Leave granted.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">2.    Challenge in this appeal is to the order of a learned Single Judge of<\/p>\n<p>Allahabad High Court dismissing the petition under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the<\/p>\n<p>Code of Criminal Procedure, 1973 (in short the `Code&#8217;).          By the said<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                            1<\/span><br \/>\npetition appellants had prayed for quashing the proceedings initiated on the<\/p>\n<p>basis of complaint filed by respondent No.1 and the order of learned Civil<\/p>\n<p>Judge, Junior Division\/Judicial Magistrate, R. S. Ghat, Barabanki, dated 8th<\/p>\n<p>February, 2005 taking cognizance of offences punishable under <a href=\"\/doc\/1436241\/\" id=\"a_1\">Sections<\/p>\n<p>420<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_2\">468<\/a> and <a href=\"\/doc\/1466184\/\" id=\"a_3\">471<\/a> of the Indian Penal Code, 1860 (in short the `<a href=\"\/doc\/1569253\/\" id=\"a_4\">IPC<\/a>&#8216;) and<\/p>\n<p>issuance of summons to the appellants. The learned magistrate recorded<\/p>\n<p>statements of the complainant under <a href=\"\/doc\/943588\/\" id=\"a_5\">Section 200<\/a> of Code as well as of the<\/p>\n<p>witness under <a href=\"\/doc\/162723\/\" id=\"a_6\">Section 202<\/a> of the Code and thereafter issued summons to the<\/p>\n<p>appellants to start proceedings.   The appellants took the stand that the<\/p>\n<p>proceedings were nothing but an abuse of the process of Court. It was<\/p>\n<p>pointed out that the summons issued were never served and bailable warrant<\/p>\n<p>of arrest and subsequently non-bailable warrant has been issued and even<\/p>\n<p>proceedings under <a href=\"\/doc\/1530896\/\" id=\"a_7\">Section 82<\/a> of the Code have been initiated. The High<\/p>\n<p>Court accepted that without service of summons the issuance of bailable as<\/p>\n<p>well as non-bailable warrant was uncalled for. It was also directed that the<\/p>\n<p>proceedings initiated under <a href=\"\/doc\/1530896\/\" id=\"a_8\">Section 82<\/a> of the Code was to be stayed and on<\/p>\n<p>the appellants appearing before the concerned court the proceedings shall<\/p>\n<p>continue. The application was accordingly disposed of.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                           2<\/span>\n<\/p>\n<p id=\"p_5\">3.      Learned counsel for the appellant submitted that the background facts<\/p>\n<p>clearly show that the proceedings were initiated with a view to harass the<\/p>\n<p>appellants and as a counterblast to the proceedings initiated by the<\/p>\n<p>appellants. The order is supported by learned counsel for the respondent<\/p>\n<p>No.1.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">4.      In order to appreciate the stand taken by the appellant it is necessary<\/p>\n<p>to take note of the factual position, the same is as follows:<\/p>\n<p id=\"p_8\">        On 1.4.1994 the Respondent no.1 approached the Petitioner no.1 for<\/p>\n<p>dealership, and a Letter of Intent appointment of dealer was issued to the<\/p>\n<p>Respondent.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">        On March 2000 the tenure of dealership of the Respondent no.1 was<\/p>\n<p>ended as the same was not doing business, incurring heavy debts to the<\/p>\n<p>appellant no.1.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">        On January, 2001 the Respondent no.1 issued cheque bearing no<\/p>\n<p>628701 dated 30.12.2000 for Rs.50,00,000\/-(Fifty Lacs) discharging his<\/p>\n<p>liability towards the debt incurred against the appellant No.1.<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                                              3<\/span><br \/>\n      On January, 2001 the Respondent presented the cheque bearing No.<\/p>\n<p>628701 to his bank for withdrawal.\n<\/p>\n<p id=\"p_13\">\n<p id=\"p_14\">      On 23.01.2001 the bank returned the cheque with an endorsement on<\/p>\n<p>the return memo i.e. refer to the drawer.