Kapoor, J.\n<\/p>\n<p id=\"p_1\"> 1. In response to an invitation to tender for<br \/>\nmanagement of computerized car parking at terminal no. 1,<br \/>\nI.G.I. Airport, New Delhi, the petitioner submitted its<br \/>\ntender. The petitioner&#8217;s tender was accepted and<br \/>\nlicense\/contract was awarded to him vide letter of<br \/>\nacceptance dated 7.11.1996 initially for a period of one<br \/>\nyear. The contract was extendable for a further period of<br \/>\ntwo years. However, the contract\/license was terminated<br \/>\non 20.11.1997. Feeling aggrieved, the petitioner filed a<br \/>\ncivil suit for injunctions according to the him, as per<br \/>\nterms of the contract, license was extendable by further<br \/>\nperiod of two years. Though ex-parte injunction was<br \/>\ngranted but finally suit was dismissed.\n<\/p>\n<p id=\"p_2\"> 2. Admittedly there was an arbitration clause in<br \/>\nthe agreement between the parties. The disputes raised by<br \/>\nthe petitioner in this petition pertain to the period<br \/>\nsubsequent to the termination of contract. The main<br \/>\ngrievance of the petitioner is that the respondents<br \/>\ncommitted breach of contract by not providing air bus<br \/>\nparking to the petitioner though it was part of contract<br \/>\nand included in license fee of Rs. 4,35,000\/- p.m. and as<br \/>\nsuch petitioner is entitled to 30% rebate on total license<br \/>\nfee. Admittedly, petitioner was allowed to run only car<br \/>\nparking at Airbus parking area. The dispute whether he is<br \/>\nentitled to claim 30% rebate on total license fee because<br \/>\nof the failure of the respondent to provide him Airbus<br \/>\nParking is not a dispute which comes within the ambit of<br \/>\ncontract. Similarly the dispute whether petitioner has<br \/>\nbeen put to loss for the period subsequent to termination<br \/>\nof contract and his continuation by the order of court<br \/>\nup to 7.8.1998 is again not a dispute which comes within<br \/>\nthe terms of the contract or agreement. The dispute that<br \/>\nthe applicant was not allotted Indian Airlines Cargo<br \/>\nParking and Courier Terminal Parking and courtesy coach<br \/>\nparking areas is not relevant so far as contract\/license<br \/>\nis concerned. There was no privity of contract between<br \/>\nthe petitioner and the respondent in this regard. If at<br \/>\nall the petitioner has any such grievance, he can seek<br \/>\nremedy against Indian Airlines.\n<\/p>\n<p id=\"p_3\"> 3. A party is entitled to seek redressal of the<br \/>\ndisputes through arbitration if such disputes arise out of<br \/>\nthe contract between the parties and that too during the<br \/>\nsubsistence of the contract. Since the disputes referred<br \/>\nin the petition do not pertain to the period when the<br \/>\ncontract was subsisting and some of the disputes raised by<br \/>\nthe petitioner are such which do not come within the arena<br \/>\nof the contract or agreement between the parties nor<br \/>\nrespondents are concerned with such claims as referred by<br \/>\nthe petitioner in the petition, the question of<br \/>\nappointment of Arbitrator does not arise.\n<\/p>\n<p id=\"p_4\"> 4. Further more, the contract for car parking was<br \/>\ninitially for one year only. Merely because there was a<br \/>\nclause that this term was extendable by another two years<br \/>\ndid not vest any statutory right in the petitioner to get<br \/>\nextension for further period of two years and did not mean<br \/>\nthat respondents were under any legal obligation to extend<br \/>\nperiod of contract. The petitioner has already exhausted<br \/>\nthe remedy against termination of contract after a period<br \/>\nof one year before Addl. District Judge by way of civil<br \/>\nsuit. It appears that when he did not succeed there, he<br \/>\nhas resorted to these proceedings.\n<\/p>\n<p id=\"p_5\"> 5.
