M. SAHAI)<\/p>\n<p id=\"p_1\">1.\tThis<br \/>\nLetters Patent Appeal has been preferred against the judgment and<br \/>\norder dated 08.08.2011 passed by the learned Single Judge in Special<br \/>\nCivil Application No.10216\/2011.\n<\/p>\n<p id=\"p_2\">2.<br \/>\n\tHeard Ms. L.K. Bhaya learned counsel for the appellant. She<br \/>\nsubmitted that the learned Single Judge erred in appreciating the<br \/>\nfact that the appellant has been granted exemption by the State<br \/>\nLabour Department vide its Notification dated 21.12.1964. She also<br \/>\nsubmitted that the written arguments submitted by the appellant were<br \/>\nnot considered by the authority and that when the reply was filed on<br \/>\n14.07.2011, straight-away the matter was fixed for final judgment,<br \/>\nwithout granting any opportunity to the appellant. She further<br \/>\nsubmitted that the order passed by the authority is a non-speaking<br \/>\norder as no reasons were assigned.\n<\/p>\n<p id=\"p_3\">3.\tThis<br \/>\nappeal has been preferred against an order passed by the learned<br \/>\nSingle Judge wherein, the order under challenge was passed by the<br \/>\ncompetent authority under The Employees&#8217; Provident Fund and<br \/>\n<a href=\"\/doc\/269107\/\" id=\"a_1\">Miscellaneous Provisions Act<\/a>, 1952.\n<\/p>\n<p id=\"p_4\">4.\tIn<br \/>\nour opinion, the petition before the learned Single Judge was under<br \/>\n<a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the Constitution of India and in view of the decision<br \/>\nrendered by the Full Bench of this Court in the case of <a href=\"\/doc\/101077\/\" id=\"a_2\">The<br \/>\nBhagyodaya Co-operative Bank Limited v. Natvarlal Patel and others<\/a>,<br \/>\n2011 (2) G.L.H. 147, a Letters Patent Appeal against the<br \/>\norder of the learned Single Judge would not be maintainable.\n<\/p>\n<p id=\"p_5\">5.\tIn<br \/>\nview of the above, this appeal is not entertained on the ground on<br \/>\nmaintainability alone. Hence, the appeal is dismissed. Consequently,<br \/>\nthe civil application also stands rejected.\n<\/p>\n<p id=\"p_6\">[V.M. SAHAI, J.]\t\t<\/p>\n<p>[K. S.
