Keeping in mind the<br \/>\ndocument, more particularly medical papers and other certificates<br \/>\nproduced on record,  I am of the view that the matter ought to have<br \/>\nbeen decided by the appellate Court on merits. In that view of the<br \/>\nmatter, the condonation application is allowed. The appellate Court<br \/>\nis directed to hear the appeal on merits. However, cost quantified at<br \/>\nRs. 7500\/- shall be paid by the petitioner.  The amount should be<br \/>\ndeposited between 07.02.2011 and 14.02.2011. On depositing the<br \/>\namount,  the appellate Court will proceed the matter on 21.02.2011.<br \/>\nThe aforesaid amount shall be paid to the respondents.\n<\/p>\n<p id=\"p_2\">3.0\tWith<br \/>\nthe above observation, the petition stands disposed of.  Notice is<br \/>\ndischarged with no order as to costs.
