       Application   for   regular   bail.     The   petitioner   faces   allegations<\/p>\n
under   Section   302<\/a>   and   323<\/a>   I.P.C.     Petitioner   is   the   nephew   of   the<\/p>\n
deceased.  There allegedly was a boundary dispute between the sister<\/p>\n
of   the   accused   and   the   deceased.     In   the   course   of   an   attempt   to<\/p>\n
identify the boundary, there was some wordy altercation which led to<\/p>\n
the   petitioner   allegedly   hitting   the   deceased   with   hand   and   kicking<\/p>\n
him with his leg.  The deceased had some cardiac ailments.  Unable to<\/p>\n
stand the strain, he expired.   Allegations under Section 302<\/a> I.P.C are<\/p>\n
raised   against   the   petitioner.     The   petitioner   had   come   before   this<\/p>\n
Court   claiming   anticipatory   bail.     That   prayer   was   rejected,   but   the<\/p>\n
petitioner was permitted to surrender before the Investigating Officer<\/p>\n
on   a   specified   date.     He   could   not   do   so.     But   he   later   surrendered<\/p>\n
before   the   learned   Magistrate   on   05.06.2007.     He   was   remanded   to<\/p>\n
custody.     Later   the   police   filed   an   application   to   get   police   custody.<\/p>\n
That   prayer   was   resisted,   but   the   petitioner   was   permitted   to   be<\/p>\n
interrogated   in   the   prison.     Such   interrogation   is   also   over.     The<\/p>\n
petitioner has been continuing in custody from 05.06.2007.<\/p>\n
       2.      The   learned   counsel   for   the   petitioner   submits   that   the<\/p>\n
allegations,  even  if  accepted   in  toto,  cannot  lead   to  any   inference  of<\/p>\n

culpability   under   Section   302<\/a>   or   304   I.P.C<\/a>   and   at   worst   what   is<\/p>\n
revealed   is   only   an   offence   punishable   under   Section   323<\/a>   Cr.P.C.<\/p>\n
Counsel submits that in these circumstances the continued detention<\/p>\n
of   the   petitioner   in   custody   is   unnecessary   and   unjustified.     It   is<\/p>\n
prayed that the petitioner may, in these circumstances, be released on<\/p>\n
bail.\n<\/p>\n

         3.    The   learned   Public   Prosecutor     opposes   the   application.<\/p>\n
The learned Public Prosecutor   submits that it is too early to sail to a<\/p>\n
conclusion that the offence under Section 302<\/a> or 304 I.P.C<\/a> will not be<\/p>\n
revealed.  Being the nephew, he must be assumed to know or imputed<\/p>\n
with  the knowledge   that his uncle was suffering from acute cardiac<\/p>\n
disease   and   that   his   conduct   is   certain   to   lead   to   the   death   of   the<\/p>\n
deceased.\n<\/p>\n

         4.    I shall not enter into the controversies raised.  Suffice it to<\/p>\n
say   that   I   am   satisfied   that   bail   can   be   granted   to   the   petitioner<\/p>\n
subject   to   appropriate   conditions,.     I   take   note   of   the   submission   of<\/p>\n
the   learned   Public   Prosecutor     that   the   deceased   and   the   petitioner<\/p>\n
are neighbours and relatives and continued presence of the petitioner<\/p>\n
in the  locality  is  likely   to act as an  irritant   and  might  endanger the<\/p>\n
law and order situation.\n<\/p>\n
\n
         5.    In   the   result,   this   application   is,   allowed.     The   petitioner<\/p>\n
shall be released on bail on the following terms and conditions.<\/p>\n
B.A.No.3589 of 2007                       3<\/span><\/p>\n
         i)      The   petitioner   shall   execute   a   bond   for   Rs.50,000\/-<\/p>\n
(Rupees   Fifty   thousand   only)   with   two   solvent   sureties   each   for   the<\/p>\n
like sum to the satisfaction of the learned Magistrate;<\/p>\n
         ii)     The petitioner shall not enter the jurisdiction of Chevayur<\/p>\n
Police Station, Kozhikode district for a period of two months from the<\/p>\n
date   of   his   release   except   for   the   purpose   of   complying   with   the<\/p>\n
condition No.(iii) below;\n<\/p>\n
\n
         iii)    The   petitioner   shall   make   himself   available   for<\/p>\n
interrogation before the Investigating Officer between 10 a.m and 12<\/p>\n
noon  on   all   Mondays   for   a   period   of   three  months   and  thereafter   as<\/p>\n
and when directed by the Investigating Officer in writing to do so.<\/p>\n
