(Oral)\n<\/pre>\n<p id=\"p_1\">          Learned counsel for the petitioner contends that learned Rent<\/p>\n<p>Controller, Jalandhar, has specifically held as under:-<\/p>\n<blockquote id=\"blockquote_1\"><p>                    &#8220;&#8230;Thus, in view of Ex.R.1 and Ex.R.2 and in view of<\/p>\n<p>                    the absence of cross-examination on this aspect by<\/p>\n<p>                    the counsel for the petitioner, in my considered view,<\/p>\n<p>                    respondent has successfully proved the due rent<\/p>\n<p>                    which was to be paid by him to the petitioner was<\/p>\n<p>                    from 1.9.2002 till 31.7.2005 @ Rs.400\/- per month<\/p>\n<p>                    and not w.e.f. 1.8.2002 till 31.7.2005. Moreover,<\/p>\n<p>                    respondent in his written statement has also<\/p>\n<p>                    indirectly admitted his liability to pay arrears of rent<\/p>\n<p>                    from 1.9.2002 till the date of filing of petition. Even,<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Civil Revision No. 6058 of 2008                                        2<\/span><\/p>\n<p>                    as per the provisional assessment of rent the<\/p>\n<p>                    respondent has already tendered the rent from<\/p>\n<p>                    1.9.2002 till 31.7.2005 @ Rs.400\/- per month.<\/p>\n<p>                    Therefore, though it has been established that<\/p>\n<p>                    respondent was in arrears of rent from 1.9.2002 till<\/p>\n<p>                    the date of filing of present petition @ Rs.400\/- per<\/p>\n<p>                    month and not from 1.8.2002, but he paid the same<\/p>\n<p>                    in the Court. Therefore, it cannot be termed that<\/p>\n<p>                    tender of the rent made by the respondent to the<\/p>\n<p>                    petitioner was short and invalid. Accordingly, issue<\/p>\n<p>                    No.1 is decided partly in favour of petitioner and in<\/p>\n<p>                    favour of respondent and issue No.2 is decided<\/p>\n<p>                    against the petitioner and in favour of respondent.<\/p>\n<p>                    Since arrears of rent have already been cleared by<\/p>\n<p>                    the respondent, therefore, now this ground is not<\/p>\n<p>                    available with the petitioner to seek the ejectment of<\/p>\n<p>                    the respondent&#8221;.<\/p><\/blockquote>\n<p id=\"p_1\">\n<p id=\"p_2\">          Learned counsel further states that by ordering that the<\/p>\n<p>appellant should   deposit Rs.3,00,000\/- as a surety bonds, onerous<\/p>\n<p>condition has been imposed, to defeat the very right of the appeal.<\/p>\n<p id=\"p_3\">          Order of learned Appellate Authority passed on 9.9.2008 is<\/p>\n<p>modified to the extent that the petitioner-tenant shall deposit Rs.2,500\/-<\/p>\n<p>per month before learned Appellate Authority in lieu of the rent to be<\/p>\n<p>paid to the landlord. It has been held in <a href=\"\/doc\/309033\/\" id=\"a_1\">M\/s Atma Ram Properties (P)<\/p>\n<p>Ltd. v. M\/s Federal Motors Pvt. Ltd<\/a>. (2005)1 Supreme Court Cases<\/p>\n<p>705 that learned Appellate Court or Revisional Court can compensate<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Civil Revision No. 6058 of 2008                                       3<\/span><\/p>\n<p>the landlord once the tenancy has come to an end.
