In the light of the common order dated 25.02.2008<\/p>\n<p>passed in Crl.M.C No. 543 of 2008 and connected cases,        it is<\/p>\n<p>held that the learned Magistrate was not justified in refusing to<\/p>\n<p>entertain the petition filed under Sec. 457 <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. The petitioner<\/p>\n<p>is permitted to apply again before the learned Magistrate who<\/p>\n<p>shall release the pickup van in question on interim custody on<\/p>\n<p>the petitioner making a cash deposit for Rs. 25,000\/- (Rupees<\/p>\n<p>twenty five thousand only)                and executing a bond for<\/p>\n<p>Rs.5,00,000\/- (Rupees five lakhs only) with two solvent<\/p>\n<p>sureties each for the like amount (without insisting on solvency<\/p>\n<p>certificate from such sureties) to the satisfaction of the<\/p>\n<p>Magistrate and on    the petitioners giving an undertaking on the<\/p>\n<p>following terms:-\n<\/p>\n<p id=\"p_2\"><span class=\"hidden_text\" id=\"span_1\">Crl. M.C. No. 1285\/08              -:2:-<\/span><\/p>\n<blockquote id=\"blockquote_1\"><p>             1.    The petitioner shall not permit the user of<br \/>\n             the pick up van for any illicit purpose<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>             2.   The petitioner shall not transfer wholly or in<br \/>\n             part    the pick up van to any other person.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>             3.   The petitioner shall produce the pick up van<br \/>\n             before the Magistrate as and when directed to<br \/>\n             do so in the same condition in which it is<br \/>\n             released to him.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>             4. The interim custody of the pick up van shall<br \/>\n             be subject to final orders, if any, to be passed<br \/>\n             for confiscation.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>       This Crl.M.C is disposed of as above.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>                                          V.
