n<p id=\"p_2\">2.\tBy<br \/>\nway of this petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India,<br \/>\nthe petitioners have prayed for an appropriate writ, direction and<br \/>\norder quashing and setting aside the impugned communication dated<br \/>\n2.8.2010 (Annexure K) issued upon the Surat Urban Development<br \/>\nAuthority, by which the application submitted by petitioners for<br \/>\ndevelopment permission\/ sanction of the plan has been filed \/<br \/>\nrejected, at this stage, by observing that the land in question is in<br \/>\nthe proposed Town Planning Scheme No.13  (T-30) and unless and until<br \/>\nthe measurement by DILR is not completed the application of the<br \/>\npetitioner for development permission cannot be considered.\n<\/p>\n<p id=\"p_3\">3.\tShri<br \/>\nAmit Thakkar, learned advocate for the petitioners has submitted that<br \/>\nas on today there is no intention declared by the appropriate<br \/>\nauthority with respect to Town Planning Scheme No.30(T-30) and<br \/>\ntherefore, it cannot be said that the proceedings under the Town<br \/>\nPlanning Act have been initiated and therefore, the action of the<br \/>\nrespondent authority in not considering the application of the<br \/>\npetitioners for development permission and\/ or not to sanction the<br \/>\napplication on the aforesaid ground cannot be sustained. Shir Amit<br \/>\nThakkar, learned advocate for the petitioners has heavily relied upon<br \/>\nthe order passed by this Court dated 27.8.2010 passed in Special<br \/>\nCivil Application  No.6055 of 2010 by which in the similar set of<br \/>\ncircumstances when even with respect to Town Planning Scheme No. T-26<br \/>\nand T-27 no intention was declared and the respondent authority<br \/>\nrefused to consider the application for development permission, this<br \/>\nCourt directed the appropriate authority to consider same.\n<\/p>\n<p id=\"p_4\">4.\tShri<br \/>\nVyas, learned advocate for the Surat Urban Development Authority is<br \/>\nnot in a position to dispute that as on date there is no intention<br \/>\ndeclared by the appropriate authority with respect to Town Planning<br \/>\nScheme No.30 (T-30). Considering the earlier order passed by this<br \/>\nCourt dated 27.8.2010 passed in Special Civil Application No.6055 of<br \/>\n2010, he has submitted that let the petitioners submit an appropriate<br \/>\napplication afresh, which shall be considered in accordance with law<br \/>\nand on merits at the earliest.\n<\/p>\n<p id=\"p_5\">5.\tIn<br \/>\nview of the above and considering the earlier order passed by this<br \/>\nCourt dated 27.8.2010 passed in Special Civil Application No.6055 of<br \/>\n2010  for the reasons stated in the said order, the impugned<br \/>\ncommunication of the respondent-Surat Urban Development Authority<br \/>\ndated 2.8.2010 in not considering the application of the petitioners<br \/>\nfor development permission \/ sanctioning plan on merits at this<br \/>\nstage, cannot be sustained and same is hereby quashed and set aside.<br \/>\nLet the petitioners submit appropriate application afresh for<br \/>\nsanction of the plan and development permission, which shall be<br \/>\nconsidered by the appropriate authority, more particularly, Surat<br \/>\nUrban Development Authority in accordance with law and on merits and<br \/>\nthe same shall not be refused on the ground that  the land in<br \/>\nquestion is likely to be covered under the Town Planning Scheme No.30<br \/>\n(T-30) so long as intention with respect to the said scheme is not<br \/>\ndeclared. The aforesaid exercise shall be completed by the Surat<br \/>\nUrban Development Authority within a period of four months from the<br \/>\ndate of submission of afresh application by the petitioners and the<br \/>\nsame shall be considered in accordance with law and on merits as<br \/>\nobserved herein above.
