BASANT, J.\n                  - - - - - - - - - - - - - - - - - - - - - -\n                     B.A.No. 6525 of 2007\n                  - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 12th day of November, 2007\n\n                               O R D E R\n<\/pre>\n<p id=\"p_1\">       Application for anticipatory bail.             The petitioner is the<\/p>\n<p>first accused. Altogether there were three accused persons in the<\/p>\n<p>F.I.R. In the course of investigation, the other two accused have<\/p>\n<p>been deleted from the array of accused. The petitioner faces<\/p>\n<p>allegation under <a href=\"\/doc\/839778\/\" id=\"a_1\">Section 380<\/a> I.P.C.              He is the Secretary of a<\/p>\n<p>temple committee.       The crux of the allegations is that the<\/p>\n<p>ornaments of the idol were thieved and attempts were made by<\/p>\n<p>the petitioner through some others to sell the ornaments of the<\/p>\n<p>idol. Investigation is in progress. The petitioner apprehends<\/p>\n<p>imminent arrest.\n<\/p>\n<p id=\"p_1\">       2. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent. He belongs to Scheduled Caste.<\/p>\n<p>He owes allegiance to B.J.P. The other members of the temple<\/p>\n<p>committee do not owe allegiance to B.J.P. and they are members<\/p>\n<p>of the ruling party. All of them do not belong to Scheduled<\/p>\n<p>B.A.No. 6525 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                     2<\/span><\/p>\n<p>Caste\/tribe. They are making false allegations against the petitioner<\/p>\n<p>that the petitioner has stolen the ornaments of the diety. As a matter<\/p>\n<p>of fact, the Poojari of the temple is in possession of the ornaments.<\/p>\n<p>The petitioner is not in possession of the ornaments.          False and<\/p>\n<p>vexatious allegations are being raised against the petitioner by his<\/p>\n<p>adversaries, who belong to different castes and different political<\/p>\n<p>parties with the transparent intention of vexing and harassing him. He<\/p>\n<p>does not deserve to endure the trauma of arrest and detention. He may<\/p>\n<p>now be granted anticipatory bail, submits the learned counsel. The<\/p>\n<p>learned counsel further submits that the petitioner had filed a complaint<\/p>\n<p>under the provisions of the SC\/ST (Prevention of Atrocities) Act. That<\/p>\n<p>case is also pending investigation before the petitioner.<\/p>\n<p id=\"p_2\">      3. The learned Prosecutor, after taking instructions, submits that<\/p>\n<p>the said case under the SC\/ST (Prevention of Atrocities) Act was only<\/p>\n<p>an attempt made by the petitioner to avoid blame which is raised<\/p>\n<p>against him in this crime. Investigation has revealed the falsity of the<\/p>\n<p>allegations raised in that crime. Decision has already been taken by the<\/p>\n<p>Investigators to refer the said complaint as unsustainable.<\/p>\n<p>B.A.No. 6525 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                      3<\/span><\/p>\n<p id=\"p_3\">      4.     The learned Prosecutor further submits that there are<\/p>\n<p>indications available in this case, which show that the petitioner was<\/p>\n<p>having possession of some of the ornaments of the diety and that the<\/p>\n<p>petitioner had made attempts through others to dispose of the said<\/p>\n<p>ornaments. A thorough and exhaustive interrogation of the petitioner<\/p>\n<p>is necessary to recover the stolen articles, which are suspected to be<\/p>\n<p>available in the possession of the petitioner. At any rate, the petitioner<\/p>\n<p>may not be permitted to arm himself with an order of anticipatory bail.<\/p>\n<p>He may be directed to co-operate with the Investigators.        He will have<\/p>\n<p>to surrender before the Investigating Officer or the learned Magistrate<\/p>\n<p>having jurisdiction, submits the learned Prosecutor.<\/p>\n<p id=\"p_4\">      5.     The case diary has been perused by me. Considering the<\/p>\n<p>nature of the allegations raised, I shall carefully not embark on a<\/p>\n<p>detailed discussion on merits about the acceptability of the allegations<\/p>\n<p>raised or the credibility of the data collected.      Suffice it to say that I<\/p>\n<p>do not find any features in this case, which would justify the invocation of<\/p>\n<p>the extra ordinary equitable discretion under <a href=\"\/doc\/1783708\/\" id=\"a_1\">section 438<\/a> Cr.P.C. in favour<\/p>\n<p>of the petitioner. This I am satisfied is a fit case where the petitioner must<\/p>\n<p>B.A.No. 6525 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                     4<\/span><\/p>\n<p>resort to the ordinary and normal procedure of appearing before the<\/p>\n<p>Investigator or the learned Magistrate having jurisdiction and then seek<\/p>\n<p>regular bail in the ordinary course.\n<\/p>\n<p id=\"p_5\">      5. This application is accordingly dismissed. I may however hasten<\/p>\n<p>to observe that if the petitioner appears before the learned Magistrate and<\/p>\n<p>applies for bail after giving sufficient prior notice to the Prosecutor in<\/p>\n<p>charge of the case, the learned Magistrate must proceed to pass orders on<\/p>\n<p>merits, in accordance with law and expeditiously.<\/p>\n<p id=\"p_6\">                                                (R.
