Junagadh was acquired for<br \/>\nthe purpose of construction of &#8220;Vrajmi Water Flow Scheme&#8221;.<br \/>\nThe Notification under Section 4 of the Act was published on<br \/>\n20.12.1979 whereas Notification under Section 6 of the Act was<br \/>\npublished on 4.5.1981.\n<\/p>\n<p id=\"p_3\">2.2\tThe<br \/>\nland Acquisition Officer after following due procedure vide his award<br \/>\ndated 11.05.1982, awarded Rs.100\/- per Are for the irrigated land,<br \/>\nRs.65\/- per Are for non-irrigated land and Rupee 1\/- per Are for<br \/>\nwaste (Kharaba) land against the claim of the claimants for Rs.1000\/-<br \/>\nper Are for irrigated land.\n<\/p>\n<p id=\"p_4\">2.3\tUnder<br \/>\nthe protest claimants-defendants herein accepted the claim amount and<br \/>\npreferred Reference under <a href=\"\/doc\/1517117\/\" id=\"a_1\">Section 18<\/a> of the Land Acquisition Act,<br \/>\n1894 against the award of the Land Acquisition Officer before the<br \/>\ntrial Court.\n<\/p>\n<p id=\"p_5\">2.4\tThe<br \/>\nsaid reference came to be decided by the learned Civil Judge (SD),<br \/>\nVeraval, who by his judgment and award dted 12.3.2004 awarded<br \/>\nRs.525\/- per Are as an additional amount for the acquired irrigated<br \/>\nland. The appellant being aggrieved by the said award passed by the<br \/>\nlearned trial Court preferred the present appeal.\n<\/p>\n<p id=\"p_6\">3.0\tMr.\n<\/p>\n<p id=\"p_7\">Janak Raval, learned Assistant Government Pleader appearing for the<br \/>\nappellant-State has submitted that the Trial Court has committed<br \/>\nerror in awarding Rs.525\/- per Are as an additional amount for the<br \/>\nacquired irrigated land relying upon the evidences which are at<br \/>\nExh.26 and 30 and the documentary evidences produced by the claimants<br \/>\nvide Exh.25. He has further submitted that the learned trial Court<br \/>\nalso committed an error not relying upon the evidence of farmer<br \/>\nKanaksinh Mandanji at Exh.42 and the documentary evidences produced<br \/>\nvide Exhs. 34 to 41.\n<\/p>\n<p id=\"p_8\">4.0\tLearned<br \/>\ncounsel for the appellant has also submitted that the learned trial<br \/>\nCourt has not considered the written submissions filed at Exh.44.\n<\/p>\n<p id=\"p_9\">5.0\tI<br \/>\nhave heard the learned counsel for the appellant. While considering<br \/>\nthe the evidences and documentary evidences on record the learned<br \/>\ntrial Court has considered present case as per land of village<br \/>\nAmrapur of Reference Case No.20 of 1985 and held that land of the<br \/>\npresent village is having same fertility as of land of Reference Case<br \/>\nNo.20 of 1985. Further the learned trial Court has rightly held that<br \/>\nthe State of Gujarat has not proved any other factor or disadvantage<br \/>\nwhich can lead to differ with the quality of the acquired land of<br \/>\nvillage Amrapur. After considering the the evidences and documentary<br \/>\nevidences on record, I am in complete agreement with the reasoning<br \/>\nrecorded by the learned trial Court. Hence, as no case is made out,<br \/>\npresent appeal is dismissed.\n<\/p>\n<p id=\"p_10\">[K.\n<\/p>\n<p id=\"p_11\">S.
