No.1106 of 2009\n               ----------------------------------------------\n                       Dated 29th July, 2009.\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">Kurian Joseph, J.\n<\/p>\n<p id=\"p_1\">            Appellant is the petitioner. The writ petition was filed<\/p>\n<p>with the following prayers :-\n<\/p>\n<p id=\"p_2\">                       &#8220;(1)   Grant     an   interim     stay upon the<br \/>\n           securitisation proceedings against the petitioner till the<br \/>\n           communication of the decision on the proposal to<br \/>\n           restructure\/reschedule the loan account.<\/p>\n<p id=\"p_3\">                       (2)   Direct the first respondent to give a<br \/>\n           sympathetic consideration to the Ext.P5 request<br \/>\n           submitted by the petitioner through his counsel within<br \/>\n           a shortest, definite time frame in compliance with the<br \/>\n           &#8220;Code of bank&#8217;s commitment to micro and small<br \/>\n           enterprises.&#8221;\n<\/p>\n<p id=\"p_4\">The learned Single Judge dismissed the writ petition without<\/p>\n<p>prejudice to the liberty to the petitioner to approach the Banking<\/p>\n<p>Ombudsman. According to the petitioner, he is entitled for the<\/p>\n<p>benefits under the Nursing\/Debt Restructuring Programme under<\/p>\n<p>the Code of bank&#8217;s commitment to micro and small enterprises.<\/p>\n<p>It is submitted that the petitioner has already remitted an amount<\/p>\n<p>of Rs.5,00,000\/- (Rupees five lakhs only) after the dismissal of the<\/p>\n<p>writ petition. However, taking note of the huge arrears, we are of<\/p>\n<p>the view that the petitioner should make some more payments<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WA NO.1106\/2009                  2<\/span><\/p>\n<p>before the Bank considers the request. Therefore, we set aside<\/p>\n<p>the judgment of the learned Single Judge and dispose of the writ<\/p>\n<p>petition as follows :-\n<\/p>\n<p id=\"p_5\">           In the event of the petitioner paying an amount of<\/p>\n<p>Rs.10,00,000\/- (Rupees ten lakhs only) within two months from<\/p>\n<p>today and filing an appropriate representation for the benefits<\/p>\n<p>under the scheme referred to above within the said period, the<\/p>\n<p>matter will be considered by the Bank with notice to the<\/p>\n<p>petitioner within another one month.
