JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 17\/11\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tThis<br \/>\napplication has been filed with the following prayers:\n<\/p>\n<p id=\"p_1\">&#8220;(A)\tYour<br \/>\nLordship may be pleased to modify the order dated 28.9.2011 to the<br \/>\neffect that the respondent no.4 and 5 may be directed to release the<br \/>\nvehicle instead of respondent no.2;\n<\/p>\n<p id=\"p_2\">(B)\tYour<br \/>\nLordship may be pleased to direct the respondent nos.4 and 5 to<br \/>\nrelease the Hitachi Machine No.GJ-5-CE-7624 in favour of applicant<br \/>\nwithin 1 week;\n<\/p>\n<p id=\"p_3\">(C)\tPending<br \/>\nhearing and final disposal of this application your lordship may be<br \/>\npleased to direct the respondent no.4 and 5 to release the Hitachi<br \/>\nMachine No.GJ-5-CE-7624 in favour of applicant immediately;\n<\/p>\n<p id=\"p_4\">(D)\tGranting<br \/>\nsuch and further reliefs and passing such other and further orders as<br \/>\nthe circumstances of the case may require;\n<\/p>\n<p id=\"p_5\">(E)\taward<br \/>\nthe cost of this application;&#8221;\n<\/p>\n<p id=\"p_6\">2.\tIt<br \/>\nis submitted by Mr.P.S. Patel, learned advocate for the applicant<br \/>\nthat the applicant had preferred Special Civil Application No.14534<br \/>\nof 2011 which was disposed of by order dated 28.09.2011, with a<br \/>\ndirection to respondent No.2 to decide the application of the<br \/>\napplicant preferred under Rule-18 of the Gujarat Minerals (Prevention<br \/>\nof Illegal Mining, Transportation and Storage) Rules, 2005 (&#8220;Rules&#8221;<br \/>\nfor short), within a period of two weeks from the date of receipt of<br \/>\na copy of the said application.\n<\/p>\n<p id=\"p_7\">3.\tThe<br \/>\nlearned advocate for the applicant submits that since passing of the<br \/>\nabove order, no action has been taken, therefore, the applicant sent<br \/>\nreminder on 24.10.2011, to which there was no response.
