MISHRA,        SON         OF NOT      KNOWN    SENIOR\n         SUPERINTENDENT OF CUSTOM(PREV) DIVISION MOTIHARI,\n         DISTT-EAST CHAMPARAN..............................OPPOSITE PARTIES.\n                                      -----------\n<\/pre>\n<p id=\"p_1\">                       For petitioner:- Mr. Shahnawaz Ali, Advocate<br \/>\n                       For Custom :- Mrs. Archana Meenakshi, Advocate<br \/>\n                                        Mrs. Archana Sinha, Advocate\n<\/p>\n<p id=\"p_1\">                                       &#8212;&#8212;&#8212;\n<\/p>\n<p id=\"p_2\">05\/      21-Sep-2010             There is no dispute that the truck in question<\/p>\n<p>                       has already been released on the terms specified by the<\/p>\n<p>                       writ Court in order dated 11.12.2008 passed in<\/p>\n<p>                       CWJC.No.15601\/2008.That part of the order stands<\/p>\n<p>                       confirmed by the Division Bench of this Court by order<\/p>\n<p>                       dated 01.09.2009.\n<\/p>\n<p id=\"p_3\">                                 2. The writ Court, on the submission of the<\/p>\n<p>                       writ petitioners treated the goods loaded under truck to<\/p>\n<p>                       be plastic scraps and accordingly directed for its<\/p>\n<p>                       photographing and valuation with the further direction<\/p>\n<p>                       to release the scraps on furnishing of bond of the value<\/p>\n<p>                       of the scraps with two sureties of that amount. That part<\/p>\n<p>                       of the order was considered by the Division Bench in<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                    2<\/span><\/p>\n<p>course of hearing of the LPA and it was clarified that<\/p>\n<p>value of the plastic scraps is very insignificant and<\/p>\n<p>therefore the direction for release of the plastic scraps<\/p>\n<p>as given by the learned single Judge will stand.<\/p>\n<p>However, it was clarified that for release of plastic<\/p>\n<p>granules which according to Custom authorities formed<\/p>\n<p>part of the goods on the truck seized, the Division<\/p>\n<p>Bench clarified that any application for release of<\/p>\n<p>plastic granules shall be considered by the Custom<\/p>\n<p>authorities on its own merits.\n<\/p>\n<p id=\"p_4\">           3.   According to Custom authorities, the<\/p>\n<p>Opposite Parties herein, the petitioner wants to create a<\/p>\n<p>confusion and seek release of the plastic granules along<\/p>\n<p>with plastic scraps on the strength of the judgment of<\/p>\n<p>the Division Bench contained in Annexure-1 dated<\/p>\n<p>01.09.2009.\n<\/p>\n<p id=\"p_5\">           4. It is further case of the Opposite Parties<\/p>\n<p>that petitioner has not come forward with bonds of<\/p>\n<p>sufficient amount of the valuation of the plastic scraps<\/p>\n<p>to take release of the plastic scraps.<\/p>\n<p id=\"p_6\">           5. On the other hand, learned counsel for the<\/p>\n<p>petitioner submits that already application has been<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                    3<\/span><\/p>\n<p>filed for release of the scraps but no intimation has<\/p>\n<p>been given to the petitioner to furnish a bond of the<\/p>\n<p>value of scraps till date. According to learned counsel<\/p>\n<p>for the petitioner the authorities have not decided as yet<\/p>\n<p>that what part of the consignment is scrap and whether<\/p>\n<p>there is any plastic granules also in the consignment.<\/p>\n<p>Learned counsel for the Opposite Parties contests the<\/p>\n<p>submission and submits that a copy of Panchnama can<\/p>\n<p>be obtained by the petitioner which would show that<\/p>\n<p>the value of plastic scraps and plastic granules have<\/p>\n<p>been shown separately.\n<\/p>\n<p id=\"p_7\">          6. Be that as it may, the petitioner is directed<\/p>\n<p>to approach the concerned authorities and on his<\/p>\n<p>furnishing bonds of the required amount the plastic<\/p>\n<p>scraps shall be released to him within a period of four<\/p>\n<p>weeks from today. If the authorities have already<\/p>\n<p>decided that the consignment contains plastic granules<\/p>\n<p>also and its value, the same shall be communicated to<\/p>\n<p>the petitioner within the aforesaid period of four weeks<\/p>\n<p>particularly at the time when he approaches the<\/p>\n<p>authorities for release of plastic scraps. If they have not<\/p>\n<p>decided this issue, they must decide the same within<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                             4<\/span><\/p>\n<p>         four weeks and provide information to the petitioner as<\/p>\n<p>         soon as he approaches for release of the plastic scraps.<\/p>\n<p>         Thereafter, it will be open for the petitioner to apply for<\/p>\n<p>         release of plastic granules also if the authorities inform<\/p>\n<p>         him that the consignment contains plastic granules also.<\/p>\n<p>         Such application for release of plastic granules as<\/p>\n<p>         directed by the Division Bench shall be considered on<\/p>\n<p>         its own merit, preferably within six weeks from the<\/p>\n<p>         date of filing of such application.\n<\/p>\n<p id=\"p_8\">                   7.
