Justice KURIAN JOSEPH\n\n Dated :25\/07\/2008\n\n O R D E R\n                          KURIAN JOSEPH, J.\n               ----------------------------------------------\n                   W.P.(C) No.13043 of 2005\n               ----------------------------------------------\n                      Dated 25th July, 2008.\n                            J U D G M E N T\n<\/pre>\n<p id=\"p_1\">                  The writ petition is filed mainly with the following<\/p>\n<p>prayer :-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                       &#8220;To issue a writ of mandamus declaring that the<br \/>\n          taking into custody and keeping the same in illegal custody of<br \/>\n          petitioner&#8217;s vehicle bearing registration No.KL-2\/R-8998 in view of<br \/>\n          the permit and licenses held by the petitioner as unjust and<br \/>\n          arbitrary and illegal and to declare the same.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_1\">It is seen from the statement that a fine of Rs.20,000\/- has been<\/p>\n<p>imposed on the petitioner, in addition to royalty and value of<\/p>\n<p>sand. It is also stated in the statement that the petitioner has<\/p>\n<p>been transporting river sand and not ordinary sand. Be that as it<\/p>\n<p>may, there is already an interim direction dated 29.4.2005 by this<\/p>\n<p>court to release the vehicle on furnishing bank guarantee to the<\/p>\n<p>tune of Rs.20,000\/-.
