Appeal by the assessee came to be allowed placing<br \/>\nreliance on the decision of Larger Bench of the Tribunal in the case<br \/>\nof <a href=\"\/doc\/1975354\/\" id=\"a_1\">Gujarat Narmada Valley Fertilizers Co. Ltd. vs. C.C.E.,<br \/>\nVadodara<\/a> reported in 2007<br \/>\n(208) ELT 342.  In view of<br \/>\nallowing of such appeal, Revenue&#8217;s appeal against non-imposition of<br \/>\npenalty and interest came to be dismissed as having become<br \/>\ninfructuous. Against this portion of the order the Revenue is before<br \/>\nus by way of this appeal.\n<\/p>\n<p id=\"p_2\">3.0<br \/>\n   We may notice that insofar as the assessee&#8217;s appeal was allowed by<br \/>\nthe Tribunal by the impugned judgment, the Revenue had carried the<br \/>\nmatter in appeal before us. Such appeal being Tax Appeal No.1132 of<br \/>\n2009 came to be allowed by<br \/>\nour order dated 24th<br \/>\nMarch, 2011. In view of the reversal of the Tribunal&#8217;s decision with<br \/>\nrespect to quantum additions, the question of penalty and interest<br \/>\nwould revive and the same would have to be, in our prima<br \/>\nfacie opinion,<br \/>\nconsidered by the Tribunal.\n<\/p>\n<p id=\"p_3\">4.0<br \/>\n   In view of above situation, issue Notice<br \/>\nfor<br \/>\nfinal disposal returnable on 20th<br \/>\nOctober, 2011.
