Addl.<br \/>\nSessions Judge,  Veraval, in Sessions Case  No. 45\/2006, whereby the<br \/>\nrespondent herein, who was original accused in the aforementioned<br \/>\nSessions Case,  came to be  acquitted of the offences punishable<br \/>\nunder sections 306 and 506[2]<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of the Indian Penal Code<\/a> [<a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>].\n<\/p>\n<p id=\"p_2\">2.\t\tMr.\n<\/p>\n<p id=\"p_3\">Kartik Pandya, Ld. APP for the applicant &#8211; appellant submitted<br \/>\nthat in this case deceased, while she was under treatment, lodged FIR<br \/>\nagainst the accused. During the course of treatment, she succumbed to<br \/>\nher burn injuries and, therefore, her FIR is her dying declaration<br \/>\n[for short &#8216;DD&#8217;] before the police. The prosecution examined as many<br \/>\nas 18 witnesses including the family members of the deceased and all<br \/>\nthe family members of the deceased unanimously supported the<br \/>\nprosecution case. The trial Court recorded acquittal of the accused<br \/>\nsolely on the ground that the prosecution failed to prove its case<br \/>\nthat the accused abetted the suicide of the deceased. It is,<br \/>\ntherefore, submitted that the appeal requires consideration and the<br \/>\nadmission.\n<\/p>\n<p id=\"p_4\">3.\t\tWe<br \/>\nhave examined impugned judgment and order rendered by the trial<br \/>\nCourt, so also the copies of the depositions and other evidence<br \/>\nsupplied for our perusal by the Ld. APP Mr. Pandya. Examining the<br \/>\nimpugned judgment and order rendered by the trial Court, so also the<br \/>\nFIR, it is alleged that the accused, who at the relevant time, aged<br \/>\nabout 23 years and the deceased complainant Urmilaben, who was aged<br \/>\nabout 18 years, came in contact with each other. It is alleged that<br \/>\nthe accused asked Urmilaben to marry him or else he would kill<br \/>\nUrmila. It is the prosecution case that on account of such persistent<br \/>\nthreats being administered to her by the accused, she decided to end<br \/>\nher life as she did not like to marry the accused. Ultimately, on<br \/>\n13\/3\/2006 while she was all alone in her home, she poured kerosene on<br \/>\nher body  and set her to fire.  She was immediately rushed to a<br \/>\nhospital where, initially upon the message being conveyed by the<br \/>\nMedical Officer to the concerned police station, PW 16 Mr. B J<br \/>\nSavaliya,  the Executive Magistrate recorded the DD of the deceased.<br \/>\nThereafter, FIR lodged by the deceased  came to be recorded.\n<\/p>\n<p id=\"p_5\">4.\t\tFurther,<br \/>\nperusing the impugned judgment and order rendered by the trial Court,<br \/>\nso also considering the evidence of the witnesses examined by the<br \/>\nprosecution, it clearly transpires that at the time when Urmilaben<br \/>\nwas admitted in the hospital, at that time PW 2 Dr. Sagathiya<br \/>\nexamined her and recorded history of deceased Urmilaben. According to<br \/>\nthe evidence of Dr. Sagathiya, so also considering the certificate<br \/>\nissued by him, it transpires that Urmilaben gave history about her<br \/>\nburn injuries to Dr. Sagathiya that she was finding difficulty in her<br \/>\nstudy and, therefore, decided to end her life. Moreover, considering<br \/>\nthe evidence of PW 16 Mr. B J Savaliya,  the Executive Magistrate,<br \/>\nwho recorded the DD of the deceased, so also considering the DD, it<br \/>\nfurther appears that according to deceased Urmilaben, at the relevant<br \/>\ntime she was studying in Standard XI and she was under tremendous<br \/>\ntension of study and, therefore, she poured kerosene on her body and<br \/>\nset her to fire. It is further pertinent to note that her FIR came to<br \/>\nbe recorded by the concerned Police Officer after deceased Urmilaben<br \/>\nhad given aforementioned history regarding her burn injuries before<br \/>\nthe Medical officer, so also her regular DD came to be recorded by<br \/>\nthe Executive Magistrate. In the FIR, Urmilaben explained her burn<br \/>\ninjuries that the accused  insisted to marry him or else he would<br \/>\nkill her and, therefore, she attempted to commit suicide. As observed<br \/>\nby the trial Court in the impugned judgment, all the family members<br \/>\nwere knowing that  the Executive Magistrate had recorded DD of the<br \/>\ndeceased. Thereafter, police came to the hospital to record FIR of<br \/>\nthe deceased. The family members and the relative witnesses stated in<br \/>\ntheir evidence that at the time when the police recorded FIR, they<br \/>\nall were present. PW \t14 Dhaniben  in her evidence categorically<br \/>\nstated that one Jethabhai dictated the FIR and accordingly, the<br \/>\npolice recorded it. She further stated that since Urmilaben had<br \/>\nsustained burn injuries, only her thumb impression was taken below<br \/>\nthe FIR.\n<\/p>\n<p id=\"p_6\">5.\t\tAppreciating<br \/>\nand evaluating the oral and documentary evidence on record, the trial<br \/>\nCourt ultimately came to the conclusion that the prosecution failed<br \/>\nto prove its case that Urmilaben committed suicide on account of the<br \/>\ninstigation and abetment provided by the accused. Re-examining and<br \/>\nre-appreciating the evidence on record, we do not find any reason to<br \/>\ninterfere with the impugned judgment and order of acquittal rendered<br \/>\nby the trial Court. The appeal, therefore, lacks merits and does not<br \/>\nrequire admission.\n<\/p>\n<p id=\"p_7\">6.\t\tFurther<br \/>\nmore, it is well settled that when two views are  possible, one<br \/>\nleading to the innocence of the accused and other leading to the<br \/>\nguilt of the accused, the view leading to the innocence of the<br \/>\naccused is required to be accepted. Resultantly, the application<br \/>\nseeking leave to prefer appeal and the appeal deserve dismissal.\n<\/p>\n<p id=\"p_8\">7.\t\tFor<br \/>\nthe foregoing reasons, both, the application seeking leave to prefer<br \/>\nappeal and the appeal stand dismissed.\n<\/p>\n<p id=\"p_9\">[<br \/>\nD.H.
