      In this Revision Petition filed under Section 397 read with<\/p>\n
Sec. 401 Cr.P.C<\/a>. the petitioner who was the accused in C.C. No.<\/p>\n
203 of 2006 on the file of the Special J.F.C.M. (Marad Cases),<\/p>\n
Kozhikode, challenges the conviction entered and the sentence<\/p>\n
passed against him for an offence punishable under Sec. 138 of<\/p>\n
the Negotiable Instruments Act<\/a>, 1881 (hereinafter referred to as<\/p>\n
‘the Act’).\n<\/p>\n
      2.   I heard the learned counsel for the Revision Petitioner<\/p>\n
and the learned Public Prosecutor.\n<\/p>\n
      3.   The learned counsel appearing for the Revision<\/p>\n
Petitioner re-iterated the contentions in support of the Revision.<\/p>\n
The courts below have concurrently held that the cheque in<\/p>\n
question was drawn by the petitioner                  in favour of the<\/p>\n
complainant on the drawee bank, that the cheque was validly<\/p>\n
presented to the bank, that it was dishonoured for reasons which<\/p>\n
fall under Section 138<\/a> of the Act, that the complainant made a<\/p>\n
demand for payment by a notice in time in accordance with<\/p>\n
clause (b) of the proviso to Section 138<\/a> of the Act and that the<\/p>\n
Revision Petitioner\/accused failed to make the payment within<\/p>\n
Crl.R.P. 2334 of 2008            -:2:-<\/span><\/p>\n
15 days of receipt of the statutory notice.    Both the courts have<\/p>\n
considered and rejected the defence set up by the revision<\/p>\n
petitioner while entering the above finding. The said finding has<\/p>\n
been recorded on an appreciation of the oral and documentary<\/p>\n
evidence. I do not find any error, illegality or impropriety in the<\/p>\n
finding so recorded concurrently by the courts below.           The<\/p>\n
conviction was thus rightly entered against the petitioner.<\/p>\n
      4.         What now survives for consideration is the question<\/p>\n
as to whether        what should be the     proper sentence to be<\/p>\n
imposed on the revision petitioner. Having regard to the facts<\/p>\n
and circumstances of the case, I am inclined to modify the<\/p>\n
sentence imposed on the revision petitioner. In the light of the<\/p>\n
recent decision of the Supreme Court in                Ettappadan<\/p>\n
Ahammedkutty v. E.P. Abdullakoya – 2008 (1) KLT 851<\/p>\n
default sentence cannot be imposed for the enforcement of an<\/p>\n
order for compensation under Sec. 357 (3) Cr.P.C<\/a>. Accordingly,<\/p>\n
for the conviction under Section 138<\/a> of the Act the revision<\/p>\n
petitioner is sentenced to pay a fine of Rs. 49,000\/- (Rupees<\/p>\n
forty nine thousand only).          The said fine shall be paid as<\/p>\n
compensation under Section 357<\/a> (1) Cr.P.C<\/a>.             The revision<\/p>\n
petitioner is permitted either to deposit the said fine amount<\/p>\n
before the Court below or directly pay the compensation to the<\/p>\n
complainant within four       months from today and produce a<\/p>\n
memo to that effect before the trial Court in case of direct<\/p>\n
payment. If he fails to deposit or pay the said amount within<\/p>\n
the aforementioned period he shall suffer simple imprisonment<\/p>\n
Crl.R.P. 2334 of 2008          -:3:-<\/span><\/p>\n
for three months by way of default sentence.<\/p>\n
      In the result, this Revision is disposed of confirming the<\/p>\n
conviction entered but modifying the sentence imposed on the<\/p>\n
revision petitioner.\n<\/p>\n
