Khunger, Advocate for the petitioner.\n               Mr. Mehardeep Singh, Assistant Advocate General Punjab for\n               the State.\n\nKANWALJIT SINGH AHLUWALIA, J. (ORAL)\n<\/pre>\n<p id=\"p_1\">               On February 2, 2009, this Court had passed the following<\/p>\n<p>order:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>               &#8220;It is submitted that no specific role has been assigned<br \/>\n         to the petitioner though the mob had gathered there and<br \/>\n         thrown brick bats and put the car on fire. Counsel further<br \/>\n         submits that Vijay Pal alias Rai Sahib has been granted<br \/>\n         regular bail. It is further submitted that the person who died<br \/>\n         belong to the members of the mob, therefore, <a href=\"\/doc\/409589\/\" id=\"a_1\">Section 304<\/a> IPC<br \/>\n         is not attracted qua the petitioner.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>               Issue notice to learned Advocate General, Punjab, for<br \/>\n         20.2.2009.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>               Meanwhile, in the event of arrest, petitioner shall be<br \/>\n         released on interim bail to the satisfaction of the Arresting<br \/>\n         Officer. Petitioner shall join investigation as and when called<br \/>\n         for. Petitioner shall also abide by the conditions specified<br \/>\n         under <a href=\"\/doc\/1692057\/\" id=\"a_1\">Section 438(2)<\/a> Cr.P.C.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_1\"> Criminal Misc. No. M-2990 of 2009<\/p>\n<p>             Mr. Mehardeep Singh, AAG Punjab on instructions from HC<\/p>\n<p>Balwinder Singh, Police Station Abohar, states that petitioner has joined<\/p>\n<p>the investigation and he is no longer required for further custodial<\/p>\n<p>interrogation.\n<\/p>\n<p id=\"p_2\">             For the reasons stated in order dated February 2, 2009 and in<\/p>\n<p>view of the statement made by counsel for the State, interim bail granted to<\/p>\n<p>the petitioner Om Parkash vide order dated February 2, 2009 is made<\/p>\n<p>absolute till submission of report under <a href=\"\/doc\/1412034\/\" id=\"a_2\">Section 173<\/a> Cr.P.C. (challan).<\/p>\n<p>Thereafter, his prayer for regular bail shall be decided by the trial Court on<\/p>\n<p>merits.\n<\/p>\n<p id=\"p_3\">              With these observations, present petition is disposed off.<\/p>\n<p>             Co-accused of Om Parkash has filed Criminal Misc. No.M-<\/p>\n<p>4851 of 2009. Since Investigating Officer is present in Court to assist the<\/p>\n<p>counsel for the State, therefore Criminal Misc. No.M-4851 of 2009 is also<\/p>\n<p>taken up along with Criminal Misc. No.M-2990 of 2009.<\/p>\n<p id=\"p_4\">             Counsel for the State has stated that the role of the petitioner<\/p>\n<p>is identical and pre-arrest bail can be granted to the petitioner.<\/p>\n<p id=\"p_5\">             Accordingly, accused Ram Saroop is granted pre-arrest bail till<\/p>\n<p>presentation of report under <a href=\"\/doc\/1412034\/\" id=\"a_3\">Section 173<\/a> Cr.P.C. (Challan), subject to his<\/p>\n<p>joining investigation. Thereafter, his application for regular bail shall be<\/p>\n<p>decided by the trial Court on merits of the case.<\/p>\n<p id=\"p_6\">             In view of this, Criminal Misc. No.M-4851 of 2009 is also<\/p>\n<p>disposed off along with Criminal Misc.
