{"id":249878,"date":"2011-08-25T00:00:00","date_gmt":"2011-08-24T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/amit-kumar-vs-the-state-of-bihar-on-25-august-2011"},"modified":"2017-10-09T08:25:00","modified_gmt":"2017-10-09T02:55:00","slug":"amit-kumar-vs-the-state-of-bihar-on-25-august-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/amit-kumar-vs-the-state-of-bihar-on-25-august-2011","title":{"rendered":"Amit Kumar vs The State Of Bihar on 25 August, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Amit Kumar vs The State Of Bihar on 25 August, 2011<\/div>\n<pre id=\"pre_1\">                             IN THE HIGH COURT OF JUDICATURE AT PATNA\n                                      Criminal Revision No.894 of 2011\n                   Amit Kumar, Son of Sailesh Kumar @ Sanjeet Kumar, Resident of\n                   Village-Nandan Bigha, Police Station-Hulasganj, District-Jehanabad, At\n                   present Renter in the House of Dipak Kumar (Informant) Mohalla-Ram\n                   Chandrapur (Shivpuri), Police Station-Laheri, District-Nalanda, under the\n                   guardianship of father of the petitioner.\n                                                                              .....Petitioner.\n                                                        Versus\n                   The State of Bihar                                         .....Opposite Party.\n                                           ----------------------------------\n<\/pre>\n<p id=\"p_1\">03\/   25.08.2011                        The      accused-petitioner               has    preferred<\/p>\n<p>                        this revision application under <a href=\"\/doc\/1475229\/\" id=\"a_1\">Section 53<\/a> of the<\/p>\n<p>                        Juvenile Justice (Care and <a href=\"\/doc\/1973522\/\" id=\"a_1\">Protection of Children)<\/p>\n<p>                        Act<\/a>, 2000, against the order dated 28th of June,<\/p>\n<p>                        2011,     passed      by    learned       Vth    Additional        Sessions<\/p>\n<p>                        Judge,        Nalanda         at     Biharsharif           in      Criminal<\/p>\n<p>                        (Juvenile) Appeal No. 61                   of 2011, by which the<\/p>\n<p>                        order       dated     10.05.2011        passed       by    the     court    of<\/p>\n<p>                        Juvenile Justice Board, Nalanda at Bihar Sharif in<\/p>\n<p>                        Juvenile Case No. 22 of 2011 has been confirmed and<\/p>\n<p>                        the appeal has been dismissed and the prayer for<\/p>\n<p>                        bail was rejected.\n<\/p>\n<p id=\"p_1\">                                        Heard        Shri      Devendra           Prasad      Singh,<\/p>\n<p>                        learned        Counsel        appearing         on    behalf        of     the<\/p>\n<p>                        petitioner and Shri Hirday Prasad Singh and learned<\/p>\n<p>                        Counsel for the State.\n<\/p>\n<p id=\"p_2\">                                        Learned Counsel for the petitioner has<\/p>\n<p>                        submitted that the petitioner was declared juvenile<\/p>\n<p>                        by    the     Juvenile       Justice       Board,      thereafter,         his<\/p>\n<p>                        prayer for bail was rejected vide its order dated<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                   2<\/span><\/p>\n<p>10.05.2011.      Thereafter,       the       petitioner         preferred<\/p>\n<p>Criminal (Juvenile) Appeal No. 61 of 2011, which<\/p>\n<p>has been dismissed on             the ground that there is<\/p>\n<p>possibility that the release of juvenile is likely<\/p>\n<p>to bring him into association of criminals and he<\/p>\n<p>has further submitted that the accused\/petitioner<\/p>\n<p>has no criminal antecedent. The report was called<\/p>\n<p>for from the Probation Officer vide Letter No. 38<\/p>\n<p>dated 25.04.2011. There is no material to show that<\/p>\n<p>the release of the petitioner will defeat the ends<\/p>\n<p>of justice and there is no material to show that if<\/p>\n<p>the    petitioner     is       released,           he    will     go    into<\/p>\n<p>association of unknown criminals.<\/p>\n<p id=\"p_3\">               Learned        Counsel        for        the   State      has<\/p>\n<p>submitted that father of the petitioner will take<\/p>\n<p>care of the petitioner.\n<\/p>\n<p id=\"p_4\">               Considering the facts and circumstances<\/p>\n<p>of the case, hearing the parties and perusal of the<\/p>\n<p>impugned order as well as the report submitted by<\/p>\n<p>the    Probation      Officer,          it     appears          that     the<\/p>\n<p>contention of the petitioner is correct. There is<\/p>\n<p>no material on the record to show that there is<\/p>\n<p>reasonable ground for believing that the release of<\/p>\n<p>the    petitioner        is    likely        to     bring       him     into<\/p>\n<p>association with any known criminal or exposed him<\/p>\n<p>to    moral,   physical,        psychological            danger    or    his<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               3<\/span><\/p>\n<p>            release will defeat the ends of justice.<\/p>\n<p id=\"p_5\">                       Considering the facts and circumstances<\/p>\n<p>            stated above, in my opinion, the impugned order is<\/p>\n<p>            not fit to be sustained. It is set aside. The above<\/p>\n<p>            named petitioner is directed to be released on bail<\/p>\n<p>            on   furnishing       bail    bond     of    Rs.    10,000\/-     (ten<\/p>\n<p>            thousand) with two sureties of the like amount each<\/p>\n<p>            to the satisfaction of Juvenile Justice Board Case<\/p>\n<p>            No. 22 of 2011, arising out of Laheri P.S. Case No.<\/p>\n<p>            16 of 2011 with the following conditions:<\/p>\n<p id=\"p_6\">                                  (i)    the   father      of   the   petitioner<\/p>\n<p>                 will be one of the bailors, he will produce<\/p>\n<p>                 the   petitioner         before     the     Juvenile   Justice<\/p>\n<p>                 Board if and when required, in case of absence<\/p>\n<p>                 on two consecutive dates his bail bond liable<\/p>\n<p>                 to be cancelled.\n<\/p>\n<p id=\"p_7\">                                  (ii)     the     petitioner         will    not<\/p>\n<p>                 indulge in similar or any other offence, in<\/p>\n<p>                 case of violation of the terms his bail bond<\/p>\n<p>                 liable   to      be     cancelled      by   Juvenile   Justice<\/p>\n<p>                 Board and he shall be taken into custody.<\/p>\n<p id=\"p_8\">                       In the result, this revision application<\/p>\n<p>            is allowed.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">                                           (Amaresh Kumar Lal, J.)<br \/>\nkksinha\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
