JUSTICE SUNIL HALI, JUDGE       \nDate: 16\/11\/2009 \n:J U D G M E N T :\n<\/pre>\n<p id=\"p_1\">Dispute with respect to the inheritance regarding land<br \/>\nmeasuring 8 acres comprised in Khasra nos. 103, 107, 109,<br \/>\n109 min, 110 and 111 situated at village Ghore Bains tehsil R.<br \/>\nS. Pura, has been engaging the parties in various courts. It is<br \/>\ncontended that Ananti Devi allegedly made a Will of her<br \/>\noccupancy rights in favour of Karan Singh and Kanta Devi. In<br \/>\nthis respect a civil suit came to be filed before the trial Court in<br \/>\nwhich decree was passed in favour of the petitioner. On an<br \/>\nappeal being filed before the learned District Judge, the decree<br \/>\npassed by the trial Court was set aside. Against this Civil<br \/>\nSecond Appeal was filed in this Court. This Court vide order<br \/>\npassed on 22.05.2003 directed that operation of the impugned<br \/>\n<span class=\"hidden_text\" id=\"span_1\">2<\/span><br \/>\njudgment and decree shall stay. The second appeal was,<br \/>\nhowever, dismissed for default on 30.09.2003. While passing<br \/>\nthe order of dismissal, this Court had vacated the stay order<br \/>\ngranted on 22.05.2003. The appeal was restored on<br \/>\n15.04.2004 to its original number subject to payment of Rs.<br \/>\n500\/- as costs.\n<\/p>\n<p id=\"p_1\">It is contended by the petitioner that after restoration of<br \/>\nthe appeal, respondents dispossessed him, from the land in<br \/>\nquestion and it is under these circumstances the present<br \/>\ncontempt petition has been filed.\n<\/p>\n<p id=\"p_2\">Respondents in their objections have stated that one Raj<br \/>\nSingh had filed a suit before learned Munsiff R.S.Pura wherein<br \/>\norder of status quo was passed on 12.06.2003. On an<br \/>\napplication filed by Raj Singh, plaintiff, direction was issued to<br \/>\nS.H.O. Police Station R. S. Pura to implement the order of<br \/>\n12.06.2003 and ensure that no obstruction is caused in<br \/>\ncultivating the suit land by the applicant. Against this order an<br \/>\nappeal is stated to have been preferred by the present<br \/>\nrespondents before learned Ist Additional District Judge<br \/>\nJammu, who, vide order dated 16.04.2004, set aside the orders<br \/>\npassed by learned Munsiff R. S. Pura. It is contended that Raj<br \/>\nSingh was acting as an intermediater for and on behalf of the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">3<\/span><br \/>\npetitioner in claiming to be in possession of the land for and on<br \/>\ntheir behalf.\n<\/p>\n<p id=\"p_3\">The positive case of the respondents is that petitioner<br \/>\nwas never in possession of the property nor was there any<br \/>\norder of stay passed by this Court.\n<\/p>\n<p id=\"p_4\">I have the learned counsel for the parties.<br \/>\nIt is contended by the petitioner that after the restoration<br \/>\nof the appeal the stay order was to automatically revive.<br \/>\nLearned counsel for the petitioner has contended that after<br \/>\nrevival of the appeal, stay order becomes operational and<br \/>\nrespondents could not have dispossessed her from the said<br \/>\npiece of land. He contends that respondents trespassed in the<br \/>\nland on 26.06.2004 but failed to dispossess the petitioner on<br \/>\nthat date and subsequently they trespassed into land on<br \/>\n07.07.2004 by ploughing it with five tractors. He has placed<br \/>\nreliance on a judgment of Hon&#8217;ble Supreme Court, in <a href=\"\/doc\/19951\/\" id=\"a_1\">Vareed<br \/>\nJacob v. Sosamma Geevarghese &amp; Ors<\/a>, reported as AIR 2004<br \/>\nSC, 3992.\n<\/p>\n<p id=\"p_5\">The stand of the respondents is enumerated herein<br \/>\nabove. The power to proceed for non-compliance of an order of<br \/>\ninjunction passed under Order 39 Rule 1 and 2 of the Code of<br \/>\nCivil procedure is under Rule 2 (a). The determination is<br \/>\nrequired to be obtained from the Court that the contemnor has<br \/>\n<span class=\"hidden_text\" id=\"span_2\">4<\/span><br \/>\nviolated the order of the Court and then appropriate orders are<br \/>\nrequired to be passed by the Court after such determination.<br \/>\nThe present petitioner has not taken any steps to adduce<br \/>\nevidence to prove the alleged violation of the Court order by the<br \/>\nrespondents. It is yet to be seen as to whether the present<br \/>\npetitioner was in actual possession of the property at the time<br \/>\nthe order of stay was granted by the Court and consequently<br \/>\nwhen the appeal was restored to its original number. It is all<br \/>\nmatter of proof. Petitioner was required to prove these facts<br \/>\nbefore seeking the punishment of the respondents for having<br \/>\nviolated the Court order. Petitioner has failed to prove all these<br \/>\nallegations in this contempt petition.\n<\/p>\n<p id=\"p_6\">Petitioner&#8217;s other contention that on revival of the appeal<br \/>\nthe order of stay would get automatically revived, cannot be<br \/>\naccepted in the present case. The judgment relied upon by the<br \/>\npetitioner clearly makes a distinction that once the suit or<br \/>\nappeal is dismissed, there is automatic revival of the stay,<br \/>\nunless Court expressly or impliedly excludes its operation. It is<br \/>\nadmitted in the present case that when the appeal was<br \/>\ndismissed for default, the interim order of stay passed by this<br \/>\nCourt was also vacated. Once the order of stay was vacated,<br \/>\nthe revival of appeal would not automatically mean that the stay<br \/>\norder has also been revived.
