And Others on 16 June, 2010<\/div>\n<pre id=\"pre_1\">Court\u00a0No.\u00a0\u00ad\u00a010\n\n\n\nCase\u00a0:\u00ad\u00a0WRIT\u00a0\u00ad\u00a0A\u00a0No.\u00a0\u00ad\u00a035365\u00a0of\u00a02010\n\n\n\nPetitioner\u00a0:\u00ad\u00a0Sarvesh\u00a0Kumar\u00a0Rai\n\nRespondent\u00a0:\u00ad\u00a0State\u00a0Of\u00a0U.P.\u00a0And\u00a0Others\n\nPetitioner\u00a0Counsel\u00a0:\u00ad\u00a0Somesh\u00a0Khare,Komal\u00a0Khare\n\nRespondent\u00a0Counsel\u00a0:\u00ad\u00a0C.S.C.\n\n\n\nHon'ble\u00a0Rakesh\u00a0Sharma,J.\n<\/pre>\n<p id=\"p_1\">Heard learned counsel for the petitioner and learned Standing Counsel who<br \/>\nhas accepted notice on behalf of Opp. Party Nos. 1 to 3.<\/p>\n<p>Issue\u00a0notice\u00a0to\u00a0Opp.\u00a0Party\u00a0No.\u00a04.\u00a0\n<\/p>\n<p id=\"p_1\">\nThe \u00a0 Opp. \u00a0 Parties \u00a0 may \u00a0 file \u00a0 counter \u00a0 affidavit \u00a0 within \u00a0 six \u00a0 weeks.\u00a0<\/p>\n<p>Rejoinder\u00a0affidavit,\u00a0if\u00a0any,\u00a0may\u00a0be\u00a0filed\u00a0with\u00a0in\u00a0two\u00a0weeks\u00a0thereafter.\u00a0<\/p>\n<p>List\u00a0this\u00a0case\u00a0in\u00a0the\u00a0first\u00a0week\u00a0of\u00a0September,\u00a02010.<\/p>\n<p>As\u00a0 per \u00a0 learned\u00a0 counsel \u00a0 for \u00a0 the\u00a0 petitioner, \u00a0 the\u00a0 petitioner \u00a0 has \u00a0 been\u00a0<\/p>\n<p>appointed\u00a0in\u00a0the\u00a0services\u00a0of\u00a0the\u00a0educational\u00a0institution,\u00a0indicated\u00a0in\u00a0<\/p>\n<p>the\u00a0writ\u00a0petition,\u00a0after\u00a0following\u00a0due\u00a0procedure\u00a0for\u00a0direct\u00a0recruitment.\u00a0<\/p>\n<p>Petitioners&#8217; \u00a0 appointment \u00a0 was \u00a0 made \u00a0 considering \u00a0 the \u00a0 compelling\u00a0<\/p>\n<p>administrative\u00a0exigencies,\u00a0number\u00a0of\u00a0students\u00a0in\u00a0the\u00a0institution\u00a0and\u00a0<\/p>\n<p>the\u00a0interest\u00a0of\u00a0imparting\u00a0proper\u00a0education\u00a0to\u00a0the\u00a0students\u00a0in\u00a0the\u00a0rural\u00a0<\/p>\n<p>areas.\n<\/p>\n<p id=\"p_2\">\nLearned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 petitioner \u00a0 has \u00a0 further \u00a0 submitted \u00a0 that \u00a0 the\u00a0<\/p>\n<p>petitioner\u00a0has\u00a0been\u00a0discharging\u00a0duties,\u00a0functions\u00a0and\u00a0responsibilities\u00a0<\/p>\n<p>of\u00a0the\u00a0post\u00a0held\u00a0by\u00a0him\u00a0and\u00a0as\u00a0such,\u00a0he\u00a0is\u00a0entitled\u00a0for\u00a0monthly\u00a0salary.\u00a0<\/p>\n<p>He\u00a0rather\u00a0submits\u00a0that\u00a0no\u00a0one\u00a0has\u00a0been\u00a0appointed\u00a0against\u00a0the\u00a0said\u00a0<br \/>\n post \u00a0 held \u00a0 by \u00a0 the \u00a0 petitioner \u00a0 by \u00a0 the \u00a0 concerned \u00a0 authority \u00a0 and \u00a0 the\u00a0<\/p>\n<p>continuance\u00a0of\u00a0the\u00a0petitioner&#8217;s\u00a0service\u00a0is\u00a0required\u00a0in\u00a0the\u00a0institution.\u00a0<\/p>\n<p>On\u00a0the\u00a0other\u00a0hand,\u00a0learned\u00a0Standing\u00a0Counsel\u00a0has\u00a0strongly\u00a0resisted\u00a0<\/p>\n<p>the \u00a0 motion \u00a0 on \u00a0 the \u00a0 ground \u00a0 that \u00a0 the \u00a0 petitioner \u00a0 was \u00a0 not \u00a0 finally \u00a0 and\u00a0<\/p>\n<p>regularly\u00a0appointed\u00a0and\u00a0there\u00a0is\u00a0absence\u00a0of\u00a0sanction\u00a0of\u00a0the\u00a0authority\u00a0<\/p>\n<p>concerned\u00a0as\u00a0required\u00a0under\u00a0law.\u00a0\n<\/p>\n<p id=\"p_3\">\nIn\u00a0view\u00a0of\u00a0the\u00a0above,\u00a0it\u00a0is\u00a0provided\u00a0that\u00a0if\u00a0the\u00a0employer\u00ademployee\u00a0<\/p>\n<p>relationship\u00a0subsists\u00a0and\u00a0the\u00a0petitioner\u00a0is\u00a0continuing\u00a0in\u00a0the\u00a0service,\u00a0he\u00a0<\/p>\n<p>shall\u00a0be\u00a0paid\u00a0his\u00a0current\u00a0salary\u00a0w.e.f.\u00a0June,\u00a02010\u00a0and\u00a0shall\u00a0be\u00a0allowed\u00a0<\/p>\n<p>to \u00a0 continue. \u00a0 The \u00a0 arrangement \u00a0 shall \u00a0 continue \u00a0 till \u00a0 the \u00a0 person \u00a0 duly\u00a0<\/p>\n<p>appointed\u00a0by\u00a0the\u00a0selection\u00a0board\u00a0joins\u00a0the\u00a0institution.\u00a0<\/p>\n<p>Order\u00a0Date\u00a0:\u00ad\u00a016.6.2010<\/p>\n<p>n.u.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Sarvesh Kumar Rai vs State Of U.P.