\n<\/p>\n<p id=\"p_15\">\n<p id=\"p_16\">      On 05.02.2001 the appellant issued a Legal Notice under <a href=\"\/doc\/1823824\/\" id=\"a_9\">Section 138<\/a><\/p>\n<p>Negotiable Instrument Act, 1882 (in short the `<a href=\"\/doc\/1132672\/\" id=\"a_10\">NI Act<\/a>&#8216;)<\/p>\n<p>      On January 2001, the appellant filed a complaint u\/s 138\/442 read<\/p>\n<p>with <a href=\"\/doc\/686130\/\" id=\"a_11\">Section 141<\/a> of the NI Act before the Court of judicial Magistrate-I,<\/p>\n<p>Faridabad.\n<\/p>\n<p id=\"p_17\">\n<p id=\"p_18\">      On 12.04.2001, the Trial Court after considering the Complaint and<\/p>\n<p>the pre-summoning evidence took cognizance and issued summons against<\/p>\n<p>the Respondent. The Respondent no.1 appeared and subsequently was<\/p>\n<p>released on bail.\n<\/p>\n<p id=\"p_19\">\n<p><span class=\"hidden_text\" id=\"span_3\">                                                                        4<\/span><br \/>\n      On 04.10.2002 the Respondent No.1 filed a private complaint under<\/p>\n<p><a href=\"\/doc\/444619\/\" id=\"a_12\">section 200<\/a> Cr.P.C. before the Civil Judge, (J.D.)\/District Barabanki<\/p>\n<p>alleging that the officials of Petitioner no.1 herein had stolen the cheques<\/p>\n<p>bearing No. 0628701 &#8216;to 0628704, It was further mentioned by him that in<\/p>\n<p>the complaint that in the year 1998 he had informed the Bank of Baroda,<\/p>\n<p>Barabanki that he has lost the aforesaid cheques and also reported to the<\/p>\n<p>same to the SHO, Barabanki. He further alleged that the appellants herein<\/p>\n<p>forged the cheques bearing No. 0628701 and presented the same in the bank<\/p>\n<p>at Faridabad, and thereby alleged that they had committed an offence under<\/p>\n<p><a href=\"\/doc\/556166\/\" id=\"a_13\">Sections 468<\/a> &amp; <a href=\"\/doc\/1466184\/\" id=\"a_14\">471<\/a> IPC.\n<\/p>\n<p id=\"p_20\">\n<p id=\"p_21\">      On 08.02.2005 the complaint bearing No. 1343 of 2004 filed by the<\/p>\n<p>Respondent No.1 herein came up for hearing before the Civil Judge, (J.D.)\/<\/p>\n<p>Judicial Magistrate, R.S. Ghat, Uttar Pradesh, and the Learned Magistrate<\/p>\n<p>vide its order dated 08.02.2005 took cognizance of the matter and issued<\/p>\n<p>summons to the Appellants.\n<\/p>\n<p id=\"p_22\">\n<p id=\"p_23\">      In January 2007, to their utter shock and surprise, the appellants came<\/p>\n<p>to know that the Learned Civil Judge, (J.D.)\/Judicial Magistrate, R.S.Ghat,<\/p>\n<p>Barabanki, Uttar Pradesh had issued non-bailable warrant and had also<\/p>\n<p><span class=\"hidden_text\" id=\"span_4\">                                                                            5<\/span><br \/>\ninitiated proceedings under <a href=\"\/doc\/1598801\/\" id=\"a_15\">Section 82<\/a> Cr.P.C. against them in the<\/p>\n<p>complaint case No. 1343 of 2004 filed by the Respondent herein.<\/p>\n<p id=\"p_24\">5.    Exercise of power under <a href=\"\/doc\/903398\/\" id=\"a_16\">Section 482<\/a> of the Code in a case of this<\/p>\n<p>nature is an exception and not the rule. The section does not confer any new<\/p>\n<p>powers on the High Court. It only saves the inherent power which the Court<\/p>\n<p>possessed before the enactment<a href=\"\/doc\/1569253\/\" id=\"a_17\"> of the Code<\/a>. It envisages three<\/p>\n<p>circumstances under which the inherent jurisdiction may be exercised,<\/p>\n<p>namely, (i) to give effect to an order under<a href=\"\/doc\/1569253\/\" id=\"a_18\"> the Code<\/a>, (ii) to prevent abuse of<\/p>\n<p>the process of court, and (iii) to otherwise secure the ends of justice. It is<\/p>\n<p>neither possible nor desirable to lay down any inflexible rule which would<\/p>\n<p>govern the exercise of inherent jurisdiction. No legislative enactment<\/p>\n<p>dealing with procedure can provide for all cases that may possibly arise.