Whether the judgment should be reported in the Digest?\n\n                                ....\n\nMahesh Grover,J.\n<\/pre>\n<p id=\"p_1\">              This revision petition is directed against judgment dated<\/p>\n<p>19.9.1997 passed by the Additional Sessions Judge, Chandigarh (hereinafter<\/p>\n<p>described as `the appellate Court&#8217;) vide which the appeal of the petitioner<\/p>\n<p>preferred against judgment and order        dated 30.5.1994 of the Judicial<\/p>\n<p>Magistrate Ist Class, Chandigarh (referred to hereinafter as `the trial Court&#8217;)<\/p>\n<p>was disposed of with some modification in the sentence awarded to him<\/p>\n<p>and his conviction under <a href=\"\/doc\/1985627\/\" id=\"a_1\">Sections 467<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_1\">468<\/a> and <a href=\"\/doc\/1466184\/\" id=\"a_2\">471<\/a> of the I.P.C. was<\/p>\n<p>maintained.\n<\/p>\n<p id=\"p_1\">              The facts of the case, in brief, are that the petitioner, while<\/p>\n<p>employed as peon on daily wages in the Punjab &amp; Sind Bank, Sector 17,<br \/>\n                       Crl.Revision Petition No.909 of 1997<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                      -2-<\/span><\/p>\n<p>                                       &#8230;.\n<\/p>\n<p id=\"p_2\">\nChandigarh Branch, had attempted to withdraw an amount of Rs.1500\/-<\/p>\n<p>from the account of Ms. Indra Chaudhary, who was working as an officer<\/p>\n<p>in the said branch,    by forging the signatures. On presentation of the<\/p>\n<p>withdrawal slip, he was apprehended on the spot as the signatures did not<\/p>\n<p>tally with the signatures of the account holder.<\/p>\n<p id=\"p_3\">            After completion of necessary investigation, the petitioner was<\/p>\n<p>challaned for having committed offences punishable under <a href=\"\/doc\/1985627\/\" id=\"a_3\">Sections 467<\/a>,<\/p>\n<p><a href=\"\/doc\/556166\/\" id=\"a_4\">468<\/a> and <a href=\"\/doc\/1466184\/\" id=\"a_5\">471<\/a> of the I.P.C.\n<\/p>\n<p id=\"p_4\">            The trial Court, on appraisal of the evidence brought before it,<\/p>\n<p>convicted the petitioner for the offences alleged against him. He was<\/p>\n<p>sentenced to undergo rigorous imprisonment for three years and to pay a<\/p>\n<p>fine of Rs.1000\/- under <a href=\"\/doc\/1985627\/\" id=\"a_6\">Section 467<\/a> of the I.P.C. and in default of payment<\/p>\n<p>of fine, he was directed to suffer further rigorous imprisonment of two<\/p>\n<p>months. He was further sentenced to rigorous imprisonment for two years<\/p>\n<p>and to pay a fine of Rs.500\/- under <a href=\"\/doc\/556166\/\" id=\"a_7\">Section 468<\/a> of the I.P.C. and in default<\/p>\n<p>of payment of fine, to suffer rigorous imprisonment for one month. Still<\/p>\n<p>further, he was sentenced to suffer rigorous imprisonment for two years<\/p>\n<p>under <a href=\"\/doc\/1466184\/\" id=\"a_8\">Section 471<\/a> of the I.P.C. However, all the sentences were directed to<\/p>\n<p>run concurrently.\n<\/p>\n<p id=\"p_5\">            On appeal, the conviction of the petitioner as recorded by the<\/p>\n<p>trial Court was maintained. Even the sentence awarded under <a href=\"\/doc\/1985627\/\" id=\"a_9\">Sections 467<\/a><\/p>\n<p>and <a href=\"\/doc\/556166\/\" id=\"a_10\">468<\/a> of the I.P.C. was upheld, but the sentence under <a href=\"\/doc\/1466184\/\" id=\"a_11\">Section 471<\/a> of the<\/p>\n<p>I.P.C. was modified to the extent that the petitioner was directed to pay a<\/p>\n<p>fine of Rs.500\/- and in default of payment thereof, to undergo rigorous<br \/>\n                        Crl.Revision Petition No.909 of 1997<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                       -3-<\/span><\/p>\n<p>                                        &#8230;.\n<\/p>\n<p id=\"p_6\">\nimprisonment for one month, besides the sentence of                   rigorous<\/p>\n<p>imprisonment of two years. All the substantive sentences were ordered to<\/p>\n<p>run concurrently.\n<\/p>\n<p id=\"p_7\">              This has resulted in filing of the instant petition by the<\/p>\n<p>petitioner.