Presiding Officer, Fast Track<br \/>\nCourt, Jetpur Camp at Upleta vide order dated 13.10.2010 passed in<br \/>\nCriminal Misc. Application No. 416 of 2010.\n<\/p>\n<p id=\"p_1\">2.<br \/>\n The respondent is the original accused in the criminal complaint<br \/>\nbeing C.R. No. I-90\/2009 registered with Jetpur Taluka Police<br \/>\nStation, District Rajkot for offences punishable u\/s. 192, 196, 197,<br \/>\n198, 464, 465, 468, 470 and 471 of <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>. In connection with the said<br \/>\noffence,  he was arrested on  and was produced before the competent<br \/>\nCourt. The respondent preferred application for regular bail before<br \/>\nthe Court below and this Court, which came to be dismissed and<br \/>\nwithdrawn respectively. Thereafter, the respondent &#8211; original<br \/>\naccused preferred Criminal Misc. Application No.  416 of 2010 before<br \/>\nthe court of learned  I\/c. Presiding Officer, Fast Track Court,<br \/>\nJetpur Camp at Upleta, who allowed the said application, vide order<br \/>\ndated 13.10.2010. Hence, this application.\n<\/p>\n<p id=\"p_2\">3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. While appreciating the evidence adduced before it the<br \/>\nCourt below found that at the time of the incident the accused person<br \/>\nwas not the Managing Trustee and he was only the member of the Trust.<br \/>\n Looking to the allegations made in the complaint it does not appear<br \/>\nthat accused person was directly implicated with the commission of<br \/>\nthe alleged offence.  After considering the above aspects, the<br \/>\nevidence on record, and that the trial will take a long time, the<br \/>\nCourt below granted regular bail on conditions to the accused.\n<\/p>\n<p id=\"p_3\">4.\t\tConsidering<br \/>\nthe reasons given by the Court below in the impugned order and<br \/>\nkeeping in mind the law on the subject, I do not find this to be a<br \/>\ncase wherein the bail granted to the accused deserves to be<br \/>\ncancelled.
