Bihar, District Nalanda at\n                  Biharsharif.\n                                                    Versus\n           1.   THE STATE OF BIHAR through the Commissioner Cum Secretary, Medical\n                Education and Family Welfare, Department of Health, Government of Bihar,\n                Vikas Bhawan, Secretariate, Bailey Road, Patna.\n           2.   The Director-in-Chief, Medical Education &amp; Family Welfare, Department of\n                Health, Government of Bihar, vikas Bhawan, Secretariat, Bailey Road, Patna.\n           3.   The Civil surgeon, Nalanda at Biharsharif.\n           4.   The Accountant General, Bihar, Virchand Patel Path, Patna.\n                                                  -----------\n<\/pre>\n<p id=\"p_1\">3   1.10.2010                     No one appears for the petitioner.<\/p>\n<p id=\"p_1\">                                  Prayer of the petitioner in this writ application reads as<\/p>\n<p>                      follows:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                                               &#8220;That this writ application is directed for<br \/>\n                                  issuance of an appropriate writ\/ writs, direction\/<br \/>\n                                  directions, order\/ orders and command the<br \/>\n                                  respondents to given him the benefits of senior<br \/>\n                                  Selection Grade scale and\/or Second Time bound<br \/>\n                                  promotion scale after determination of last pay scale<br \/>\n                                  (L.P.C.) in the said scale and make payment of<br \/>\n                                  differential amount of gratuity, differential amount<br \/>\n                                  of leave salary, differential amount of regular<br \/>\n                                  pension from the date of retirement i.e. on<br \/>\n                                  31.01.1997.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">\n<p id=\"p_3\">                                  As with regard to the aforementioned prayer the<\/p>\n<p>                      respondents in their counter affidavit have explained that the<\/p>\n<p>                      petitioner has already been promoted in the junior selection grade<\/p>\n<p>                      w.e.f. 1.4.1997 and his time bound promotion is also under active<\/p>\n<p>                      consideration.\n<\/p>\n<p id=\"p_4\">                                  That being so, this Court would direct the respondent<\/p>\n<p>                      to ensure that the necessary decision with regard to time bound<\/p>\n<p>                      promotion of the petitioner, if not already taken, must be taken<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                     2<\/span><\/p>\n<p>              within a period of six months and the petitioner should also be<\/p>\n<p>              extended the monetary benefits to which he becomes entitled upon<\/p>\n<p>              grant of such time bound promotion.\n<\/p>\n<p id=\"p_5\">                          With the aforementioned observations and directions<\/p>\n<p>              this application is disposed of.\n<\/p>\n<p id=\"p_6\">\n<pre id=\"pre_1\">Abhay Kumar                                         ( Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Dr.Ram Ashray Singh vs The State Of Bihar &amp;Amp; Ors on 1 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.13161 of 2003 DR.RAM ASHRAY SINGH, son of late Jangi Singh, presently residing at mohalla Bhaisasur, Dental Clinic near Animal Husbandary Hospital, P.S.
