Justice V.GIRI\n\n Dated :17\/<a href=\"\/doc\/1390448\/\" id=\"a_1\">09\/2008\n\n O R D E R\n                         V.GIRI, J\n                       -------------------\n                    W.P.(C<\/a>).27469\/2008\n                       --------------------\n        Dated this the 17th day of September, 2008\n\n                       JUDGMENT\n<\/pre>\n<p id=\"p_1\">      Petitioners, who are members of the Syndicate of the<\/p>\n<p>University of Kerala,     are aggrieved by Ext.P2 order<\/p>\n<p>passed by the Lok Ayukta, directing them to be impleaded<\/p>\n<p>in complaint No.572\/2008 instituted by the second<\/p>\n<p>respondent herein.       It was the contention of the<\/p>\n<p>petitioners that they are members of the Syndicate elected<\/p>\n<p>in that behalf and therefore, they cannot be considered as<\/p>\n<p>public servants as defined under Section 2(o) of the Kerala<\/p>\n<p>Lok Ayukta Act.     Mr.M.K.Damodaran,           learned senior<\/p>\n<p>counsel appearing on behalf of the petitioners, submits<\/p>\n<p>that the petitioners are therefore, not public servants as<\/p>\n<p>defined under the Lok Ayukta Act. Therefore, Lok Ayukta<\/p>\n<p>would not derive jurisdiction to proceed against them,<\/p>\n<p>even if the complaint filed by the second respondent<\/p>\n<p>otherwise satisfies the ingredients of an allegation as<\/p>\n<p>defined under the Act.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">2.    I also heard Mr.George Poonthottam who entered<\/p>\n<p>appearance    on   behalf     of    the    second  respondent.<\/p>\n<p>W.P.(C).27469\/2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               2<\/span><\/p>\n<p>Mr.Geroge Poonthottam points out that Section 2(o)(v) of<\/p>\n<p>the Act defines     public servants and sub clause (v)<\/p>\n<p>thereof comprehends a member of a local authority,<\/p>\n<p>State or a Statutory body established by law or under<\/p>\n<p>the law of the State legislature. According to him, the<\/p>\n<p>University of Kerala is a body corporate established by a<\/p>\n<p>law passed by the same legislature and the members of<\/p>\n<p>Syndicate who are elected, nominated or otherwise<\/p>\n<p>would also therefore, be a member of a statutory body<\/p>\n<p>contemplated by Section 2(o)(v) of the Act. He contends<\/p>\n<p>that, in such circumstances, he would become a public<\/p>\n<p>servant as defined under Section 2(o) of the Act.<\/p>\n<p id=\"p_3\">3.    Mr.Damodaran contends that the provision which is<\/p>\n<p>really applicable is 2(o)(vii). Therefore, only a person in<\/p>\n<p>the service or paid by a statutory body would be a public<\/p>\n<p>servant within the meaning of the Act.<\/p>\n<p id=\"p_4\">4.    It is true    that the contention raised by the<\/p>\n<p>petitioners herein relates to the jurisdiction of the Lok<\/p>\n<p>Ayukta to proceed as against       them and therefore it<\/p>\n<p>might be open,       in certain circumstances,      for an<\/p>\n<p>W.P.(C).27469\/2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              3<\/span><\/p>\n<p>aggrieved person complaining of lack of jurisdiction of a<\/p>\n<p>statutory body in taking proceedings against him to<\/p>\n<p>invoke the jurisdiction of this Court under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of<\/p>\n<p>the Constitution of India.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">5.   But I take note of the fact that Ext.P2 is passed by a<\/p>\n<p>high powered statutory body, a judicial forum and<\/p>\n<p>obviously competent to take note of and decide any<\/p>\n<p>question which affects the jurisdiction of     the body to<\/p>\n<p>take proceedings against     a person who complains of<\/p>\n<p>absence of jurisdiction in that regard.<\/p>\n<p id=\"p_7\">6.   In the result, I am of the view that objections now<\/p>\n<p>raised by the petitioners can be effectively raised before<\/p>\n<p>the Upa Lok Ayukta and Upa Lok Ayukta would have to<\/p>\n<p>decide the question of jurisdiction before further<\/p>\n<p>proceeding with the complaint in so far as the petitioners<\/p>\n<p>are concerned.\n<\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">7.   Accordingly, the writ petition is disposed of in the<\/p>\n<p>following terms:-\n<\/p>\n<p id=\"p_10\">W.P.(C).27469\/2008<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                             4<\/span><\/p>\n<p id=\"p_11\">   (i).   Petitioners may appear before the Upa Lok<\/p>\n<p>   Ayukta in person or through counsel and file their<\/p>\n<p>   written objections detailing their objections as<\/p>\n<p>   regards the jurisdiction of the Upa Lok Ayukta to<\/p>\n<p>   the effect that they are not public servants and<\/p>\n<p>   therefore,     are not   comprehended    by   the<\/p>\n<p>   provisions of the Act or powers of the Upa Lok<\/p>\n<p>   Ayukta in that regard.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">   (ii).    If such objection is raised, then I am<\/p>\n<p>   absolutely certain that Upa Lok Ayukta will look<\/p>\n<p>   into the objections and take a decision thereon<\/p>\n<p>   before      further proceeding   with   complaint<\/p>\n<p>   No.572\/2008, in so far as the petitioners are<\/p>\n<p>   concerned.
