Advocate\n\nHon'ble Rajesh Dayal Khare,J.\n<\/pre>\n<p id=\"p_1\">Heard learned counsel for the petitioner and the learned AGA for the<br \/>\nState.\n<\/p>\n<p id=\"p_1\">This application under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of the Code of Criminal Procedure<br \/>\n(in short &#8220;the Code&#8221;) has been filed for quashing of the proceedings of<br \/>\nCase No. 1228 of 2009 (State v Ram Vilash &amp; others) under <a href=\"\/doc\/1011035\/\" id=\"a_1\">Sections<br \/>\n323<\/a>, <a href=\"\/doc\/555306\/\" id=\"a_2\">504<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_3\">506<\/a> and <a href=\"\/doc\/222396\/\" id=\"a_4\">427<\/a> IPC, PS Maiel, District Deoria pending before the<br \/>\nJudicial Magistrate, Deoria and also for quashing of the cognizance<br \/>\ntaken in order dated 20.06.2009.\n<\/p>\n<p id=\"p_2\">It is contended that vide order dated 20.06.2009 cognizance has been<br \/>\ntaken in the case and it is argued that charge sheet had been submitted<br \/>\nunder <a href=\"\/doc\/1011035\/\" id=\"a_5\">Sections 323<\/a>, <a href=\"\/doc\/555306\/\" id=\"a_6\">504<\/a>, <a href=\"\/doc\/180217\/\" id=\"a_7\">506<\/a> and <a href=\"\/doc\/222396\/\" id=\"a_8\">427<\/a> IPC, which are non-cognizable<br \/>\noffence under<a href=\"\/doc\/1569253\/\" id=\"a_9\"> Indian Penal Code<\/a> and reliance has been placed on the<br \/>\nExplanation to <a href=\"\/doc\/915147\/\" id=\"a_10\">Section 2<\/a> (d)<a href=\"\/doc\/1569253\/\" id=\"a_11\"> of the Code<\/a>, which reads as follows:\n<\/p>\n<p id=\"p_3\">&#8220;explanation-A repord made by a police officer in a case which<br \/>\ndiscloses, after investigation, the commission of a non-cognizable<br \/>\noffence shall be deemed to be a complaint; and the police officer by<br \/>\nwhom such report is made shall be deemed to be the complainant.&#8221;\n<\/p>\n<p id=\"p_4\">Therefore, on the basis of the aforesaid Explanation, which has been<br \/>\ninterpreted in a Single Judge decision of this Court in Dr. Rakesh<br \/>\nKumar Sharma v State of U.P. &amp; another [2007 (9) ADJ 478], it has<br \/>\nbeen held that when the charge sheet is only of non-cognizable<br \/>\noffences, in view of the aforesaid provision, the charge sheet should be<br \/>\ntreated as a complaint. The argument is well founded and the order<br \/>\ntaking cognizance is set aside. Now the Magistrate may pass an order<br \/>\ntaking cognizance if, he so chooses, by proceeding in this matter as a<br \/>\ncomplaint case under Chapter XV of the Code. He can also keep this<br \/>\nfact in mind that in view of Proviso (a) to <a href=\"\/doc\/943588\/\" id=\"a_12\">Section 200<\/a> of the Code, which<br \/>\nreads as follows:\n<\/p>\n<p id=\"p_5\"> &#8220;provided that, when the complaint is made in writing, the Magistrate<br \/>\nneed not examine the complainant and the witnesses-\n<\/p>\n<p id=\"p_6\">(a) if a public servant acting or purporting to act in discharge of his<br \/>\nofficial duties or a Court has made the complaint.&#8221;\n<\/p>\n<p id=\"p_7\">That is if the complainant who gives the information in writing is a public<br \/>\nservant, who is acting in discharge of its official dutites, it may not be<br \/>\nnecessary to examine the complainant and the witnesses.\n<\/p>\n<p id=\"p_8\">With these observations, this application is allowed.\n<\/p>\n<p id=\"p_9\">Order Date :- 1.2.2010<br \/>\nshailesh\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Ram Vilash vs State Of U.P. &amp; Another on 1 February, 2010 Court No. &#8211; 49 Case :- APPLICATION U\/S 482 No. &#8211; 34575 of 2009 Petitioner :- Ram Vilash Respondent :- State Of U.P. &amp; Another Petitioner Counsel :- D.K.
