     The petitioner is the defacto complainant in Crime No.86<\/p>\n
of 2007 of Poonthura Police Station, Trivandrum. She has a<\/p>\n
pathetic tale to narrate. She has been deceived and defrauded by<\/p>\n
her husband, from whom she has now obtained an order of<\/p>\n
divorce.   F.I.R. was registered against her husband alleging<\/p>\n
offences punishable, inter alia, under Section 498A<\/a> I.P.C. and<\/p>\n
Section 67<\/a> of the Information Technology Act. To cut a long<\/p>\n
story short, the grievance of the petitioner is that no proper<\/p>\n
investigation is being conducted into that crime.<\/p>\n
     2. The grievance of the petitioner does arouse sympathy<\/p>\n
and compassion. I am not adverting to the detailed averments<\/p>\n
regarding the alleged injustice done to her. But the petitioner<\/p>\n
appears to have come to this Court without and before exhausting<\/p>\n
the equally efficacious alternative remedy available to her to<\/p>\n

\n                                    2<\/span><\/p>\n
approach the learned Magistrate under Section 156(3)<\/a> Cr.P.C.<\/p>\n
complaining about the inadequate investigation.<\/p>\n
      3. After the decision in Sakiri Vasu v. State of U.P<\/a>. (2008<\/p>\n
(1) KLT 724)(SC), which has been followed by this Court in Vasanthi<\/p>\n
Devi v. S.I. of Police<\/a> (2008 (1) KLT 945), a person with a grievance<\/p>\n
like the instant one raised by the petitioner cannot come to this Court<\/p>\n
directly and claim invocation of the extra ordinary inherent jurisdiction<\/p>\n
under    Section 482<\/a> Cr.P.C.      or the extra ordinary constitutional<\/p>\n
jurisdiction unswe Article 226<\/a> of the Constitution. Such person must<\/p>\n
ordinarily exhaust the remedy available to her under Section 156(3)<\/a><\/p>\n
Cr.P.C., it is trite.\n<\/p>\n
      4.     This petition filed by the petitioner must in these<\/p>\n
circumstances fail for the short reason that the petitioner has not<\/p>\n
exhausted the equally efficacious alternative remedy available to her<\/p>\n
before the learned Magistrate under Section 156(3)<\/a> Cr.P.C. The fact<\/p>\n
that the petitioner is employed abroad now is no reason for this Court<\/p>\n
to treat this case as an exceptional one, to which the dictum in Sakiri<\/p>\n
Vasu (supra) need not be applied. The petitioner can, through her<\/p>\n

\n                                    3<\/span><\/p>\n
counsel, apply to the learned Magistrate for issue of appropriate<\/p>\n
directions under Section 156(3)<\/a> Cr.P.C. If the petitioner’s grievance<\/p>\n
remains without redressal after the learned Magistrate passes orders,<\/p>\n
needless to say, the petitioner can challenge the same before this Court<\/p>\n
in appropriate proceedings.\n<\/p>\n
      5. With the above observations, this Writ Petition is dismissed.<\/p>\n
But I must note that whether with directions or without the directions<\/p>\n
of the learned Magistrate, it is incumbent on the Investigating Officer<\/p>\n
to ensure that a proper, efficient and efficacious investigation is<\/p>\n
conducted in Crime No.86 of 2007.\n<\/p>\n
      6.   Copy of the judgment shall be communicated to the<\/p>\n
Investigating Officer through the learned Govt. Pleader.<\/p>\n
      7. Issue copy to the learned Prosecutor.\n<\/p>\n
