NO. 3186 OF 2005\n            = = = = = = = = = = = = = = =\n      Dated this the 10th day of November, 2008.\n\n                         O R D E R\n<\/pre>\n<p id=\"p_1\">     This revision is preferred against the judgment of the<\/p>\n<p>Sessions Judge, Thrissur in Crl.A.699\/03. The said appeal<\/p>\n<p>had been preferred against the conviction and sentence<\/p>\n<p>passed by the Judicial First Class Magistrate, Chalakudy in<\/p>\n<p>C.C.756\/00. It was an action initiated u\/s 138 of the <a href=\"\/doc\/1132672\/\" id=\"a_1\">N.I.<\/p>\n<p>Act<\/a>. The trial court found the accused guilty u\/s 138 and<\/p>\n<p>convicted   and   sentenced    him    to   undergo    simple<\/p>\n<p>imprisonment for a period of three months and to pay a<\/p>\n<p>compensation of Rs.2,00,000\/- in default to undergo simple<\/p>\n<p>imprisonment for three months.     In appeal the conviction<\/p>\n<p>was confirmed,    sentence    was   modified  into   one  of<\/p>\n<p>imprisonment till the raising of the Court and to pay a<\/p>\n<p>compensation of Rs.2,25,000\/- and in default to undergo<\/p>\n<p>simple imprisonment. It is against that decision the accused<\/p>\n<p>has come up in revision.\n<\/p>\n<p id=\"p_1\">Cr.R.P. 3186   OF 2005<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                -:2:-<\/span><\/p>\n<p id=\"p_2\">      2.   Heard the learned counsel for the revision<\/p>\n<p>petitioner as well as the counsel for the respondent. At the<\/p>\n<p>out set the limitation of revisional Court has to be<\/p>\n<p>mentioned. i.e, Unless there is illegality, irregularity,<\/p>\n<p>perversity or total mis-appreciation of evidence the revisional<\/p>\n<p>Court is not expected to entertain any question on facts. The<\/p>\n<p>learned counsel for the revision petitioner would submit<\/p>\n<p>before me that he moved an application u\/s 311 for<\/p>\n<p>comparing the signatures in Exts.D1 and D2 which was<\/p>\n<p>dismissed for non payment of the amount for sending it to<\/p>\n<p>the expert. The appellate court also did not entertain the<\/p>\n<p>plea and at this revisional stage this Court may not be able<\/p>\n<p>to entertain the case especially when there are other<\/p>\n<p>circumstances pointed out.\n<\/p>\n<p id=\"p_3\">       3.  It is the case of the complainant that the accused<\/p>\n<p>had borrowed a sum of 2,00,000\/- on 2.3.00 and in<\/p>\n<p>discharge of the liability had issued Ext.P1 cheque which<\/p>\n<p>when presented for encashment returned with endorsement<\/p>\n<p>insufficiency of funds. Thereafter a statutory notice was<\/p>\n<p>Cr.R.P. 3186  OF 2005<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 -:3:-<\/span><\/p>\n<p>issued and as no payment was made action was initiated u\/s<\/p>\n<p id=\"p_4\">138.<\/p>\n<p id=\"p_5\">      4.    The defence of the revision petitioner appears to<\/p>\n<p>be that in the year 1997 he had borrowed a sum of<\/p>\n<p>Rs.75,000\/- and at that time has handed over a cheque to<\/p>\n<p>the complainant as security which has been misused by him<\/p>\n<p>for filing the complaint.    The Court below appreciated the<\/p>\n<p>evidence of the complainant as well as the accused and<\/p>\n<p>found in favour of the complainant. The Courts below found<\/p>\n<p>that even according to the accused the discharge was made<\/p>\n<p>as early as in June, 1998 and the substantial documents<\/p>\n<p>relied on for the purpose of proving the discharge are<\/p>\n<p>thereafter and if the amount has been already paid there was<\/p>\n<p>no necessity for the mother to execute the document in<\/p>\n<p>favour of the complainant towards discharge of the liability.<\/p>\n<p id=\"p_6\">       5.   So far as the slips were concerned namely Exts.D2<\/p>\n<p>and D3 the Courts below found that the complainant had<\/p>\n<p>denied its execution and the revision petitioner did not<\/p>\n<p>succeed in proving the same. So taking into consideration<\/p>\n<p>Cr.R.P. 3186 OF 2005<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                              -:4:-<\/span><\/p>\n<p>the negotiable instrument namely Ext.P1 cheque and the<\/p>\n<p>presumption u\/Ss. 118 and 139 of <a href=\"\/doc\/1132672\/\" id=\"a_1\">N.I. Act<\/a> in the absence of<\/p>\n<p>acceptable evidence to rebut the presumption under those<\/p>\n<p>Sections the Courts below found in favour of the complainant<\/p>\n<p>and held that the accused had committed an offence u\/s 138.<\/p>\n<p>One cannot find any irregularity, illegality or perversity in<\/p>\n<p>such a finding and therefore there is no scope to interfere<\/p>\n<p>with the conviction u\/s 138.\n<\/p>\n<p id=\"p_7\">     6.    Learned counsel lastly submits that some leniency<\/p>\n<p>may be shown in the case of punishment. Appellate court has<\/p>\n<p>already   shown    leniency  by    reducing    three months<\/p>\n<p>imprisonment to one of imprisonment till the raising of the<\/p>\n<p>Court but enhanced the compensation u\/s 357(3)<a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>.<\/p>\n<p>from 2 lakhs to 2.25 lakhs. Being a criminal prosecution I<\/p>\n<p>feel some leniency can be shown in 138 matters and<\/p>\n<p>therefore it will be only just to reduce the amount to<\/p>\n<p>Rs.2,00,000\/- and further to convert it as fine.<\/p>\n<p id=\"p_8\">     In the result the Criminal Revision is disposed of as<\/p>\n<p>follows:\n<\/p>\n<p id=\"p_9\">Cr.R.P. 3186   OF 2005<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                 -:5:-<\/span><\/p>\n<p>      (1)   The conviction u\/s 138 of the <a href=\"\/doc\/1132672\/\" id=\"a_3\">N.I. Act<\/a> is upheld.<\/p>\n<p>      (2)   The sentence is modified and the revision<\/p>\n<p>petitioner is directed to undergo simple imprisonment for one<\/p>\n<p>day, i.e. till the raising of the Court and to pay a fine of<\/p>\n<p>Rs.2,00,000\/-     which   on   realisation  be   paid   to  the<\/p>\n<p>complainant in the case.\n<\/p>\n<p id=\"p_10\">      (3)   In case of default of payment of fine the revision<\/p>\n<p>petitioner has to undergo imprisonment for a period of two<\/p>\n<p>months.\n<\/p>\n<p id=\"p_11\">      (4)   The revision petitioner shall appear before the trial<\/p>\n<p>court to receive the sentence on 5.2.2009 and also for<\/p>\n<p>payment of fine.     In default the trial court is directed to<\/p>\n<p>execute the sentence.\n<\/p>\n<p id=\"p_12\">      The Crl.R.P. is disposed of as above.\n<\/p>\n<p id=\"p_13\">\n<p id=\"p_14\">                            M.N.
