No. 1181 of 2009\n                     =================\n            Dated this the 1st day of April, 2009.\n\n                               ORDER\n<\/pre>\n<p id=\"p_1\">      The accused in C.C. No.517 of 2002 on the file of the<\/p>\n<p>Judicial First Class Magistrate, Nilambur for an offence punishable<\/p>\n<p>under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of the        Negotiable Instruments Act, 1881,<\/p>\n<p>challenges the conviction entered and the sentence passed<\/p>\n<p>against him concurrently by the courts below.<\/p>\n<p id=\"p_1\">      2.    Pending this revision, the parties have settled the<\/p>\n<p>matter. Crl. M.A. No. 3532 of 2009 has been filed under <a href=\"\/doc\/177946336\/\" id=\"a_1\">Section<\/p>\n<p>147<\/a> of the Negotiable Instruments Act, 1881 seeking permission<\/p>\n<p>to record the composition entered into between the revision<\/p>\n<p>petitioner and the complainant.         The said petition has been<\/p>\n<p>signed by both the revision petitioner as well as the complainant<\/p>\n<p>and their respective counsels. In the light of this development,<\/p>\n<p>the aforementioned composition is recorded and it will have the<\/p>\n<p>effect of an acquittal of the revision        petitioner within the<\/p>\n<p>meaning of Sec. 320 (8) <a href=\"\/doc\/445276\/\" id=\"a_2\">Cr.P.C<\/a>. Money, if any, deposited by the<\/p>\n<p>revision petitioner before the trial court pursuant to the orders, if<\/p>\n<p>any, passed by the        superior courts shall be refunded to the<\/p>\n<p>revision petitioner\/accused.\n<\/p>\n<p id=\"p_2\">      This Crl.
