Dabhi, learned Additional Public Prosecutor waives service<br \/>\nof notice of Rule on behalf of the respondent-State of Gujarat.\n<\/p>\n<p id=\"p_2\">2.\t\tThis<br \/>\napplication has been filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\nProcedure, 1973, for grant of bail in connection with F.I.R. Being<br \/>\nC.R. No.I-75 of 2008, registered with Bhimasar Police Station,<br \/>\ninitially for offences punishable under <a href=\"\/doc\/1270101\/\" id=\"a_1\">Sections 279<\/a>, <a href=\"\/doc\/1721129\/\" id=\"a_2\">338<\/a>, <a href=\"\/doc\/1371604\/\" id=\"a_3\">304-A<\/a> of<br \/>\nthe Indian Penal Code and <a href=\"\/doc\/103867614\/\" id=\"a_4\">Sections 177<\/a>, <a href=\"\/doc\/9295814\/\" id=\"a_5\">184<\/a> and <a href=\"\/doc\/734786\/\" id=\"a_6\">134<\/a> of the Motor<br \/>\nVehicles Act.  Subsequently, by report dated 17.01.09 of<br \/>\nInvestigating Officer, <a href=\"\/doc\/1560742\/\" id=\"a_7\">sections 302<\/a> and <a href=\"\/doc\/1897847\/\" id=\"a_8\">120-B<\/a> of the Indian Penal<br \/>\nCode were sought to be added and other sections sought to be deleted.\n<\/p>\n<p id=\"p_3\">3.\t\tThe<br \/>\nallegations against the applicant is that he is involved in<br \/>\ncommission of the above-mentioned offences.\n<\/p>\n<p id=\"p_4\">4.\t\tBriefly<br \/>\nstated, the case of the prosecution is that two persons, met with an<br \/>\naccident with a truck and succumbed to their injuries.  Subsequently,<br \/>\nthe allegation against the applicant is that he is involved in the<br \/>\ncommission of above-mentioned offences, punishable under <a href=\"\/doc\/1560742\/\" id=\"a_9\">sections 302<\/a><br \/>\nand <a href=\"\/doc\/1897847\/\" id=\"a_10\">120-B<\/a> of the Indian Penal Code.\n<\/p>\n<p id=\"p_5\">5.\t\tMr.\n<\/p>\n<p id=\"p_6\">Yogesh Lakhani, learned senior counsel with Mr. Chirag Parekh,<br \/>\nlearned counsel for the applicant, has submitted that applicant is<br \/>\ninnocent and has been falsely implicated in the commission of the<br \/>\nalleged offences. That, the incident has taken place on 20.07.08, and<br \/>\nupto 24.11.08, the present version of the prosecution, that the<br \/>\napplicant was involved in more serious offence, did not surface.<br \/>\nThat, it is only on 24.11.08 i.e. after a period of about over four<br \/>\nmonths, that the applicant is sought to be involved in the commission<br \/>\nof the above-mentioned offences.  That there is no explanation<br \/>\nwhatsoever, why the said narration was not given, at an earlier point<br \/>\nof time, especially when the complainant has filed a private<br \/>\ncomplaint on 12.11.08, wherein this aspect is totally missing.  That<br \/>\nas there is no material on record to connect the applicant with the<br \/>\ncommission of above-mentioned offences, as no person has seen the<br \/>\napplicant committing the alleged offence and, as the charge-sheet has<br \/>\nbeen filed and investigation is over and, as the applicant is not<br \/>\nlikely to abscond, tamper with the evidence or intimidate the<br \/>\nwitnesses, the application may be considered.\n<\/p>\n<p id=\"p_7\">6.\t\tOn<br \/>\nthe other hand, Mr. L.B. Dabhi, learned Additional Public Prosecutor<br \/>\non behalf of the respondent-State, has strongly opposed the grant of<br \/>\nbail to the applicant.\n<\/p>\n<p id=\"p_8\">7.\t\tI<br \/>\nhave heard the learned counsel for the respective parties and perused<br \/>\nthe averments made in the application, contents of the FIR and other<br \/>\ndocuments on record. Considering the material on record, the<br \/>\nfollowing aspects emerge for consideration:\n<\/p>\n<p id=\"p_9\">a)\tThe<br \/>\nincident has taken place on 20.07.08.\n<\/p>\n<p id=\"p_10\">b)\tUpto<br \/>\n24.11.08, the  case  of  the\tprosecution\thas been that the deceased<br \/>\npersons died of\tinjuries sustained as a result of an accident, \twith<br \/>\na truck.\n<\/p>\n<p id=\"p_11\">c)\tOn<br \/>\n24.11.08, this version undergone a\tchange\twhich is allegedly on the<br \/>\nbasis of certain\tstatements, and the applicant is sought<br \/>\nto\tbe\tinvolved in an offence of a more serious\tnature.\n<\/p>\n<p id=\"p_12\">d)\tThe<br \/>\nversion of the prosecution is that the\tdeceased persons were lying in<br \/>\na bloodied\tcondition on the road.  