He has been in the habit of<br \/>\nremaining unauthorizedly absent from time to time. Though under Clause 14 of the certified standing<br \/>\norders which is reproduced in paragraph 3 of the affidavit in reply<br \/>\nfiled by Mr.B.G.Patel, no notice of intimation was required to be<br \/>\ngiven to the absenting employee and an opportunity is available to<br \/>\nthe employee under the said clause to return except on medical<br \/>\ngrounds within 8 days with the expiry of the leave and explain to the<br \/>\nsatisfaction of the General Manager or any other officer authorized<br \/>\nby him his inability to return on the termination of his leave, the<br \/>\nemployer issued notice on 12.05.1989 (Annexure-2 page 21) advising<br \/>\nthe petitioner employee to report for duty immediately in any case by<br \/>\n19.05.1989 with a satisfactory explanation for his absence.  This<br \/>\nletter was sent by Registered Post A.D.  By letter dated 26.05.1991,<br \/>\nagain sent by Registered Post A.D., the employee was advised to<br \/>\nreport for duty immediately with the satisfactory explanation for his<br \/>\nabsence (page 22).  He was advised that in case he did not report for<br \/>\nduty by 06.06.1989 with a satisfactory explanation, he will be deemed<br \/>\nto have list his lien on his appointment in the Corporation.  Both<br \/>\nthese letters sent by Registered Post A.D. were refused to be<br \/>\naccepted and therefore, it was taken as good service.  As the<br \/>\nemployee did not obtain any leave and absented from 22.04.1989 and<br \/>\ndid not report for duty despite opportunity nor explained the cause<br \/>\nof his absence, under Registered Post A.D. letter dated 10.06.1989<br \/>\n(Annexure-3 page 23), the petitioner employee was advised that he is<br \/>\ndeemed to have lost his lien on the post by his own action in terms<br \/>\nof clause 14 of the Standing Orders and his name is struck off from<br \/>\nthe roll of the Corporation with effect from 10.06.1989.\n<\/p>\n<p id=\"p_4\">4.\tClause<br \/>\n14 provides for opportunity to the employee of returning for<br \/>\nexplaining way he remained absent.\n<\/p>\n<p id=\"p_5\">\tThis<br \/>\nclause thus provides for inbuilt opportunity to the employee.<br \/>\nDespite this opportunity by two Registered Post A.D. letters being<br \/>\ngiven to the employee to return or explain why he remained absent, as<br \/>\nthe employee done neither, he is deemed to have lost his lien by his<br \/>\nown action.  He has abandoned the service.\n<\/p>\n<p id=\"p_6\">5.\tThe<br \/>\nlearned advocate for the petitioner admits that the petitioner was<br \/>\naware of the aforesaid notices issued by the respondent.\n<\/p>\n<p id=\"p_7\">6.\tBoth<br \/>\nthe learned advocates agree that on the above fact situation, the<br \/>\nissue is now concluded by the following decisions of the Hon&#8217;ble Apex<br \/>\nCourt and this Court:-\n<\/p>\n<p id=\"p_8\">AIR<br \/>\n\t2000 SC 2198<\/p>\n<p><span class=\"hidden_text\" id=\"span_28\">(2001)<\/span><br \/>\n\t1 SCC 214<\/p>\n<p><span class=\"hidden_text\" id=\"span_29\">(1996)<\/span><br \/>\n\t11 SC 404<\/p>\n<p><span class=\"hidden_text\" id=\"span_30\">2008<\/span><br \/>\n\t AIR SCW 1629<\/p>\n<p><span class=\"hidden_text\" id=\"span_31\">2001<\/span><br \/>\n\t(3) GLR 2025<\/p>\n<p><span class=\"hidden_text\" id=\"span_32\">2001<\/span><br \/>\n\tLLR 155<\/p>\n<p id=\"p_9\">7.\tIn<br \/>\nview of the above, the petition is dismissed.
