S.J. MUKHOPADHAYA)<\/p>\n<p>\tThis<br \/>\nCivil Application has been preferred for condonation of delay of 53<br \/>\ndays in preferring the proposed Misc. Civil Application for<br \/>\nrestoration of Letters Patent Appeal No. 125 of 2009.\n<\/p>\n<p id=\"p_1\">2.\tFrom<br \/>\nthe order dated 4.5.2010, it will be evident that the counsel for the<br \/>\nappellants sought permission to withdraw the appeal and, therefore,<br \/>\nthe case was disposed of.  The order reads as follows :-\n<\/p>\n<p id=\"p_2\">&#8220;Learned<br \/>\ncounsel appearing on behalf of the appellants sought for and<br \/>\npermitted to withdraw the Appeal without any liberty.  Learned<br \/>\ncounsel for the respondents have no objection.  It is accordingly<br \/>\ndismissed.  Interim relief, if any, stands vacated.&#8221;\n<\/p>\n<p id=\"p_3\">3.\tThe main<br \/>\nplea taken is that only the first appellant wanted to withdraw the<br \/>\nappeal, but that cannot be a ground for restoration of a case which<br \/>\nwas withdrawn.  For the said reason, we are not inclined to entertain<br \/>\nthis application.  Both the petition for condonation of delay and the<br \/>\nMisc. Civil Application for restoration are dismissed.\n<\/p>\n<p id=\"p_4\">\t\t\t\t\t\t[S.