<\/p>\n<p>Courts, therefore, have inherent powers apart from express provisions of<\/p>\n<p>law which are necessary for proper discharge of functions and duties<\/p>\n<p>imposed upon them by law. That is the doctrine which finds expression in<\/p>\n<p>the section which merely recognizes and preserves inherent powers of the<\/p>\n<p>High Courts. All courts, whether civil or criminal, possess, in the absence of<\/p>\n<p>any express provision, as inherent in their constitution, all such powers as<\/p>\n<p>are necessary to do the right and to undo a wrong in the course of<\/p>\n<p><span class=\"hidden_text\" id=\"span_5\">                                                                              6<\/span><br \/>\nadministration of justice on the principle quando lex aliquid alicui concedit,<\/p>\n<p>concedere videtur id sine quo res ipsa esse non potest (when the law gives a<\/p>\n<p>person anything it gives him that without which it cannot exist). While<\/p>\n<p>exercising powers under the section, the Court does not function as a court<\/p>\n<p>of appeal or revision. Inherent jurisdiction under the section though wide<\/p>\n<p>has to be exercised sparingly, carefully and with caution and only when<\/p>\n<p>such exercise is justified by the tests specifically laid down in the section<\/p>\n<p>itself. It is to be exercised ex debito justitiae to do real and substantial<\/p>\n<p>justice for the administration of which alone courts exist. Authority of the<\/p>\n<p>court exists for advancement of justice and if any attempt is made to abuse<\/p>\n<p>that authority so as to produce injustice, the court has power to prevent such<\/p>\n<p>abuse. It would be an abuse of process of the court to allow any action<\/p>\n<p>which would result in injustice and prevent promotion of justice. In exercise<\/p>\n<p>of the powers, court would be justified to quash any proceeding if it finds<\/p>\n<p>that initiation\/continuance of it amounts to abuse of the process of court or<\/p>\n<p>quashing of these proceedings would otherwise serve the ends of justice.<\/p>\n<p>When no offence is disclosed by the complaint, the court may examine the<\/p>\n<p>question of fact. When a complaint is sought to be quashed, it is permissible<\/p>\n<p>to look into the materials to assess what the complainant has alleged and<\/p>\n<p>whether any offence is made out even if the allegations are accepted in toto.<\/p>\n<p><span class=\"hidden_text\" id=\"span_6\">                                                                                7<\/span>\n<\/p>\n<p id=\"p_25\">6.      <a href=\"\/doc\/1033301\/\" id=\"a_19\">In R.P. Kapur v. State of Punjab<\/a> [AIR 1960 sc 866] this Court<\/p>\n<p>summarized some categories of cases where inherent power can and should<\/p>\n<p>be exercised to quash the proceedings:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>        (i) where it manifestly appears that there is a legal bar against the<br \/>\n     institution or continuance e.g. want of sanction;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>         (ii) where the allegations in the first information report or complaint<br \/>\n     taken at their face value and accepted in their entirety do not constitute<br \/>\n     the offence alleged;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>        (iii) where the allegations constitute an offence, but there is no legal<br \/>\n     evidence adduced or the evidence adduced clearly or manifestly fails to<br \/>\n     prove the charge. (AIR para 6)<\/p>\n<\/blockquote>\n<p id=\"p_26\">7.      In dealing with the last case, it is important to bear in mind the<\/p>\n<p>distinction between a case where there is no legal evidence or where there is<\/p>\n<p>evidence which is clearly inconsistent with the accusations made, and a case<\/p>\n<p>where there is legal evidence which, on appreciation, may or may not<\/p>\n<p>support the accusations. When exercising jurisdiction under <a href=\"\/doc\/903398\/\" id=\"a_20\">Section 482<\/a> of<\/p>\n<p>the Code, the High Court would not ordinarily embark upon an enquiry<\/p>\n<p>whether the evidence in question is reliable or not or whether on a<\/p>\n<p>reasonable appreciation of it accusation would not be sustained. That is the<\/p>\n<p>function of the trial Judge. Judicial process, no doubt, should not be an<\/p>\n<p>instrument of oppression or needless harassment. Court should be<\/p>\n<p>circumspect and judicious in exercising discretion