No.42794 of 2010\n                  MANOJ KUNWAR son of Late Umdi Kunwar\n                                   Versus\n                          THE STATE OF BIHAR\n                                  -----------\n<\/pre>\n<p id=\"p_1\">3\/   14.03.2011               Heard learned counsel for the petitioner and the State.<\/p>\n<p id=\"p_1\">                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under <a href=\"\/doc\/1560742\/\" id=\"a_1\">sections 302<\/a>, <a href=\"\/doc\/386021\/\" id=\"a_1\">201<\/a>\/<a href=\"\/doc\/37788\/\" id=\"a_2\">34<\/a> Indian Penal Code and 27 of the<\/p>\n<p>                  <a href=\"\/doc\/1934415\/\" id=\"a_3\">Arms Act<\/a>.\n<\/p>\n<p id=\"p_2\">                              It has been submitted that at best it would be a case of<\/p>\n<p>                  having been last seen with the deceased against the petitioner and<\/p>\n<p>                  apart from one other case pending again him the petitioner has no<\/p>\n<p>                  criminal antecedents.\n<\/p>\n<p id=\"p_3\">                              In view of such, let the petitioner, above named, be<\/p>\n<p>                  released on bail on furnishing bail bond of Rs.5,000\/- (five<\/p>\n<p>                  thousand) with two sureties of the like amount each or any other<\/p>\n<p>                  surety to be fixed by the court below to the satisfaction of the 3rd<\/p>\n<p>                  Additional Sessions Judge, Naugachia at Bhagalpur, in connection<\/p>\n<p>                  with Sessions Trial No.1101 of 2010, subject to the conditions (i)<\/p>\n<p>                  That one of the bailors will be a close relative of the petitioner, who<\/p>\n<p>                  will give an affidavit giving genealogy as to how he is related with<\/p>\n<p>                  the petitioner. The bailors will undertake to furnish information to<\/p>\n<p>                  the court about any change in the address of the petitioner, (ii) That<\/p>\n<p>                  the bailors shall also state on affidavit that they will inform the court<\/p>\n<p>                  concerned if the petitioner is implicated in any other case of similar<\/p>\n<p>                  nature after his release in the present case and thereafter the court<\/p>\n<p>                  below will be at liberty to initiate the proceeding for cancellation of<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p>       bail on the ground of misuse, (iii) That the petitioner will give an<\/p>\n<p>       undertaking that he will receive the police papers on the given date<\/p>\n<p>       and be present on date fixed for charge and if he fails to do so on<\/p>\n<p>       two given dates and delays the trial in any manner, his bail will be<\/p>\n<p>       liable to be cancelled for reasons of misuse, and (iv) That the<\/p>\n<p>       petitioner will be well represented on each date and if he fails to do<\/p>\n<p>       so on two consecutive dates, his bail will be liable to be cancelled.<\/p>\n<p id=\"p_4\">                   The fact that there is only one other case pending against<\/p>\n<p>       the petitioner shall be verified by the Magistrate before releasing the<\/p>\n<p>       petitioner on bail.\n<\/p>\n<p id=\"p_5\">\n<pre id=\"pre_1\">JA\/-                                           (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Manoj Kunwar vs The State Of Bihar on 14 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
