Appeal from Order No. 568 of 1999<br \/>\n<span class=\"hidden_text\" id=\"span_1\">          MR KC SHAH AGP for Petitioner No. 1<\/span><br \/>\n          MR PR NANAVATI for Respondents No. 1-2<br \/>\n<span class=\"hidden_text\" id=\"span_1\">          MR MD PANDYA for Respondent No. 3<\/span><\/p>\n<p id=\"p_8\">     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p id=\"p_9\">              CORAM : MR.JUSTICE B.J.SHETHNA<\/p>\n<p>     Date of decision: 02\/11\/2001<\/p>\n<p>ORAL JUDGEMENT<br \/>\n     The appellant-original defendant No.1-Commissoner<br \/>\n     of Electricity (Electricity Duty) of Gujarat State has<br \/>\n     challenged in this appeal the impugned order dated<br \/>\n     17.8.1999 passed by the 8th Joint Civil Judge (S.D.)<br \/>\n Vadodara granted application below Ex.5 in Special Civil<br \/>\nSuit No.211\/99 in terms of para 16(1) of application Ex.5<br \/>\ntill final disposal of the suit whereby the recovery<br \/>\nstayed.   This appeal was straightaway      admitted   on<br \/>\n9.12.1999 and fixed for hearing immediately on 15.12.1999<br \/>\nbut due to some or the other reason this could not be<br \/>\nheard till today. Be that as it may.\n<\/p>\n<p id=\"p_10\">Learned AGP, Mr.K.C.Shah for      the   appellant<br \/>\nsubmitted that such recovery cannot be challenged before<br \/>\nthe civil court and the civil court will have no<br \/>\njurisdiction to entertain suit, therefore, civil court<br \/>\nought not to have granted injunction.        He    further<br \/>\nsubmitted that whether it is manufacturing process or not<br \/>\nthat question has to be decided by this court in a writ<br \/>\npetition filed by other persons, therefore, prima facie<br \/>\nview taken by the learned Trial Judge in favour of the<br \/>\nplaintiff cannot be sustained. He also submitted that<br \/>\nrecovery of public revenue running into lakhs of rupees<br \/>\nhas been stayed by trial court, which is not permissible<br \/>\nunder law.    In support of his submission Mr.Shah has<br \/>\nrelied upon the order dated 20.02.2000 passed by my<br \/>\nlearned Brother   D.H.Waghela,   J.    in Special Civil<br \/>\nApplication No.373\/01 rejecting the prayer for interim<br \/>\nrelief in view of the judgment of the Hon&#8217;ble Supreme<br \/>\nCourt reported in AIR 1985 SC 330.         Mr.Shah    also<br \/>\nsubmitted that while allowing application Ex.5 learned<br \/>\nTrial Judge has practically decreed the suit.          He,<br \/>\ntherefore, submitted that the interim relief granted by<br \/>\nthe trial court be vacated and they may be permitted to<br \/>\ndisconnect    the    electricity    connection    or   the<br \/>\nrespondent-original plaintiff be directed to deposit the<br \/>\nentire amount due from them by way of electricity duty.\n<\/p>\n<p id=\"p_11\">However, learned counsel Shri Nanavati for the<br \/>\nrespondents-plaintiffs   vehemently submitted that the<br \/>\ntrial court has jurisdiction to entertain suit and when<br \/>\nthe trial court found prima facie strong case in favour<br \/>\nof the plaintiff and that the balance of convenience was<br \/>\nalso in their favour and the irreparable loss would have<br \/>\nbeen caused to the plaintiffs if the injunction was not<br \/>\ngranted and in that view of the matter if the trial court<br \/>\nhas   granted injunction then this court should not<br \/>\ninterfere with such order.      He also submitted that<br \/>\nadmittedly the unit of the respondent-plaintiffs is Small<br \/>\nScale Industry (SSI) unit and the goods manufactured by<br \/>\nit is excisable because they are manufacturing the same,<br \/>\ntherefore, no excise duty can be levied as the unit was<br \/>\nexempted from payment of electricity duty from 11.1.1996<br \/>\nto 12.11.2000.    He also tried to rely upon the Gas<br \/>\nCylinder Rules, 1981 under which they were granted<br \/>\n license to manufacture oxygen gas, wherein manufacturing<br \/>\ngas is defined. He submitted that if this court comes to<br \/>\nthe conclusion that when there is a question of public<br \/>\nrevenue then the court in its discretion can pass<br \/>\nconditional order of depositing electricity duty at a<br \/>\nreasonable rate.