However, there\t do\tnot   \tappear<br \/>\n\tto  be   any  eyewitnesses who\thave witnessed the entire incident.\n<\/p>\n<p id=\"p_13\">e)\tThe\twives<br \/>\nof the deceased persons have\t  filed \tpetitions\ton 21.08.08, for<br \/>\nclaiming\tcompensation before\tthe concerned Court, on\tthe ground that<br \/>\ntheir husbands (deceased\tpersons) died in an accident.\n<\/p>\n<p id=\"p_14\">f)\tOn<br \/>\nperusal of the material  on  record,\tincluding\tpapers of charge-sheet<br \/>\nand\tstatements, the involvement of the applicant\tin the commission of<br \/>\nthe alleged offence is\tnot clearly discernible.\n<\/p>\n<p id=\"p_15\">g)\tPrima-facie,<br \/>\nthere does not appear to be\tmaterial\t  on \trecord,  to<br \/>\nconnect\tthe\tapplicant    with     the commission of the<br \/>\n\tabove-mentioned\toffences.\n<\/p>\n<p id=\"p_16\">8.\t\tConsidering<br \/>\nthe above aspects, emerging from the material on record, prima-facie,<br \/>\nthe involvement of the applicant in the commission of above-mentioned<br \/>\noffences, in the manner alleged, is not clearly reflected, or<br \/>\nindicated from the record. Considering the totality of the facts and<br \/>\ncircumstances of the case, the nature and gravity of the offence, as<br \/>\nwell as the quantum of punishment that can be imposed<br \/>\nupon conviction, and as the applicant is not likely to abscond,<br \/>\ntamper with the evidence or intimidate witnesses, the application<br \/>\ndeserves to be allowed, especially, when the charge-sheet has been<br \/>\nfiled and investigation is over.\n<\/p>\n<p id=\"p_17\">9.\t\tFor<br \/>\nthe reasons stated above, the<br \/>\napplication is allowed. The applicant is ordered to be released on<br \/>\nbail in connection with FIR, being C.R. No.I-75 of 2008 registered<br \/>\nwith Bhimasar Police Station, on executing a personal bond to the<br \/>\ntune of Rs.10,000\/- (Rupees Ten Thousand Only), with one solvent<br \/>\nsurety of the like amount to the satisfaction of the trial Court and<br \/>\nsubject to the conditions that the applicant:\n<\/p>\n<p id=\"p_18\">\ta)\tshall<br \/>\n\tnot take undue advantage of his\tliberty or abuse his liberty in<br \/>\n\tany\tmanner;\n<\/p>\n<p id=\"p_19\">\tb)\tshall<br \/>\n\tnot act in a manner injurious to\tthe \tinterest of the prosecution or<br \/>\n\ttamper\twith evidence or intimidate witnesses;\n<\/p>\n<p id=\"p_20\">\tc)<br \/>\n\t \tshall maintain law and order and shall\tcooperate fully with the<br \/>\n\tinvestigating\tofficers and shall make himself\tavailable \tfor<br \/>\n\tinvestigation, as and\twhenever directed;\n<\/p>\n<p id=\"p_21\">\td)\tshall<br \/>\n\tmark his presence before the\tInvestigating Officer of the<br \/>\n\tconcerned\tPolice Station on the 15th and 30th<br \/>\n\tday of\tevery English calendar month, between\t10:00 am<br \/>\n\tto 5:00 pm, till the\tcommencement of trial.\n<\/p>\n<p id=\"p_22\">\te)\tshall<br \/>\n\tnot leave the local limits of the\tState of Gujarat without the<br \/>\n\tprior\tpermission of the concerned Sessions\tJudge;\n<\/p>\n<p id=\"p_23\">\tf)\tshall<br \/>\n\t furnish his  residential address\tto \tthe \tInvestigating Officer and<br \/>\n\talso to \tthe \tCourt  at the  time  of execution of\tthe\tbond and<br \/>\n\tshall not change his\tresidential\taddress \t without prior\tpermission<br \/>\n\tof this Court;\n<\/p>\n<p id=\"p_24\">\tg)\tshall<br \/>\n\t surrender  their Passport, if any,\tto\tthe \tlower Court within a<br \/>\n\tweek.\n<\/p>\n<p id=\"p_25\">10.\t\tIf<br \/>\nthe applicant commits breach of any of the above conditions, the<br \/>\nconcerned Sessions Judge will be free to issue warrants or take<br \/>\nappropriate action in the matter.\n<\/p>\n<p id=\"p_26\">11.\t\tIt<br \/>\nis made clear that no observations made by this Court be construed as<br \/>\nhaving any bearing on the merits of the case. At the time of the<br \/>\ntrial, the trial Court will proceed in accordance with law,<br \/>\nunaffected and uninfluenced by any observations contained in this<br \/>\norder.\n<\/p>\n<p id=\"p_27\">12.\t\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate, if prayed for.\n<\/p>\n<p id=\"p_28\">13.\t\tRule<br \/>\nis made absolute.
