Government Pleader.\t\t\t\t\n\t\t\n:ORDER\n<\/pre>\n<p id=\"p_1\">Heard both sides and perused the records.\n<\/p>\n<p id=\"p_1\">\t2.\tThe prayer of the petitioner is to grant pension under the Scheme<br \/>\nfor Pension for &#8220;Mozhipor Thyagi&#8221; which literally means Martyr in Tamil Language<br \/>\nAgitation.\n<\/p>\n<p id=\"p_2\">\t3.\tThe writ petition was admitted on 23.04.2005.  The petitioner&#8217;s<br \/>\nprayer for an interim direction was not granted by this Court.\tOn notice from<br \/>\nthis Court, the first respondent filed a counter affidavit dated 20.11.2005 and<br \/>\nto which, a reply affidavit dated 07.02.2006 has been filed by the petitioner.\n<\/p>\n<p id=\"p_3\">\t4.\t<a href=\"\/doc\/195458\/\" id=\"a_1\">By the Tamil Nadu Act<\/a> of 23 of 1983, known as  &#8220;Tamil Nadu Payment<br \/>\nof Pension to Tamil Scholars and <a href=\"\/doc\/269107\/\" id=\"a_2\">Miscellaneous Provisions Act<\/a>, 1983 was enacted<br \/>\nby the State Legislature&#8221;. Under <a href=\"\/doc\/1941999\/\" id=\"a_3\">Section 2<\/a> (d), the term &#8220;Martyr&#8221; is defined,<br \/>\nwhich is as follows:-\n<\/p>\n<p id=\"p_4\">&#8220;d.&#8221;martyr&#8221; means a person, who has evinced enthusiasm for Tamil language and<br \/>\nTamil culture and whole arriving to uphold his enthusiasm for Tamil language or<br \/>\nin preserve the growth of Tamil language or to preserve the Tamil culture, has<br \/>\nlost his life.&#8221;\n<\/p>\n<p id=\"p_5\">\t5.\tUnder <a href=\"\/doc\/774445\/\" id=\"a_4\">Section 3<\/a> of the Act, it is guaranteed that the Government may<br \/>\nsanction pension for the following two categories:-<br \/>\n\t&#8220;a) to every person who has exhibited conspicuous courage and nobility in<br \/>\nhis enthusiasm for the Tamil language or in his zeal to preserve the growth of<br \/>\nTamil language or to preserve the Tamil culture.\n<\/p>\n<p id=\"p_6\">\tb)\tto the dependant of every martyr.&#8221;\n<\/p>\n<p id=\"p_7\">\t6.\tIt is stated under <a href=\"\/doc\/893197\/\" id=\"a_5\">Section 4(4)<\/a>V, the Government may consider<br \/>\nseveral factors under <a href=\"\/doc\/893197\/\" id=\"a_6\">Section 4<\/a>, for the grant of Sanction of Pension or<br \/>\nScholarship. Under <a href=\"\/doc\/893197\/\" id=\"a_7\">Section 4(4)<\/a>V, one of the factor is the nature of suffering<br \/>\neither by way of imprisonment or otherwise undergone by the applicant or martyr.<br \/>\nWhat is described in 4(4)V is one of the guidelines and that itself cannot<br \/>\nbecome the sole factor for the pension.\n<\/p>\n<p id=\"p_8\">\t7.\tThe Government has prescribed the Rules under the Act by<br \/>\nG.O.Ms.No.21, Tamil Development dated 20.06.1984.  Under the said G.O. in Rule<br \/>\nNo.5 it is stated any application sent to the Government for the benefit under<br \/>\nthe Act will be referred to an High Power Committee to be constituted by the<br \/>\nGovernment.  Only if the Government is satisfied about the eligibility of the<br \/>\nperson, it can consider the sanction, pension grant or scholarship and after<br \/>\ntaking note of the recommendations of the Committee, the Government may order<br \/>\nthe pension or the scholarship as the case may be.\n<\/p>\n<p id=\"p_9\">\t8.\tThe Government constituted a High Level Committee by G.O.Ms.No.172,<br \/>\nTamil Development, dated 27.08.1996, under the Chairmanship of the Minister for<br \/>\nTamil Official Language and Culture.  During the meeting held on 10.06.1998, it<br \/>\nwas decided that those who are convicted and imprisoned in various jails for<br \/>\nmore than 14 days alone shall be considered for sanction of pension under that<br \/>\nScheme.\n<\/p>\n<p id=\"p_10\">\t9.\tThough the petitioner claimed that he was imprisoned for more than<br \/>\none month from 13.06.1965 to 11.06.1965,  the report of the Collector was showed<br \/>\nhe was convited only one day, i.e. on 13.06.1965 and it was stated that the<br \/>\npetitioner had produced a false certificate.\n<\/p>\n<p id=\"p_11\">\t10.\tIn the reply affidavit, the petitioner had not denied this averment.<br \/>\nHe merely stated that even for one day imprisonment will be covered by Section<br \/>\n4(4)V of the Act.  Therefore, though in the typed set, the petitioner had<br \/>\nproduced a certificate from the Sub-Jail, Kodaikonal, showing that his date of<br \/>\nadmission to the jail was on 13.02.1965 and date of release was on 14.03.1965,<br \/>\nhis status was described as an undertrial.\n<\/p>\n<p id=\"p_12\">\t11.\tThe High Power Committee had laid down the guidelines that those who<br \/>\nare convicted and imprisoned in jails for more than 14 days will be considered<br \/>\nfor pension.  The petitioner by placing reliance upon Section 4(4)V of the Act<br \/>\nstated that the prerequisite of 14 days conviction is not valid but it has no<br \/>\nrelevance to the present case since the said sub-section lists out five<br \/>\nguidelines and it is only the 5th guidelines which states &#8220;suffering by way of<br \/>\nan imprisonment by an applicant&#8221;.  Though it is argued that the High Power<br \/>\nCommittee cannot lays down guidelines by prescribing a minimum number of day of<br \/>\nconviction and imprisonment, the said issue is not relevant and need not be<br \/>\nconsidered by this Court in the case of the applicant.\n<\/p>\n<p id=\"p_13\">\t12.It is an admitted fact that he was convicted for only one day and that<br \/>\ncannot to be said to be suffering within the meaning of Section 4(4)V of the<br \/>\nAct.  Therefore, the Government was right in rejecting his claim based on  the<br \/>\nHigh Power Committee&#8217;s recommendations.  If the petitioner feels that he was put<br \/>\nto suffering it is for him to convince the Government about the same by placing<br \/>\nmaterials with them. That has not been done so.  It is for the petitioner to<br \/>\nmake out a fresh application and set out the circumstances for grant of pension.\n<\/p>\n<p id=\"p_14\">\t13.\tBut on no ground, he can question the guidelines prescribed by the<br \/>\nHigh Power Committee in respect of <a href=\"\/doc\/893197\/\" id=\"a_8\">Section 4(4)<\/a>V as ultra vires of the Act or<br \/>\narbitrary.\tThe writ petition will stand disposed of accordingly.
