Past<\/p>\n<p>maintenance for 25 months was claimed in O.P.No.141\/09.<\/p>\n<p>Future maintenance under <a href=\"\/doc\/1056396\/\" id=\"a_1\">Section 125<\/a> Cr.P.C was claimed in<\/p>\n<p>M.C.No.143 of 2009. An amount of Rs.5,000\/- per mensum for<\/p>\n<p>the wife and Rs.1,500\/- per mensum was awarded for the wife<\/p>\n<p>and child as past and future maintenance.\n<\/p>\n<p id=\"p_1\">     2.     The appellant claims to be aggrieved by the impugned<\/p>\n<p>order.    Marriage is admitted.                   Separate residence is also<\/p>\n<p>admitted.      There was a contention that divorce has been<\/p>\n<p>effected. This was denied by the wife. No worthwhile material<\/p>\n<p>was adduced in support of the plea of divorce. In the light of the<\/p>\n<p>decision in <a href=\"\/doc\/332673\/\" id=\"a_1\">Shamim Ara v. State of U.P<\/a> [2002(3)KLT 537<\/p>\n<p>(S.C)], the appellant\/petitioner-husband cannot be heard to<\/p>\n<p>contend that on the available materials divorce has been<\/p>\n<p>established as insisted by law.\n<\/p>\n<p id=\"p_2\">     3.     There was a contention that the wife is employed. In<\/p>\n<p>support of that assertion also, no material whatsoever has been<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Mat.Appeal No.85\/10 &amp; R.P.F.C No.259\/10 2<\/span><\/p>\n<p>adduced. The court below did not accept that assertion. The claim<\/p>\n<p>for maintenance of the child is conceded and the order passed is<\/p>\n<p>not challenged before us in the course of arguments.<\/p>\n<p id=\"p_3\">      4.     Thus, in the course of arguments before us, the short<\/p>\n<p>question canvassed is that the quantum of past and future<\/p>\n<p>maintenance for the wife at the rate of Rs.5,000\/- per mensum is<\/p>\n<p>excessive. This is the short question that falls for consideration in<\/p>\n<p>this Mat.Appeal and the R.P.F.C.\n<\/p>\n<p id=\"p_4\">      5.     The husband is employed abroad. He was so employed<\/p>\n<p>even prior to his marriage with the claimant\/wife. He has been<\/p>\n<p>employed abroad for the past about two decades, without any<\/p>\n<p>disputes. The wife asserted that the husband&#8217;s monthly income<\/p>\n<p>exceeds Rs.1,00,000\/-. She tendered her own oral evidence in<\/p>\n<p>support of that assertion.             A power of attorney holder of the<\/p>\n<p>husband was examined as RW1. Even in the counter, the vague<\/p>\n<p>allegation is after deducting all expenses, his income is only<\/p>\n<p>Rs.5,000\/- per mensum.              RW1 did not adduce any satisfactory<\/p>\n<p>evidence &#8211; oral or documentary, on that aspect. The court below<\/p>\n<p>mainly relying on broad probabilities came to the conclusion that<\/p>\n<p>the appellant can reasonably be directed to pay an amount of<\/p>\n<p>Rs.5,000\/- per mensum as past and future monthly maintenance<\/p>\n<p>to his wife .\n<\/p>\n<p id=\"p_5\"><span class=\"hidden_text\" id=\"span_1\">Mat.Appeal No.85\/10 &amp; R.P.F.C No.259\/10 3<\/span><\/p>\n<p id=\"p_6\">      6.     We have been taken through the impugned common<\/p>\n<p>order. We find absolutely no circumstances that can persuade us<\/p>\n<p>to take any contra view. The degree of affluence of the husband is<\/p>\n<p>revealed from the fact that he has been employed abroad for the<\/p>\n<p>past about two decades admittedly. He did not adduce any better<\/p>\n<p>evidence to prove his precise income. It would be idle to expect<\/p>\n<p>the wife, left in India, to adduce evidence about the precise income<\/p>\n<p>of the husband, employed abroad. The burden was undoubtedly on<\/p>\n<p>the husband to adduce evidence, if he had a contra case to about<\/p>\n<p>his actual income. He did not discharge that burden on him.<\/p>\n<p id=\"p_7\">      7.     In any view of the matter, we are satisfied that the<\/p>\n<p>quantum of maintenance fixed by the court below cannot be held<\/p>\n<p>to be incorrect, inappropriate or perverse as to warrant invocation<\/p>\n<p>of our appellate jurisdiction under <a href=\"\/doc\/1411868\/\" id=\"a_2\">Section 19<\/a> of the Family Courts<\/p>\n<p>Act or our revisional jurisdiction under <a href=\"\/doc\/1571667\/\" id=\"a_3\">Section 401<\/a> Cr.P.C.<\/p>\n<p id=\"p_8\">      8.
