{"id":249553,"date":"2010-05-03T00:00:00","date_gmt":"2010-05-02T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/kamla-bai-vs-hiralal-on-3-may-2010"},"modified":"2014-12-24T11:22:51","modified_gmt":"2014-12-24T05:52:51","slug":"kamla-bai-vs-hiralal-on-3-may-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/kamla-bai-vs-hiralal-on-3-may-2010","title":{"rendered":"Kamla Bai vs Hiralal on 3 May, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Kamla Bai vs Hiralal on 3 May, 2010<\/div>\n<pre id=\"pre_1\">                       M.C.C.No.561\/2010\n\n   Kamla Bai                              Hiralal &amp; others\n\n\n\n\n3.5.2010\n      Shri Sameer Seth, counsel for applicant.\n      Office has raised an objection that applicant has not filed\nher Vakalatnama, but the Vakalatnama is signed by the Power\nof Attorney holder.\n      On the objection of office, it is submitted by Shri Seth that\napplicant is 82 year old and she has appointed her son Rajendra\nKumar    Jhanwar      as   Power     of   Attorney,    who   has   filed\nVakalatnama and has also filed this appeal in person before the\nRegistrar.\n      Though in the cause title, the applicant has stated her age\nas 65 years, but in para 3 of the memo of appeal, in Power of\nAttorney and in the application I.A.No.4345\/2010 age of\napplicant has been shown as 82 years.\n      Considering aforesaid, this appeal filed by the Power of\nAttorney on behalf of applicant is at present accepted, subject\nto objection, if any by the respondents.<\/pre>\n<p id=\"p_1\">      M.C.C.No.561\/2010.\n<\/p>\n<p id=\"p_1\">      This is an application under Order 44 Rule 1 C.P.C., and<br \/>\nfor the just decision of the case the applicant is directed to<br \/>\nimplead State of Madhya Pradesh, through Collector Khandwa<br \/>\nas respondent no.4.         The impleadment of State in this<br \/>\napplication shall be for limited purpose for holding an enquiry in<br \/>\nrespect of indigency of the applicant.