and should take all<\/p>\n<p><span class=\"hidden_text\" id=\"span_7\">                                                                               8<\/span><br \/>\nrelevant facts and circumstances into consideration before issuing process,<\/p>\n<p>lest it would be an instrument in the hands of a private complainant to<\/p>\n<p>unleash vendetta to harass any person needlessly. At the same time the<\/p>\n<p>section is not an instrument handed over to an accused to short-circuit a<\/p>\n<p>prosecution and bring about its sudden death. The scope of exercise of<\/p>\n<p>power under <a href=\"\/doc\/903398\/\" id=\"a_21\">Section 482<\/a> of the Code and the categories of cases where the<\/p>\n<p>High Court may exercise its power under it relating to cognizable offences<\/p>\n<p>to prevent abuse of process of any court or otherwise to secure the ends of<\/p>\n<p>justice were set out in some detail by this Court in <a href=\"\/doc\/1033637\/\" id=\"a_22\">State of Haryana v.<\/p>\n<p>Bhajan Lal<\/a> [1992 Supp (1) SCC 335]. A note of caution was, however,<\/p>\n<p>added that the power should be exercised sparingly and that too in the rarest<\/p>\n<p>of the rare cases. The illustrative categories indicated by this Court are as<\/p>\n<p>follows: (SCC pp. 378-79, para 102)<\/p>\n<p>      &#8220;(1) Where the allegations made in the first information report or the<br \/>\n   complaint, even if they are taken at their face value and accepted in their<br \/>\n   entirety do not prima facie constitute any offence or make out a case<br \/>\n   against the accused.\n<\/p>\n<p id=\"p_27\">      (2) Where the allegations in the first information report and other<br \/>\n   materials, if any, accompanying the FIR do not disclose a cognizable<br \/>\n   offence, justifying an investigation by police officers under <a href=\"\/doc\/1132672\/\" id=\"a_23\">Section 156<\/a><br \/>\n   (1)<a href=\"\/doc\/1569253\/\" id=\"a_24\"> of the Code<\/a> except under an order of a Magistrate within the purview<br \/>\n   of <a href=\"\/doc\/1062869\/\" id=\"a_25\">Section 155(2)<\/a> of the Code.\n<\/p>\n<p id=\"p_28\">      (3) Where the uncontroverted allegations made in the FIR or<br \/>\n   complaint and the evidence collected in support of the same do not<br \/>\n   disclose the commission of any offence and make out a case against the<br \/>\n   accused.\n<\/p>\n<p id=\"p_29\">\n<span class=\"hidden_text\" id=\"span_8\">                                                                             9<\/span><br \/>\n         (4) Where, the allegations in the FIR do not constitute a cognizable<br \/>\n     offence but constitute only a non-cognizable offence, no investigation is<br \/>\n     permitted by a police officer without an order of a Magistrate as<br \/>\n     contemplated under <a href=\"\/doc\/1062869\/\" id=\"a_26\">Section 155(2)<\/a> of the Code.\n<\/p>\n<p id=\"p_30\">        (5) Where the allegations made in the FIR or complaint are so absurd<br \/>\n     and inherently improbable on the basis of which no prudent person can<br \/>\n     ever reach a just conclusion that there is sufficient ground for proceeding<br \/>\n     against the accused.\n<\/p>\n<p id=\"p_31\">        (6) Where there is an express legal bar engrafted in any of the<br \/>\n     provisions<a href=\"\/doc\/1569253\/\" id=\"a_27\"> of the Code<\/a> or the Act concerned (under which a criminal<br \/>\n     proceeding is instituted) to the institution and continuance of the<br \/>\n     proceedings and\/or where there is a specific provision in<a href=\"\/doc\/1569253\/\" id=\"a_28\"> the Code<\/a> or the<br \/>\n     Act concerned, providing efficacious redress for the grievance of the<br \/>\n     aggrieved party.\n<\/p>\n<p id=\"p_32\">         (7)Where a criminal proceeding is manifestly attended with mala<br \/>\n     fides and\/or where the proceeding is maliciously instituted with an<br \/>\n     ulterior motive for wreaking vengeance on the accused and with a view<br \/>\n     to spite him due to private and personal grudge.&#8221;\n<\/p>\n<p id=\"p_33\">\n<p id=\"p_34\">8.      