Oja, learned Senior Standing Counsel for the applicant has<br \/>\n\tinvited attention to the averments made in the application to<br \/>\n\tdemonstrate that initially, a consolidated tax appeal had been filed<br \/>\n\tin relation to nine appeals which had been preferred before the<br \/>\n\tTribunal, hence, the applicant was required to file eight other<br \/>\n\tappeals. That, the appeal which had been filed initially was within<br \/>\n\ttime and that on account of technical objection, separate appeals<br \/>\n\twere required to be filed. It is submitted that in the<br \/>\n\tcircumstances, as such, there is no delay in filing the tax appeal<br \/>\n\tand only on the ground that separate appeals were required to be<br \/>\n\tfiled that there is delay in filing this appeal.\n<\/p>\n<p id=\"p_3\">In<br \/>\n\tthe light of the submissions advanced by the learned Senior Standing<br \/>\n\tCounsel, it is apparent that the consolidated appeal had been filed<br \/>\n\tin time, however, on account of technical grounds, namely, that<br \/>\n\tseparate appeals were required to be filed, the applicant was<br \/>\n\trequired to file separate appeal. Since, the consolidated appeal had<br \/>\n\tbeen filed within the prescribed period of limitation, as such, it<br \/>\n\tcannot be said that there is any delay in filing the tax appeal.\n<\/p>\n<p id=\"p_4\">For<br \/>\n\tthe foregoing reasons,  the application succeeds and is accordingly<br \/>\n\tallowed. The delay caused in filing Tax Appeal [Stamp] No.  344 of<br \/>\n\t2011 is hereby condoned.
