GP appearing on behalf of applicants and learned<br \/>\nadvocate Mr. Vijay N. Raval appearing on behalf of opponents<br \/>\nclaimants.\n<\/p>\n<p id=\"p_1\">\tLearned<br \/>\nAddl. GP Mr. Trivedi submitted that this award, which is under<br \/>\nchallenge, has been passed by Reference Court, Godhra in respect of<br \/>\nvillage Mojari where previous award of village Rasulpur has been<br \/>\nconsidered. Section 4 notification is dated 15th July 1999<br \/>\nand Section 6 notification is dated 9th December 1999. The<br \/>\nLand Acquisition Officer has passed an order on 7th March<br \/>\n2000 and awarded Rs.7\/- for non-irrigated land and Rs.8\/- for<br \/>\nirrigated land. But, Reference Court has awarded Rs.65\/- per<br \/>\nsq.mtrs., as additional amount of compensation in favour of<br \/>\nclaimants. He submitted that in previous award of village Rasulpur,<br \/>\nBhathvada village was considered and on that basis, that award was<br \/>\npassed. Against Bhathvada village, appeals are preferred by State<br \/>\nAuthority, which are pending before Division Bench of this Court. He<br \/>\nalso submitted that even in case of Rasulpur village, appeals are<br \/>\npreferred by State Authority, which are also pending before this<br \/>\nCourt. He further submitted that there is a distance of about 45<br \/>\nkilometers between village Bhathvada to village Punsari. He submitted<br \/>\nthat while deciding reference in respect of Bhathvada village,<br \/>\nprevious award in respect of village Punsari has been relied by<br \/>\nReference Court. Therefore, appeals preferred by State Authority are<br \/>\npending before this Court. He submitted that this Court might be<br \/>\ndirected to deposit the amount awarded by Reference Court, but, not<br \/>\nto permit opponents claimants for withdrawal of 50% amount.\n<\/p>\n<p id=\"p_2\">\tLearned<br \/>\nadvocate Mr. Vijay N. Raval appearing on behalf of opponents<br \/>\nclaimants submitted that in those appeals preferred by State<br \/>\nAuthority, Division Bench of this Court has permitted 50% withdrawal<br \/>\nto respondents claimants while giving direction to Sate Authority to<br \/>\ndeposit entire awarded amount together with cost and interest.\n<\/p>\n<p id=\"p_3\">\tI<br \/>\nhave considered submissions made by both learned advocates appearing<br \/>\non behalf of respective parties and I have also appreciated the<br \/>\nanxiety which has been shown by learned Addl. GP Mr. Trivedi before<br \/>\nthis Court today.\n<\/p>\n<p id=\"p_4\">\tHence,<br \/>\nRULE.\n<\/p>\n<p id=\"p_5\">\tLearned<br \/>\nadvocate Mr. Vijay N. Raval waives service of notice of rule on<br \/>\nbehalf of opponents   claimants.\n<\/p>\n<p id=\"p_6\">\tWith<br \/>\nconsent of both learned advocates, this group of civil applications<br \/>\nis taken up for hearing and final disposal today.\n<\/p>\n<p id=\"p_7\">\tI<br \/>\nhave considered the facts which have been highlighted by both learned<br \/>\nadvocates and according to my opinion, this being a money decree,<br \/>\ntherefore, appellant must have to deposit entire awarded amount<br \/>\ntogether with cost and interest before Reference Court concerned.<br \/>\nTherefore, interim relief in terms of Para 5(b) on condition that<br \/>\napplicant   State Authority shall have to deposit entire awarded<br \/>\namount together with cost and interest and other statutory<br \/>\nconsequential benefits before Reference Court concerned within a<br \/>\nperiod of six weeks from date of receiving copy of present order.\n<\/p>\n<p id=\"p_8\">\tAfter<br \/>\nrealising said amount from applicant   State Authority, it is<br \/>\ndirected to Reference Court concerned to pay 50% amount by account<br \/>\npayee cheque in name of each opponent   claimant after proper<br \/>\nverification.\n<\/p>\n<p id=\"p_9\">\tIt<br \/>\nis further directed to Reference Court concerned that rest of the<br \/>\namount is to be invested in any Nationalised Bank initially for a<br \/>\nperiod of three years with cumulative interest, but, FDR is to be<br \/>\nremained with Nazir of Reference Court concerned which requires<br \/>\nperiodical renewal till first appeals are finally deciding by this<br \/>\nCourt.\n<\/p>\n<p id=\"p_10\">\tIt<br \/>\nis made clear by this Court that opponents claimants are not entitled<br \/>\nany amount of interest from said FDR till first appeals are finally<br \/>\ndecided by this Court.\n<\/p>\n<p id=\"p_11\">\tAccordingly,<br \/>\nrule is made absolute to that extent in each application.\n<\/p>\n<p id=\"p_12\">[H.K.\n<\/p>\n<p id=\"p_13\">RATHOD, J.]<\/p>\n<p>#Dave<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court State vs Fatesinh on 29 January, 2010 Author: H.K.Rathod,&amp;Nbsp;