\n<\/p>\n<p id=\"p_8\">              Learned counsel for the petitioner, while assailing the<\/p>\n<p>impugned judgment, has contended that a lenient view may be taken of the<\/p>\n<p>situation as the petitioner has already faced the agony of the criminal<\/p>\n<p>proceedings for the last twenty years and that only an attempt was made to<\/p>\n<p>withdraw the money which did not cause any pecuniary loss to PW12-Indra<\/p>\n<p>Chaudhary. He further contended that the sentence of three years awarded<\/p>\n<p>to the petitioner under <a href=\"\/doc\/1985627\/\" id=\"a_12\">Section 467<\/a> of the I.P.C. is also on higher side. In<\/p>\n<p>any eventuality, he submitted that since the proceedings are going on for<\/p>\n<p>more than two decades, no useful purpose would be served by sending the<\/p>\n<p>petitioner to jail at this point of time, especially when by now,he would be<\/p>\n<p>fairly advanced in age. In support of his submission, he placed reliance on a<\/p>\n<p>judgment of the Supreme Court reported as Radhey Shyam Versus State of<\/p>\n<p>U.P., 2009(1) R.C.R. (Criminal) 216.\n<\/p>\n<p id=\"p_9\">              On the other hand, learned counsel for the Union Territory,<\/p>\n<p>Chandigarh contended that there is over-whelming evidence on record by<\/p>\n<p>which the guilt of the petitioner has been established as he was caught red<\/p>\n<p>handed and there is no mitigating circumstance in his favour.<\/p>\n<p id=\"p_10\">              I have thoughtfully considered the rival contentions.<\/p>\n<p>              A perusal of the impugned judgment shows that the petitioner<br \/>\n                         Crl.Revision Petition No.909 of 1997<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                        -4-<\/span><\/p>\n<p>                                         &#8230;.\n<\/p>\n<p id=\"p_11\">\nwas apprehended at the spot with the forged signatures on the withdrawal<\/p>\n<p>slip. The opinion of the handwriting expert clearly established that the<\/p>\n<p>signatures of PW12-Indra Chaudhary were forged.                PW12    has also<\/p>\n<p>deposed that she had never signed the withdrawal slip. In view of this un-<\/p>\n<p>impeached evidence, I do not find any infirmity in the impugned judgment<\/p>\n<p>of conviction.\n<\/p>\n<p id=\"p_12\">            The only question that is to be determined is as to whether the<\/p>\n<p>maintaining of sentence as awarded by the trial Court and affirmed by the<\/p>\n<p>appellate Court at this stage is just and proper, especially keeping in view<\/p>\n<p>the fact that the petitioner has faced the agony of criminal proceedings for<\/p>\n<p>the last more than twenty three years and by now, he has fairly advanced in<\/p>\n<p>age.   In my opinion, the ends of justice would be squarely met if the<\/p>\n<p>sentence of the petitioner is reduced to that of already undergone and in the<\/p>\n<p>alternative, he is directed to pay a sum of Rs.5000\/- as fine in addition to<\/p>\n<p>the fine already imposed upon him. For this view, I find support from the<\/p>\n<p>judgment of the Apex Court in Radhey Shyam&#8217;s case (supra).<\/p>\n<p id=\"p_13\">            Accordingly, this revision petition is disposed of in the<\/p>\n<p>following terms:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>            1. The conviction of the petitioner shall remain intact.<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>            2. The sentence awarded to him is reduced to that of already<\/p>\n<p>                 undergone and he shall pay a fine of Rs.5000\/- within a<\/p>\n<p>                 period of three months from today, which shall be in<\/p>\n<p>                 addition to the amount of fine already imposed and paid by<\/p>\n<p>                 him.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                   Crl.Revision Petition No.909 of 1997<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                  -5-<\/span><\/p>\n<p>                                   &#8230;.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>          3.
