Justice THOMAS P.JOSEPH\n\n Dated :30\/09\/2008\n\n O R D E R\n           H.L.DATTU, C.J. &amp; THOMAS P.JOSEPH, J.\n             ------------------------------------------------------\n                          W.A.No.1988 of 2008\n                 ----------------------------------------------\n             Dated, this the 30th day of September, 2008\n\n                               JUDGMENT\n<\/pre>\n<p id=\"p_1\">H.L.Dattu, C.J.\n<\/p>\n<p id=\"p_1\">              This writ appeal is directed against the interim order<\/p>\n<p>passed by the learned Single Judge in W.P.(C) No.27179\/2008 dated<\/p>\n<p>19.9.2008.\n<\/p>\n<p id=\"p_2\">              2. The learned Single Judge, while entertaining the writ<\/p>\n<p>petition has passed the following interim order:<\/p>\n<blockquote id=\"blockquote_1\"><p>       &#8221;   Standing Counsel takes notice.           There will be an<\/p>\n<p>       interim stay of Exhibit P3 on condition that the<\/p>\n<p>       petitioner pays the amount covered by Exhibit P3 in five<\/p>\n<p>       equal monthly instalments. The first instalment shall be<\/p>\n<p>       paid on or before 3.10.2008 and the subsequent<\/p>\n<p>       instalments shall be paid on or before the Ist working<\/p>\n<p>       day of every succeeding month. The payment will be<\/p>\n<p>       provisional and subject to the result of the Writ<\/p>\n<p>       Petition.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>              3. Aggrieved by the said order, the petitioner in the writ<\/p>\n<p>petition has presented this writ appeal.<\/p><\/blockquote>\n<p id=\"p_3\">\n<p id=\"p_4\">              4. Sri.M.V.Thamban, learned counsel appearing for the<\/p>\n<p>appellant, may be knowing the mind of the Court, would only request<\/p>\n<p>us to permit the appellant to pay the first instalment as directed by the<\/p>\n<p>learned Single Judge on 4.11.2008 and the subsequent instalments on<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.A.No.1988\/2008                    -2-<\/span><\/p>\n<p>or before the Ist working day of every succeeding months.<\/p>\n<p id=\"p_5\">              5. In our view, the request of the learned counsel for the<\/p>\n<p>appellant appears to be reasonable, and if it is granted, it would not<\/p>\n<p>prejudice the case of the respondents\/ Kerala State Electricity Board in<\/p>\n<p>any manner whatsoever. Accordingly, we pass the following:<\/p>\n<blockquote id=\"blockquote_2\"><p>                             Order<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_3\"><p>              i). The writ appeal is disposed of.<\/p><\/blockquote>\n<p id=\"p_6\">\n<p id=\"p_7\">              ii). The appellant is permitted to pay the first instalment as<\/p>\n<p>directed by the learned Single Judge on or before 4.11.2008 and the<\/p>\n<p>subsequent instalments on or before the Ist working day of the<\/p>\n<p>succeeding months.\n<\/p>\n<p id=\"p_8\">              iii).
