On appreciation of<br \/>\nevidence and after hearing the learned advocates for the parties, the<br \/>\ntrial court, by its judgment and order dated 3.12.1991, dismissed the<br \/>\nsuit.  Against the said judgment and order, Regular Civil Appeal No.<br \/>\n4\/92 came to be filed by the petitioners-original plaintiffs. The<br \/>\nfirst appellate court, on appreciation of evidence and after hearing<br \/>\nthe learned advocates for the parties, dismissed the appeal<br \/>\nconfirming the judgment and order passed by the trial court vide its<br \/>\njudgment and order dated 31.8.1998.  Therefore, the present revision<br \/>\napplication has been preferred.\n<\/p>\n<p id=\"p_2\">3.\tLearned<br \/>\ncounsel Mr. Mehul Shah for the petitioners submitted referring to the<br \/>\njudgment of the trial court in Regular Civil Suit No. 200\/85 that<br \/>\nonce acquisition of alternate premises has been accepted in the<br \/>\nwritten statement as well as in the evidence, the question of<br \/>\nsuitability of such alternate premises is required to be considered.<br \/>\nHe submitted that, as transpires from the evidence, admittedly, the<br \/>\nrespondent-defendant has stated that there are only two persons in<br \/>\nhis family, as the brother and his family as well as the mother have<br \/>\ngone to Bhavnagar, which both the courts below have not appreciated.<br \/>\nLearned counsel Mr. Shah submitted that, on the basis of the<br \/>\nevidence, as could be seen from the issues, particularly Issue No. 5<br \/>\nregarding acquiring of suitable accommodation, the finding is &#8216;yes&#8217;.<br \/>\nTherefore, the same has been discussed though the suit has been<br \/>\ndismissed. He therefore submitted that the first appellate court<br \/>\nought to have appreciated this aspect and the suit ought not to have<br \/>\nbeen dismissed.  He has submitted that acquisition of other<br \/>\naccommodation even on rental basis would be sufficient.  He submitted<br \/>\nthat this aspect has not been appreciated by the first appellate<br \/>\ncourt inasmuch as, if this finding is in favour of the plaintiffs,<br \/>\nthe cross-objection could have been filed by the defendant-tenant.\n<\/p>\n<p id=\"p_3\">4.\tLearned<br \/>\ncounsel Mr. Shah referred to O.41 R.22  and submitted that as there<br \/>\nwere no cross-objections filed on this aspect, at least the lower<br \/>\nappellate court could not have given the finding against the<br \/>\npetitioners-original plaintiffs landlord.  He has also referred to<br \/>\nthe explanation and submitted that both the courts below have thus<br \/>\ncommitted an error. He has also referred to the testimony\/evidence of<br \/>\nthe plaintiffs at exh. 28 and the defendant-tenant at exh. 55.  He<br \/>\ntherefore submitted that as both the courts have failed to appreciate<br \/>\nthis aspect with regard to acquisition of suitable premises which has<br \/>\nbeen admitted by the defendant-tenant, the decree ought not to have<br \/>\nbeen passed and in fact the discussion by the trial is in favour of<br \/>\nthe plaintiffs though the suit has been dismissed, which has not been<br \/>\nappreciated by the lower appellate court.\n<\/p>\n<p id=\"p_4\">5.\tThe<br \/>\nsubmissions have been made by learned counsel Mr. Shah referring to<br \/>\nthe judgment as well as the evidence.  However, a close look at the<br \/>\nwritten statement at exh. 17 clearly suggests that it cannot be said<br \/>\nthat it has been admitted by the defendant about the acquisition of<br \/>\nsuitable accommodation.  In fact, what has been stated is that the<br \/>\nfamily of the defendant is large including the brother, his family,<br \/>\nmother and there are guests, which led to the hardship and therefore<br \/>\nby way of temporary arrangement they were using other alternate<br \/>\npremises which has also been taken away by the landlord subsequently<br \/>\nas it transpires from the evidence.  The same version has been stated<br \/>\nby the defendant-tenant in th evidence at exh. 55.  Therefore, the<br \/>\nmoot question is whether it can be said that the defendant-tenant can<br \/>\nbe said to have acquired suitable alternate accommodation.\n<\/p>\n<p id=\"p_5\">6.\tThough<br \/>\nthe reasoning given by the trial court may not have been with<br \/>\nclarity, it has to be read in context of th entire evidence and the<br \/>\nfindings given.  The lower appellate court has also specifically<br \/>\nobserved on appreciation of evidence, referring to aspect of<br \/>\nacquisition of alternate suitable premises, and has not accepted the<br \/>\ncontention of the plaintiffs and the appeal has been dismissed.  