JUDGMENT<\/p>\n

Sharda Aggarwal, J.\n<\/p>\n

1. The petitioners being the executors of the ‘Will’
\nhave filed the present petition under Section 276<\/a> of the
\nIndian Succession Act and for grant of probate with
\nrespect to the estate of Smt. D.A. Shahani @ Lalri Shahani,
\nwife of late Lt.Col. J.N. Shahani, who died on 31st
\nMay, 2001, on the basis of her ‘Will’ dated 5th
\nJanuary, 1991.\n<\/p>\n

2. The testatrix Smt. D.A. Shahani left her last
\n‘Will’ and testament dated 5th January, 1991 bequeathing
\nher entire moveable and immovable assets in favor of
\nRadha Soami Satsang, Beas (in short the Satsant), a
\nsociety registered under the Societies Registration Act<\/a>,
\nof which she was a deciple. Her husband died in or about
\n1955 and there was no issue from the marriage. Her only
\nlegal heir is her sister Smt. Renu Thadani, who had filed
\nher NO objection Certificate to the grant of probate in
\nfavor of the petitioners.\n<\/p>\n

3. Notice of the petition was issued to the State
\nand the relations\/respondent through publication in the
\nnewspaper ‘Statesman’ and by displaying the notice on the
\nnotice board. Notice was also issued to the Chief
\nRevenue Controlling Authority for valuation report.
\nRespondent No. 2 Shri V.K. Sethi was reported to have
\nexpired after filing of the petition. Shri V.K. Sethi was
\none of the executors named in the ‘Will’ and was only
\nimp leaded as a proforma respondent and no relief was
\nclaimed against him. The petitioners are also the named
\nexecutors of the ‘Will’. Since there was no opposition
\nto the petition, evidence was taken by way of affidavits.
\nPetitioner No. 2, Shri Pramod Ahuja, Shri Sewa Singh and
\nShri Bul Chand Vishain Dass Navin, attesting witnesses of
\nthe ‘Will’ have filed their respective affidavits by way
\nof evidence.\n<\/p>\n

4. Shri Pramod Ahuja has testified that he had been
\nassociated with the testatrix for the last more than 25
\nyears. The deceased, being the devotee of Satsang, had
\nexecuted the ‘Will’ dated 5th January, 1991 in the
\npresence of one Shri S.L. Sondhi, the then Secretary of
\nthe Satsang and the ‘Will’ was witnessed by Shri Bul
\nChand Vishain Dass Navin as well as Shri Sewa Singh, who
\nis the present Secretary of the Satsang. The deponent,
\nbeing acquainted with the signatures of the deceased,
\nidentified her handwriting and that of the attesting
\nwitnesses Shri Sewa Singh and Shri Bul Chand Vishain Dass
\nNavin. The original ‘Will’ has been proved as Exhibit
\nP-1. Shri Pramod Ahuja has also proved the identity card
\nof the deceased issued by the Election Commission as
\nExhibit PW-1\/1. He also proved the deceased’s PAN Card
\nas Exhibit PW-1\/2. The house tax receipt pertaining to
\nHouse No. C-392, defense Colony, New Delhi, owned by the
\ndeceased, is Exhibit PW-1\/3. The Death Certificate of
\nthe testatric in Gurmukhi is Exhibit PW-1\/4, whereas
\nEnglish Translation has been proved as Exhibit PW-1\/5.
\nShe had died at Amritsar as the generally stayed at B-31,
\nDera Baba Jaimal Singh, Radha Soami Satsang Beas,
\nDistrict Amritsar being a devotee. The testatrix had
\nmoveable assets, as detailed in Schedule-II attached to
\nthe affidavit and has been proved as Exhibit PW-1\/6.\n<\/p>\n

5. To the same effect are the affidavits of Shri
\nSewa Singh and Shri Bul Chand Vishain Dass Navin. Both
\nof them were attesting witnesses to the ‘Will’. They
\nhave testified that on 5th January, 1991, the testatrix
\nhad signed the ‘Will’ in their presence and in the
\npresence of Shri S.L. Sondhi (since died). They have also
\ndeposed that they had also signed the ‘Will’ as attesting
\nwitnesses Along with Shri S.L. Sondhi in the presence of
\nthe testatrix and the testatrix had signed in their
\npresence. They have also deposed that at the time of
\nexecution of the ‘Will’, the testatrix was in a sound
\ndisposing state of mind and she was in perfect health.\n<\/p>\n

6. In view of the averments made in the petition and
\nthe deposition by way of affidavits of the witnesses, it
\nis abundantly clear that there was no opposition to the
\npetition. The averments made in the petition stand
\nproved by virtue of the deposition. In view of the
\ndeposition of the witnesses, I am satisfied that at the
\ntime of execution of the ‘Will’, the testatrix Smt.
\nD.A. Shahani was of sound disposing mind and had executed
\nthe ‘Will’ in the presence of the attesting witnesses and
\nthe attesting witnesses had signed the same in the
\npresence of the testatrix. Both the petitioners are
\nnamed executors in the ‘Will’ and as such there is no bar
\nin grant of probate in their favor.\n<\/p>\n

7. In view of my above discussion, I find that the
\npetition stands proved. The same is accordingly allowed.
\nThe probate of the ‘Will’ is granted in favor of the
\npetitioners with regard to the properties mentioned in
\nthe ‘Will’ including the moveable properties shown in
\nSchedule-II (Exhibit PW-1\/6), subject to the petitioners
\nfurnishing administration bond of the requisite value.\n<\/p>\n

8. With these observations, the petition stands
