According to him,<br \/>\nhe is conversant with the ailment of the applicant-accused. Mr. V.C.<br \/>\nTrivedi, Senior Jailor, who is a gazetted officer is also present.\n<\/p>\n<p id=\"p_1\">\tIt<br \/>\nis submitted jointly by these two officials that applicant is being<br \/>\ntreated by the Cancer Hospital of State of Gujarat, attached with<br \/>\nCivil Hospital, Ahmedabad and the applicant was to be sent to<br \/>\nHospital for Colonoscopy. Complaint of the applicant is that he is<br \/>\nbleeding per rectum. On two different dates, firstly, on 8th<br \/>\nDecember, 2008, requisition for police escort was sent to the  Joint<br \/>\nPolice Commissioner and thereafter, on 12th December,<br \/>\n2008, similar request was made and  for 19th December,<br \/>\n2008, requisition was made. We are of the view that inaction on the<br \/>\npart of the Joint Police Commissioner is clear violation  of<br \/>\nfundamental right of a  prisoner. Statutory obligation of  the State<br \/>\nis to see that each prisoner gets appropriate treatment at<br \/>\nappropriate time.\n<\/p>\n<p id=\"p_2\">\tBefore<br \/>\npassing  any adverse orders against Senior Officer like Joint Police<br \/>\nCommissioner, we would like to  call him in person. Learned APP is<br \/>\ndirected to see that the Joint Police Commissioner appears before<br \/>\nthis Court at 4.00 p.m today without fail, failing which, appropriate<br \/>\nfurther order shall be passed, or this Court may be  informed that<br \/>\ntomorrow, there shall be police escort and necessary arrangement<br \/>\nshall be made by the jail authority and the doctor treating and<br \/>\nsupervising the ailment of the applicant-accused in prison, and that<br \/>\nappropriate treatment and diagnostic procedure shall be completed by<br \/>\ntomorrow or at the earliest, preferably within 4 days from today,<br \/>\notherwise, ignoring the resistance placed by the Narcotic Control<br \/>\nBureau, the Court shall have to pass appropriate orders granting<br \/>\ntemporary bail to the applicant-accused, at least for some days.  It<br \/>\nis clarified that in such type of event of profuse bleeding by the<br \/>\npatient, responsibility  of not providing police escort shall be on<br \/>\nthe shoulders of the officers who are not arranging for police<br \/>\nescort. Order and direction accordingly.  Copy of this order be given<br \/>\nto learned APP so that, copy of this order be  faxed to the Police<br \/>\nHeadquarters, Ahmedabad. Copy of this order also be given to learned<br \/>\ncounsel appearing for the applicant.\n<\/p>\n<p id=\"p_3\">\t\t\t\t\t[C.K.\n<\/p>\n<p id=\"p_4\">BUCH, J.]\t\t[D.N. PATEL, J.]<\/p>\n<p>FURTHER<br \/>\nORDER<\/p>\n<p>\tBefore<br \/>\nthe above order could be signed, a statement has been made by both<br \/>\nthe officers who are present in Court through learned APP that the<br \/>\napplicant-accused shall be taken to Civil Hospital, more<br \/>\nparticularly, to M.P.Shah Cancer Hospital attached with the Civil<br \/>\nHospital, so that appropriate treatment can be given  to the<br \/>\napplicant, including Colonoscopy as suggested by the doctor who had<br \/>\nvisited the jail lastly on 12th December, 2008.\n<\/p>\n<p id=\"p_5\">\tWe<br \/>\nare told that one doctor had visited the jail premises on 12th<br \/>\n December, 2008 and had examined the present applicant-accused and he<br \/>\nhas also confirmed that Colonoscopy is required. As the assurance is<br \/>\ncoming from the officers, more particularly, jail doctor and Senior<br \/>\nJailor that the applicant now shall get appropriate treatment as<br \/>\nprescribed and suggested by the doctors, learned counsel appearing<br \/>\nfor the petitioner may not press this application, but we are of the<br \/>\nview that in the interest of justice, hearing of this application may<br \/>\nbe adjourned to 30th December, 2008. Learned APP shall<br \/>\nintimate the Court about the treatment given to the applicant-accused<br \/>\nin the period in between.
