No.4139 of 2009\n               ---------------------------------\n              Dated, this the 9th day of February, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioner submits that his establishment is covered under<\/p>\n<p>the Employees Provident Fund and <a href=\"\/doc\/269107\/\" id=\"a_1\">Miscellaneous Provisions Act<\/a>,<\/p>\n<p>1952. Ext.P1 is an order passed by the 2nd respondent exercising his<\/p>\n<p>powers under <a href=\"\/doc\/269107\/\" id=\"a_1\">Section 7A<\/a> of the Act holding that the petitioner is<\/p>\n<p>liable to remit the amount mentioned therein.<\/p>\n<p id=\"p_1\">      2.    According to the petitioner on receipt of Ext.P1, he has<\/p>\n<p>filed Ext.P2 before the 2nd respondent seeking review of Ext.P1,<\/p>\n<p>invoking the powers under <a href=\"\/doc\/269107\/\" id=\"a_2\">Section 7B<\/a> of the Act. Orders have not<\/p>\n<p>been passed on Ext.P2. In the meanwhile, the petitioner apprehends<\/p>\n<p>that coercive steps will be initiated against the petitioner to recover<\/p>\n<p>the amount due under Ext.P1. It is with that grievance, the writ<\/p>\n<p>petition is filed.\n<\/p>\n<p id=\"p_2\">      3.    Heard the learned counsel appearing for the petitioner as<\/p>\n<p>also the learned standing counsel appearing for the respondents.<\/p>\n<p id=\"p_3\">      4.    As already stated, according to the petitioner on receipt<\/p>\n<p>of Ext.P1 issued under <a href=\"\/doc\/269107\/\" id=\"a_3\">Section 7A<\/a> of the Act, Ext.P2 application has<\/p>\n<p>WPC No.4139\/2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 -2-<\/span><\/p>\n<p>been made by him by invoking <a href=\"\/doc\/269107\/\" id=\"a_4\">Section 7B<\/a> of the Act. So long as<\/p>\n<p>Ext.P2 is pending, in my view, steps, if any, taken for recovery of the<\/p>\n<p>amount under Ext.P1 is premature.\n<\/p>\n<p id=\"p_4\">     5.    Therefore, I direct the 2nd respondent to consider and<\/p>\n<p>pass orders on Ext.P2 with notice to the petitioner, which shall be<\/p>\n<p>done as expeditiously as possible, at any rate, within eight weeks of<\/p>\n<p>production of a copy of this judgment.        In the meanwhile, it is<\/p>\n<p>directed that further proceedings pursuant to Ext.P1 shall be kept in<\/p>\n<p>abeyance.\n<\/p>\n<p id=\"p_5\">     6.
