Heard learned counsel for the petitioner and learned counsel for<\/p>\n<p>                      the State.\n<\/p>\n<p id=\"p_1\">                                   The petitioner apprehends his arrest in connection with a case in<\/p>\n<p>                      which cognizance of the offence punishable under <a href=\"\/doc\/1101188\/\" id=\"a_1\">section 379<\/a> of the Indian<\/p>\n<p>                      Penal Code and <a href=\"\/doc\/244673\/\" id=\"a_1\">section 27<\/a> of the Arms Act has been taken.<\/p>\n<p id=\"p_2\">                                   It is submitted that the petitioner is being maliciously<\/p>\n<p>                      prosecuted. Prior to the institution of the present case, a co-accused Ram<\/p>\n<p>                      Sakhi Paswan had already instituted a complaint case being Complaint Case<\/p>\n<p>                      No.574 of 2009 in the court of Chief Judicial Magistrate, Bhabua regarding<\/p>\n<p>                      the occurrence which is said to have taken place on 20.5.2009. The<\/p>\n<p>                      petitioner is one of the named witness in the complaint instituted by a co-<\/p>\n<p>                      accused Ram Sakhi Paswan. The present complaint has subsequently been<\/p>\n<p>                      instituted on 2.7.2010.\n<\/p>\n<p id=\"p_3\">                                   Taking   into   consideration   the   submissions,    facts   and<\/p>\n<p>                      circumstances of the case let the petitioner named above, in the event of<\/p>\n<p>                      arrest or surrender before the court below within a period of four weeks<\/p>\n<p>                      from the date of receipt\/communication of the order be released on bail on<\/p>\n<p>                      furnishing bail bonds of Rs.5,000\/- (five thousand) with two sureties of the<\/p>\n<p>                      like amount each to the satisfaction of learned S.D.J.M., Bhabua at Kaimur<\/p>\n<p>                      in   connection with Complaint Case No.851 of 2010 subject to the<\/p>\n<p>                      conditions as laid down under <a href=\"\/doc\/1692057\/\" id=\"a_2\">section 438(2)<\/a> of the Code of Criminal<\/p>\n<p>                      Procedure.\n<\/p>\n<p id=\"p_4\">\n<pre id=\"pre_1\">Md.S.
