( C ) No<\/a>. 18084 of 2010\n                .................................................\n\n                 Dated: 16th day of July, 2010.\n\n                              JUDGMENT\n<\/pre>\n<p id=\"p_1\">     The petitioner who is a physically handicapped woman<\/p>\n<p>aged 60 years residing at Sneha Nagar in Kadavanthara,<\/p>\n<p>Kochi, seeks a direction to the first respondent Director<\/p>\n<p>General of Police    to order a proper investigation of Crime<\/p>\n<p>No. 532 of 2009 of Aroor Police Station pertaining to the<\/p>\n<p>death of     the   petitioner&#8217;s son Pramod                      aged 28 years.<\/p>\n<p>According to the petitioner who is               working as a Sweeper in<\/p>\n<p>the Corporation of Cochin on daily wages, the petitioner&#8217;s son<\/p>\n<p>was murdered by his wife&#8217;s relatives and the petitioner is<\/p>\n<p>suspecting her daughter-in-law Nisha and one Jose who is<\/p>\n<p>the husband of Nisha&#8217;s elder sister.\n<\/p>\n<p id=\"p_1\">     2.    I heard the learned counsel for the petitioner and<\/p>\n<p>the Public Prosecutor. I also perused the case diary files.<\/p>\n<p id=\"p_2\">     3.    The marriage of Pramod and Nisha five years ago<\/p>\n<p>W.P. ( C ) No. 18084 of 2010-    :2:-\n<\/p>\n<p id=\"p_3\">\nwas a love marriage.     Pramod is a Hindu and Nisha is a<\/p>\n<p>Christian.   The father of Pramod is no more. Pramod along<\/p>\n<p>with his mother (the petitioner herein)      was residing at<\/p>\n<p>Sneha Nagar, Kadavathara, Kochi.         After the marriage,<\/p>\n<p>Pramod started residing in his wife&#8217;s House at Vattathara<\/p>\n<p>House, Chandiroor in Aroor Panchayath.     Pramod and Nisha<\/p>\n<p>are having two children aged four years and six months<\/p>\n<p>respectively.   Pramod was    in the habit of       frequently<\/p>\n<p>consuming alcohol and was not regular in going for his job<\/p>\n<p>as an electrician.    There were financial problems in the<\/p>\n<p>family.\n<\/p>\n<p id=\"p_4\">     4.     Pramod who was a drunkard was in the habit of<\/p>\n<p>picking up frequent quarrels with his wife due to the financial<\/p>\n<p>problems. Impelled by some unknown stimulus, (presumably<\/p>\n<p>out of frustration) sometime between 4.30 and 5.30 p.m. on<\/p>\n<p>20-10-2009     Pramod committed     suicide by hanging      at<\/p>\n<p>Vattathara House in Chandiroor using a nylon rope .<\/p>\n<p id=\"p_5\">     5.     The factum of death of Pramod was reported to<\/p>\n<p>the Aroor Police by one Antony, a neighbour of Pramod and<\/p>\n<p>W.P. ( C ) No. 18084 of 2010-     :3:-\n<\/p>\n<p id=\"p_6\">\nNisha at 6.30 p.m. on 20-10-2009.      The Sub Inspector of<\/p>\n<p>Police, Aroor registered   a case as Crime No. 532 of 2009<\/p>\n<p>under the caption &#8220;unnatural death&#8221; under Sec. 174 <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>.<\/p>\n<p>Inquest over the dead body of Pramod was conducted by the<\/p>\n<p>Sub Inspector from Vattathara House at 8.30 a.m. on 21-10-<\/p>\n<p>2009. At the time of inquest the Sub Inspector had questioned<\/p>\n<p>Prasanna, (the petitioner)   who is the mother of Pramod.<\/p>\n<p>Nisha, the wife of Pramod was also questioned. Both of them<\/p>\n<p>had told the police that Pramod who had taken to drinking<\/p>\n<p>used to frequently pick up quarrels and that it was a case of<\/p>\n<p>suicide and both of them had no suspicion behind the death of<\/p>\n<p>Pramod.\n<\/p>\n<p id=\"p_7\">     6.     Autopsy over the dead body of Pramod was<\/p>\n<p>conducted by Dr. K.K. Damodaran, Civil Surgeon, Community<\/p>\n<p>Health Centre, Thuravoor at 10.55 a.m.       on 21-10-2009.<\/p>\n<p>Ext.P3 postmortem certificate together with the statement of<\/p>\n<p>the said doctor     under Sec. 161 <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>.      given to the<\/p>\n<p>Investigating Officer show that the postmortem appearances<\/p>\n<p>were consistent with death by asphyxia due to hanging and<\/p>\n<p>W.P. ( C ) No. 18084 of 2010-     :4:-\n<\/p>\n<p id=\"p_8\">\nthere were no other antemortem injuries except the ligature<\/p>\n<p>mark in the neck of Pramod to suggest that       the death of<\/p>\n<p>Pramod could be due to homicidal hanging.<\/p>\n<p id=\"p_9\">      7.    After the death of Pramod the petitioner was not<\/p>\n<p>rendering any help or succor to Nisha, the daughter-in-law<\/p>\n<p>of the petitioner. Some enmity had developed between the<\/p>\n<p>petitioner and Nisha      and this was the reason for the<\/p>\n<p>petitioner subsequently coming out with a case that her son<\/p>\n<p>was murdered and was thereafter hanged to make it appear<\/p>\n<p>that he had committed suicide.\n<\/p>\n<p id=\"p_10\">     8.    The stand now     taken by  the petitioner   is the<\/p>\n<p>product of an ill-motivated afterthought. The investigation of<\/p>\n<p>the case appears to have been conducted properly and there is<\/p>\n<p>nothing to indicate that death of Pramod was  homicidal . The<\/p>\n<p>Sub Inspector who conducted the investigation has submitted<\/p>\n<p>the final report on      31-10-2009   before the    Magistrate<\/p>\n<p>concerned to the effect that there is nothing to suspect the<\/p>\n<p>commission of any offence behind the unnatural death of<\/p>\n<p>Pramod    who was     actually  committing   suicide    out of<\/p>\n<p>W.P. ( C ) No. 18084 of 2010-         :5:-\n<\/p>\n<p id=\"p_11\">\nfrustration in life. I do not find any good ground to order a<\/p>\n<p>further    investigation  in the matter.
