Kindly provide the name of the official and In order to improve the services to the subscribers<br \/>\n       the duration for which the Applicant &amp; for speedy settlement of claims a new software<br \/>\n       application was present with them.             has been installed in the office and at the initial<br \/>\n                                                      stage the settlement process has got slow down<br \/>\n                                                      therefore the claims forms could not be entered in<br \/>\n                                                      the system so quickly &amp; were lying pending in the<br \/>\n                                                      receipt section, therefore claim kept at receipt<br \/>\n                                                      section up to 20.10.2009 and than sent to<br \/>\n                                                      accounts section for action on<br \/>\n                                                      21.10.2009.\n<\/p>\n<p id=\"p_5\">   4.  Furnish information regarding the action Because of installation of new software it was<br \/>\n       taken on officials who took more than 30 beyond the control of this office therefore none<br \/>\n       Days to reply to the Applicant&#8217;s RTI.          can be held responsible.\n<\/p>\n<p id=\"p_6\">                                                                                           Page\u00a01\u00a0of\u00a03\n<\/p>\n<p id=\"p_7\">    5. Not received information from CPIO. (02\/12\/2009)\n<\/p>\n<p id=\"p_12\">   2. Unsatisfied with the information provided by CPIO. (04\/02\/2010)<\/p>\n<p>First Appellate Authority (FAA) order:\n<\/p>\n<p id=\"p_13\">FAA replied some of the points of the Applicant and disposed off the appeal.\n<\/p>\n<p id=\"p_14\">Grounds for the Second Appeal:\n<\/p>\n<p id=\"p_15\">Unsatisfied with the order of FAA.\n<\/p>\n<p id=\"p_16\">Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_17\">The following were present<br \/>\nAppellant : Mr.Rajkumar Meena;\n<\/p>\n<p id=\"p_18\">Respondent : Mr. S. P. Puri, Accounts officer on behalf of Mr. Manoj Kumar, Public Information<br \/>\nOfficer &amp; Regional Provident Fund Commissioner &#8211; II,<\/p>\n<p>        The PIO is directed to provide information on query-1 in the following format:<br \/>\n         Date on which       Name and designation of      Action      Date on which forwarded to<br \/>\n          Application        The officer receiving it.    taken           Next officer\/office.<br \/>\n           received<\/p>\n<p>    *there will be as many rows as the number of officers who handled the application.\n<\/p>\n<p id=\"p_19\">The RTI application has been made on 15\/10\/2009 which reached the office of the PIO on 23\/10\/2009.<br \/>\nThe information should have supplied to the appellant before 23\/11\/2009 but is claimed to have been<br \/>\nsent by the PIO on 01\/12\/2009.\n<\/p>\n<p id=\"p_20\">Decision:\n<\/p>\n<p id=\"p_21\">The Appeal is allowed.\n<\/p>\n<p id=\"p_22\">      The PIO is directed to give the information mentioned above to the appellant<br \/>\nbefore 20 July 2010.\n<\/p>\n<p id=\"p_23\">The issue before the Commission is of not supplying the complete, required information by the<br \/>\nPIO within 30 days as required by the law.\n<\/p>\n<p id=\"p_24\">From the facts before the Commission it is apparent that the PIO is guilty of not furnishing information<br \/>\nwithin the time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the<br \/>\nrequirement of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>.\n<\/p>\n<p id=\"p_25\">                                                                                            Page\u00a02\u00a0of\u00a03<br \/>\n It appears that the PIO&#8217;s actions attract the penal provisions of <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> (1). A showcause notice is<br \/>\nbeing issued to him, and he is directed give his reasons to the Commission to show cause why penalty<br \/>\nshould not be levied on him.\n<\/p>\n<p id=\"p_26\">He will present himself before the Commission at the above address on 03 August 2010 at 12.00pm<br \/>\nalongwith his written submissions showing cause why penalty should not be imposed on him as<br \/>\nmandated under <a href=\"\/doc\/1369783\/\" id=\"a_2\">Section 20<\/a> (1).