\n<\/p>\n<p id=\"p_12\">This is a unique case where it would be difficult<br \/>\nfor this court to go into the merits of the case because<br \/>\nexcept the present respondents-original plaintiffs no one<br \/>\nelse had approached the civil court by way of suit and<br \/>\nother similarly situated persons have approached this<br \/>\ncourt by way of writ petitions under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the<br \/>\nConstitution of India.    Number of interim orders passed<br \/>\nby different Hon&#8217;ble Judges of this court have been<br \/>\nbrought to my notice.      In some cases blanket stay was<br \/>\ngranted, in some cases no interim relief was granted and<br \/>\nin   some   cases   interim relief granted on certain<br \/>\nconditions and the writ petitions are pending for final<br \/>\ndisposal before this court. Under the circumstances, it<br \/>\nwould not be proper for this court to express any opinion<br \/>\nabout the merits of the case. However, when the trial<br \/>\ncourt granted unconditional interim relief in favour of<br \/>\nthe respondents-plaintiffs then this court        has  to<br \/>\nconsider as to whether the blanket interim relief granted<br \/>\nin favour of the respondents-plaintiffs be confirmed or<br \/>\nmodified or set aside.\n<\/p>\n<p id=\"p_13\">As stated earlier, different Hon&#8217;ble Judges of<br \/>\nthis court while entertaining writ petitions passed<br \/>\ndifferent types of interim orders. In some cases, this<br \/>\ncourt refused interim relief, in some cases, the interim<br \/>\nrelief was granted on certain conditions and in few cases<br \/>\nblanket interim relief is granted.\n<\/p>\n<p id=\"p_14\">It is true that in an almost identical case of<br \/>\nSky Oxygen, learned Single Judge of this court refused<br \/>\nthe   interim    relief   in   Special Civil Application<br \/>\nNo.4415\/99. In another writ petition being Special Civil<br \/>\nApplication   No.373\/01    filed   by  Bharat   Petroleum<br \/>\nCorporation Ltd.     another learned Single Judge of this<br \/>\ncourt specifically rejected the prayer for interim relief<br \/>\nin view of the judgment of the Hon&#8217;ble Supreme Court<br \/>\nreported in AIR 1985 SC 330 but the fact which is not in<br \/>\ndispute is that in few cases this court granted interim<br \/>\nrelief, some other judges of this court granted blanket<br \/>\ninterim relief and in some cases interim relief is<br \/>\ngranted on certain conditions directing the petitioners<br \/>\nto deposit specific amount.\n<\/p>\n<p id=\"p_15\">Having   regard   to   the   peculiar   facts   and<br \/>\n circumstances of the case and the fact that in this case<br \/>\nthe trial court has granted blanket interim relief, which<br \/>\nis in operation in favour of appellants-plaintiffs till<br \/>\ntoday in absence of any interim order passed by this<br \/>\ncourt in this appeal, I am of the considered opinion that<br \/>\nthe impugned order passed by the trial court allowing<br \/>\nEx.5 is required to be modified suitably with certain<br \/>\nconditions without expressing any opinion on the legality<br \/>\nand validity of the same.\n<\/p>\n<p id=\"p_16\">Accordingly, this appeal is partly allowed to the<br \/>\nextent that the interim relief granted earlier by the<br \/>\ntrial court in terms of para 16(1) of the application<br \/>\nEx.5 is confirmed subject to the condition that the<br \/>\nrespondents-plaintiffs shall deposit 50% of outstanding<br \/>\namount of electricity duty with the appellants within one<br \/>\nmonth from today.\n<\/p>\n<p id=\"p_17\">It    is    made   clear   that   in   case   the<br \/>\nrespondents-plaintiffs ultimately succeeds in the suit<br \/>\nthen the said amount shall be refunded to them with<br \/>\ninterest on it as ordered by the civil court.\n<\/p>\n<p id=\"p_18\">(B.J.Shethna, J.)<br \/>\n*Pvv\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Appeal From Order No. 568 Of 1999 vs Mr Pr Nanavati For on 14 October, 2011 Author: B.J.Shethna, IN THE HIGH COURT OF GUJARAT AT AHMEDABAD APPEAL FROM ORDER No 568 of 1999 For Approval and Signature: Hon&#8217;ble MR.JUSTICE B.J.SHETHNA ============================================================ 1.