It<br \/>\nhas also been mentioned that, &#8220;the plaintiff did not examine<br \/>\nany witnesses to prove that the defendant and wife of the defendant&#8217;s<br \/>\nbrother etc. are residing in the room of Ranchhodnagar and that room<br \/>\nhas better facility than of the suit room. The plaintiff did not<br \/>\nexamine any neighbour or any person who are residing nearby the room<br \/>\nof Ranchhodnagar&#8230;&#8230; The plaintiff failed to prove that the<br \/>\ndefendant is in possession of the room of Ranchhodnagar which is<br \/>\nsuitable accommodation.&#8221;\n<\/p>\n<p id=\"p_6\">7.\tIn<br \/>\nthe circumstances, appreciating the evidence and the rival<br \/>\nsubmissions, the concurrent findings of facts arrived at by the<br \/>\ncourts below does not call for any interference in exercise of the<br \/>\nrevisional jurisdiction by this court as the conclusion cannot be<br \/>\nsaid to be erroneous.\n<\/p>\n<p id=\"p_7\">8.\tThe<br \/>\nsubmissions which have also been made by learned counsel Mr. Shah<br \/>\nreferring to sec. 29(2) of the <a href=\"\/doc\/679372\/\" id=\"a_1\">Rent Act<\/a> that though it is a revision,<br \/>\nit is under a special statute and therefore the court has to satisfy<br \/>\nitself that the decision of the courts below was according to law is<br \/>\nalso misconceived.  In fact, the court has perused the record<br \/>\nincluding the deposition of both the plaintiff and the defendant, and<br \/>\nas discussed hereinabove, having  considered  the specific<br \/>\ncontentions the conclusion is arrived at which is just and proper.<br \/>\nIt is required to be mentioned that the provisions of sec. 29(2) of<br \/>\nthe <a href=\"\/doc\/679372\/\" id=\"a_1\">Rent Act<\/a> are enabling provisions for the High Court to satisfy<br \/>\nitself that the decision arrived at is according to law and there is<br \/>\nno mistake resulting into miscarriage of justice due to any wrong<br \/>\napproach or misconception of law.\n<\/p>\n<p id=\"p_8\">9.\tA<br \/>\nuseful reference can be made to the observations of the Hon&#8217;ble Apex<br \/>\nCourt in a judgment in the case of <a href=\"\/doc\/1647272\/\" id=\"a_2\">Patel Valmik Himatlal and ors.<br \/>\nv. Patel Mohanlal Muljibhai<\/a> (dead) through Lrs, reported in AIR<br \/>\n1998 SC 3325. The Hon&#8217;ble Apex Court has observed,<\/p>\n<p>&#8220;5.\n<\/p>\n<p id=\"p_9\">The ambit and scope of the said section came up for consideration<br \/>\nbefore this Court in <a href=\"\/doc\/1378557\/\" id=\"a_3\">Helper Girdharbhai v. Saiyed Mohmad Mirasaheb<br \/>\nKadri<\/a>, (1987) 3 SCC 538 : (AIR 1987 SC 1782) and after referring to a<br \/>\ncatena of authorities, Sabyasachi Mukharji, J. drew a distinction<br \/>\nbetween the appellate and the revisional jurisdictions of the Courts<br \/>\nand opined that the distinction was a real one. It was held that the<br \/>\nright to appeal carries with it the right of rehearing both on<br \/>\nquestions of law and fact, unless the statute conferring the right to<br \/>\nappeal itself limits the rehearing in some way, while the power to<br \/>\nhear a revision is generally given to a particular case is decided<br \/>\naccording to law. The Bench opined that although the High Court had<br \/>\nwider powers than that which could be exercised under Section 115 of<br \/>\nthe Code of Civil Procedure, yet its revisional jurisdiction could<br \/>\nonly be exercised for a limited purpose with a view to satisfying<br \/>\nitself that the decision under challenge before it is according to<br \/>\nlaw. The High Court cannot substitute its own findings on a question<br \/>\nof fact for the findings recorded by the Courts below on reappraisal<br \/>\nof evidence. Did the High Court exceed its jurisdiction ?&#8221;\n<\/p>\n<p id=\"p_10\">10.\tTherefore,<br \/>\na discretion is given to the High Court to satisfy itself about the<br \/>\ndecision reached by the courts below and once it is found that the<br \/>\nview taken by the courts below, particularly the concurrent findings<br \/>\nof facts arrived at by both the courts below based on evidence is a<br \/>\nplausible view, it cannot be said that there is any error, much less<br \/>\nany error resulting in miscarriage of justice. In other words, unless<br \/>\nit is shown that the courts below have misdirected in arriving at the<br \/>\ndecision and have committed an error in application of law or in<br \/>\nconstruing the provision of law or a document, the findings of facts<br \/>\nbased on appreciation of evidence cannot be interfered with.\n<\/p>\n<p id=\"p_11\">11.\tIn<br \/>\nthe circumstances, as there is no such error committed by both the<br \/>\ncourts below, the present revision application cannot be entertained<br \/>\nand deserves to be rejected and accordingly sands rejected.  Rule is<br \/>\ndischarged. No order as to costs.\n<\/p>\n<p id=\"p_12\">(Rajesh<br \/>\nH.
