It<br \/>\n\tappears that the allegations are against the brother of the<br \/>\n\taccused-applicant who eloped with the girl named Somiben whose<br \/>\n\twhereabouts are not known till this date. It appears from the papers<br \/>\n\tof the prosecution that brother of the accused-applicant is in love<br \/>\n\twith Somiben and wants to get married. The accused applicant is a 21<br \/>\n\tyears old boy. No specific role is described to him much less role<br \/>\n\tof abettor.\n<\/p>\n<p id=\"p_6\">(B)\tAccused<br \/>\n\tNo.1 i.e. main accused is arrested and is behind the bars.\n<\/p>\n<p id=\"p_7\">\tIn<br \/>\nthis view of the matter, I am persuaded to exercise my discretion in<br \/>\nfavour of the accused-applicant. Under the circumstances,<br \/>\naccused-applicant is ordered to be enlarged on regular bail in<br \/>\nconnection with offence registered with Radhanpur Police Station,<br \/>\nPatan being I-C.R.No.50 of 2011 on his executing a bond in the sum of<br \/>\nRs.15,000\/- (Rupees fifteen thousand only) with one surety of the<br \/>\nlike amount to the satisfaction of the lower Court and subject to the<br \/>\nconditions that he shall:\n<\/p>\n<p id=\"p_8\">not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p id=\"p_9\">not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_10\">maintain<br \/>\n\tlaw and order;\n<\/p>\n<p id=\"p_11\">mark<br \/>\n\this presence before the concerned Police Station on every 2nd<br \/>\n\tand 4th Sunday of every month between 10:00 am to 2:00 pm<br \/>\n\ttill the completion of the trial;\n<\/p>\n<p id=\"p_12\">not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p id=\"p_13\">furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p id=\"p_14\">surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p id=\"p_15\">\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p id=\"p_16\">\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p id=\"p_17\">\tRule<br \/>\nis made absolute.