As noted above, the powers possessed by the High Court under<\/p>\n<p><a href=\"\/doc\/903398\/\" id=\"a_29\">Section 482<\/a> of the Code are very wide and the very plenitude of the power<\/p>\n<p>requires great caution in its exercise. Court must be careful to see that its<\/p>\n<p>decision in exercise of this power is based on sound principles. The inherent<\/p>\n<p>power should not be exercised to stifle a legitimate prosecution. The High<\/p>\n<p>Court being the highest court of a State should normally refrain from giving<\/p>\n<p>a prima facie decision in a case where the entire facts are incomplete and<\/p>\n<p>hazy, more so, when the evidence has not been collected and produced<\/p>\n<p>before the Court and the issues involved, whether factual or legal, are of<\/p>\n<p><span class=\"hidden_text\" id=\"span_9\">                                                                               10<\/span><br \/>\nmagnitude and cannot be seen in their true perspective without sufficient<\/p>\n<p>material. Of course, no hard-and-fast rule can be laid down in regard to<\/p>\n<p>cases in which the High Court will exercise its extraordinary jurisdiction of<\/p>\n<p>quashing the proceedings at any stage. It would not be proper for the High<\/p>\n<p>Court to analyse the case of the complainant in the light of all probabilities<\/p>\n<p>in order to determine whether a conviction would be sustainable and on<\/p>\n<p>such premises, arrive at a conclusion that the proceedings are to be quashed.<\/p>\n<p>It would be erroneous to assess the material before it and conclude that the<\/p>\n<p>complaint cannot be proceeded with. In proceedings instituted on complaint,<\/p>\n<p>exercise of the inherent powers to quash the proceedings is called for only<\/p>\n<p>in a case where the complaint does not disclose any offence or is frivolous,<\/p>\n<p>vexatious or oppressive. If the allegations set out in the complaint do not<\/p>\n<p>constitute the offence of which cognizance has been taken by the<\/p>\n<p>Magistrate, it is open to the High Court to quash the same in exercise of the<\/p>\n<p>inherent powers under <a href=\"\/doc\/903398\/\" id=\"a_30\">Section 482<\/a> of the Code. It is not, however,<\/p>\n<p>necessary that there should be meticulous analysis of the case before the<\/p>\n<p>trial to find out whether the case would end in conviction or acquittal. The<\/p>\n<p>complaint has to be read as a whole. If it appears that on consideration of<\/p>\n<p>the allegations in the light of the statement made on oath of the complainant<\/p>\n<p>that the ingredients of the offence or offences are disclosed and there is no<\/p>\n<p><span class=\"hidden_text\" id=\"span_10\">                                                                             11<\/span><br \/>\nmaterial to show that the complaint is mala fide, frivolous or vexatious, in<\/p>\n<p>that event there would be no justification for interference by the High Court.<\/p>\n<p>When an information is lodged at the police station and an offence is<\/p>\n<p>registered, then the mala fides of the informant would be of secondary<\/p>\n<p>importance. It is the material collected during the investigation and evidence<\/p>\n<p>led in the court which decides the fate of the accused person. The<\/p>\n<p>allegations of mala fides against the informant are of no consequence and<\/p>\n<p>cannot by itself be the basis for quashing the proceedings.<\/p>\n<p id=\"p_35\">9.    These aspects were also highlighted in <a href=\"\/doc\/1014506\/\" id=\"a_31\">State of Karnataka v. M.<\/p>\n<p>Devendrappa<\/a> [ 2002(3) SCC 89].\n<\/p>\n<p id=\"p_36\">\n<p id=\"p_37\">10.   The case at hand squarely falls within the parameters indicated in<\/p>\n<p>category (7) of Bhajan Lal&#8217;s case (supra). The factual scenario as noted<\/p>\n<p>above clearly shows that the proceedings were initiated as a counterblast to<\/p>\n<p>the proceedings initiated by the appellants. Continuance of such<\/p>\n<p>proceedings will be nothing but an abuse of the process of law. Proceedings<\/p>\n<p>are accordingly quashed.\n<\/p>\n<p id=\"p_38\">\n<p id=\"p_39\">11.
