Manager<\/p>\n<p>       The brief facts of this case are as under.\n<\/p>\n<p id=\"p_3\">2.     The Appellant had requested the CPIO on March 5, 2008 to let him<br \/>\nknow if a certain account holder was operating his Bank account through<br \/>\nsignature or thumb impression during a certain period. The CPIO replied on<br \/>\nApril 15, 2008 and denied the information claiming exemption from<br \/>\ndisclosure under <a href=\"\/doc\/1525538\/\" id=\"a_1\">Section 8(1)<\/a> (e) and (j) of the Right to <a href=\"\/doc\/671631\/\" id=\"a_2\">Information (RTI)<br \/>\nAct<\/a>. Not satisfied with this reply, the Appellant sent an appeal to the first<br \/>\nAppellate Authority on May 23, 2008. The Appellate Authority dismissed the<br \/>\nappeal by endorsing the decision of the CPIO and, additionally, citing the<br \/>\nexemption provision contained in <a href=\"\/doc\/1525538\/\" id=\"a_3\">Section 8(1)<\/a> (d) of the <a href=\"\/doc\/671631\/\" id=\"a_4\">RTI Act<\/a>. The<br \/>\nAppellant has moved the CIC in second appeal against the above order.\n<\/p>\n<p id=\"p_4\">3.     The Appellant was not present during the hearing but arrived much<br \/>\nafter the hearing was over and the Respondent had left. We heard his<br \/>\nsubmissions though. In this case, the Appellant had sought information<br \/>\nregarding the details of a third party customer and the manner he operated<br \/>\nhis Bank account. In the absence of any ostensible larger public interest in<br \/>\nthe disclosure of such information, the CPIO was right in denying it as such<br \/>\ninformation was being held by the Bank both in commercial confidence and<\/p>\n<p>CIC\/PB\/A\/2008\/01232-SM<br \/>\n in a fiduciary capacity. The Appellant argued that he needed this<br \/>\ninformation in connection with a court case. He also informed us that the<br \/>\naccount holder about whom he had sought the information had since passed<br \/>\naway. Thus, it is clear that there is no larger public interest involved in the<br \/>\ndisclosure of this information. Besides, since the account holder has passed<br \/>\naway, it would be a real breach of trust and confidence he had reposed in<br \/>\nthe Bank while opening his account if the information is disclosed now. In<br \/>\nany case, the Appellant has the option of requesting the court to summon<br \/>\nthe relevant records from the Bank if it thinks fit to ascertain if the account<br \/>\nholder used his signature or thumb impression in his transactions during the<br \/>\nrelevant period. We, therefore, find no infirmity in the decision of either<br \/>\nthe CPIO or the Appellate Authority in declining the desired information.\n<\/p>\n<p id=\"p_5\">4.     To our pointed query on the apparent delay in the response of the<br \/>\nCPIO, the Respondent submitted that the application for information had<br \/>\nitself been received only on March 15 and therefore the reply dated April 15<br \/>\nwas well within the stipulated period.\n<\/p>\n<p id=\"p_6\">5.     There is nothing more to be done in this case and it is, thus, disposed<br \/>\noff.\n<\/p>\n<p id=\"p_7\">6.
